Bernie Sanders Says Police, Not Colleges, Should Handle Rape
'Has got to be understood as a very serious crime.'
Sen. Bernie Sanders said Monday that campus rape disputes should always be handled by the police, rather than university administrators, departing from conventional left-feminist thinking on student-on-student violence.
According to The Hill, Sanders maintained—somewhat dubiously—that campus rape was an "epidemic," but not one the universities themselves had any business trying to resolve:
"Rape and assault is rape or assault whether it takes place on a campus or a dark street," he said Monday at the Black and Brown Presidential Forum in Iowa.
"If a student rapes another student it has got to be understood as a very serious crime, it has to get outside of the school and have a police investigation and that has to take place."
Sanders' comments on this subject might seem uncontroversial, but in fact, he is very much going against the grain of current liberal thinking. Left-leaning anti-violence activists tend to oppose measures that would obligate survivors of sexual assault to bring their claims to law enforcement because they fear that this will discourage victims from reporting at all. They say that accusers should be able to choose whether they want to go to the police or whether they want to go through the campus process. Hillary Clinton's plan to address student rape, for instance, presumes that on-campus adjudication is an equally valid method of handling disputes.
The problem with on-campus adjudication, of course, is that university administrators lack training in the rules of evidence and due process, and often do a terrible job safeguarding the rights of the accused and the rights of accusers. The defenders of this option evidently believe two things: 1) it can be reformed so that all accusers are treated well (they generally don't care about the accused), and 2) students deserve a special, quasi-legal arrangement where their claims are evaluated under a lower burden of proof than the claims of regular people who have to go through the criminal justice system. Good for Sanders for denouncing such an arrangement.

If your sister or daughter or niece were raped on campus, would you want a campus show trial or a police investigation? Understand that the universities are pushing to arbitrate ALL campus rape. Ask a progressive (or a conservative for that matter) if the law of supply and demand applies to labor markets, while talking about minimum wage. The ask the same question when talking about immigration or international trade. You will almost invariably get two different answers (unless you're talking to 1990s Paul Krugman of course).

"It's relatively new for Hillary to talk about that," Biden continued, acknowledging that Clinton has "come forward with some really thoughtful approaches to deal with the issue" of income inequality.

How is that any different from almost any other crime? Any thief can say his victim gave him the money, and that the victim is simply revoking his consent to the gift after the fact. Rape isn't really peculiar in that respect. With most crimes, the question of the credibility of the alleged victim is inevitable. On;y unlike with rape, special laws serve to make it impossible to question the accuser's credibility in the court of law in many circumstances.
Judging from today's coverage, Sanders is the second-most libertarian candidate in the running, Cruz is an unkind man who probably eats babies, and Trump is the reincarnation of Hitler himself.
Thank God we have a libertarian magazine to buck the mainstream consensus and steer us on the right path towards smaller government and away from socialism.

Now, if I wanted to be perfectly fair to the colleges (and I'm not sure I do), the proper comparison in most cases is between the campus courts and the plea-bargain process in the real-world courts.
Only a minority of cases go to trial and receive the benefit of "the rules of evidence and due process."
The rest of the cases are negotiated based on mutual threats - the prosecution threatens to send the defendant away for several years, and the defense threatens to make the prosecution spend time and money proving its case, with the risk of acquittal and thus breaking the prosecution's winning streak.
And if the defendant happens to be innocent, he or she...OK, *he*...will still have to be worried about being convicted despite his innocence and getting a harsher punishment than he could get through negotiation.

I can't resist playing devil's advocate, so here I go. Campus administrators don't understand due process, but then again the most they can do is expel a student from the university. They can't impose fines or jail time. Therefore, what are libertarians complaining about? Can't a private organization have discretion on who to admit or expel from its body without conforming to standards imposed by the government or public?

I highly doubt it. I don't think it's... "problematic" to point out that Sanders holds some contradictory points of view. In fact, those contradictory points of view should be waved mercilessly in the faces of his supporters, like a big, flaccid penis.
Congress would pass absolutely nothing with him in power, so that's something. But then there's the SCOTUS appointments.
Congress has to approve those, too. Bernie would get a Secret Service detail to hold him down and apply deodorant every morning, but not much more.
Assuming Presidency worship doesn't supersede his very limited political capital. Obama's agenda got a lot further than some were willing to believe at the outset.

At least with any given Republican, we have a 50/50 shot at another Scalia, Thomas, or Alito. With Bernie (or Hillary) we're guaranteed another Kagan or Sotomayor (or worse).
