The state Supreme Court set a high bar for citizens to prevail in lawsuits against government or police officials, with a recent ruling upholding the immunity of Concord police and the city of Concord in what the judges called “a close case.”

The ruling last Wednesday stems from the 2009 arrest of John Farrelly by Concord police officers Walter Carroll and Eric Pichler after Farrelly allegedly sent a series of harassing emails to his ex-girlfriend.

The two arrested Farrelly on a charge of harassment. According to Farrelly’s testimony, Pichler told him at the time, “This is what you get for f—- with a 30-year veteran of the Concord PD.”

Because the officers believed that the crime had occurred within the past 12 hours, they arrested Farrelly without a warrant. They were later informed by the county attorney that the statute cited in Farrelly’s arrest had been ruled unconstitutional and the charges were dropped.

The warrantless arrest would have been legal only if Farrelly’s conduct presented a “credible present threat” to his ex-girlfriend’s safety.

“During his deposition, Pichler stated that the plaintiff was probably not a present threat to his ex-girlfriend,” according to the ruling.

The Superior Court judge agreed that the warrantless arrest was unlawful, but ruled that the defendants were immune from prosecution because the officers’ actions, while possibly negligent, were not “wanton or reckless.”

The COPs are now shooting the neighbors and kids with toy guns.

You know who is to blame:

The BLACK people calling the POLICE on other BLACK people. THis happened in this case and in yesterday’s chicago shooting.

As for the Cops shooting 1st and asking questions later, that’s par for the course.
The officer responsible for the shooting is now on Paid Vacation and will be cleared on this…as always.

I doubt the person who called the police intended for Rice to get shot. But if the caller knew that Rice had a “toy gun”, then why didn’t he or she confront him directly before calling the police? “Hey, young man, that gun looks realistic and you could get hurt if someone mistakes it for the real thing.” If he tells you to fuck off, then wash your hands of it. I don’t know what calling the police was supposed to accomplish, given the facts at hand.

I don’t know how it works in Canada, but in the US, all refugees are “privately” sponsored. That is, the Federal government grants them refugee status, but 1 of 9 voluntary agencies or VOLAGs do the sponsorship. Sponsorship meaning that the agency is legally and financially responsible for the refugee. Since the US Office of Refugee Resettlement provides the VOLAGs with some funding, with the agency expected to raise the rest of the funds, the best descriptor would be private-public, but as far as I know there is no purely public refugee resettlement program currently operating in the US.
