Los Angeles Pulls Trigger on Massive Minimum Wage Hike; Doesn't Know Who Will Actually Have to Pay It
Demands $15 per hour by 2020.


The City Council of Los Angeles has formally said yes to a huge increase in the city's minimum wage. By 2020, businesses within the city will be expected to pay their employees a minimum of $15 per hour. The council voted in the affirmative (again) on Tuesday, but have essentially put off dealing with the controversies that have popped up over who would actually be affected by the new rules. From the Los Angeles Times:
One lingering, highly contentious question is whether unionized companies should be allowed to negotiate for a sub-minimum wage with their employees. The Los Angeles County Federation of Labor sought to add that provision to the ordinance in the final days of the debate, saying that it would help avert legal challenges and allow union workers to trade pay increases for other benefits as they saw fit.
Business groups angrily attacked it as a ploy to prod companies to unionize. Deluged with criticism, council members agreed to study the provision further. …
Other sensitive, pending issues include whether to loosen the minimum wage requirement for programs that train the disadvantaged and disaffected for jobs. Another unresolved matter is whether to restrict restaurants' use of surcharges to offset added labor costs.
Lawmakers are also examining how the wage law would apply to out-of-town companies whose workers venture into Los Angeles. Several council members also asked for a report on whether to exempt small businesses — those with up to 50 workers — when the value of employee benefits meets or exceeds the wage requirements.

There's a lot to shake one's head about here. They're actually considering trying to prohibit restaurants, which often have tiny profit margins, from passing their new costs along to customers, which is just flat-out bonkers.
Brian Doherty and Matt Welch have previously written about concerns with the Los Angeles plan, Doherty about how it could absolutely screw over non-profits who help provide work and train people on the margins of society (like ex-convicts) and Welch about how the labor unions, who have been the primary force driving this whole effort, want to exempt themselves from the law.
Let me be a little more clear: This was exactly the labor unions' goal all along. We have seen this in previous instances where cities have introduced drastic minimum wage increases, again after heavy pushes by labor unions. In fact we saw it earlier in Los Angeles when the city forced hotels with more than 300 employees to pay minimum wages even higher than this proposed plan. Union labor is exempt if they negotiate lower salaries.
This "minimum wage" is meant to actually be a tax on non-union labor. I wrote about this situation last December:
What better way to get workers to accept unionization than to force a situation where they could be laid off unless their employers agree to unionized collective bargaining to keep wages down? But the unions will claim they're the ones looking out for the workers. And they'll blame corporate greed for any layoffs while counting their union dues off in the corner.
But now the City Council doesn't seem to be excluding organized labor from the rules just yet, which would be hilarious if it sticks. But the cynic in me expects that it won't. There's still time for donations. Oops, I mean there's still time for amendments. Amendments is what I meant.

The idea of the minimum wage isn't to get rid of poverty, just to get rid of poor people. No more low-wage employees means no more low-wage employers means the low-wage employees are going to have to go somewhere else, anywhere else. I'm pretty sure the studies done 5 years down the road on this are going to show a positive impact for LA - nobody's poor in LA any more.

They do it without the extra software anyway, but man that sounds handy. I remember having to go through the point of sale system and "coupon" out a bunch of money each night after close so we could pay our cash payroll guys and a couple small cash vendors. From my experience, the skim is not so much used to avoid the taxes so much as avoiding the extra regulations and hassles - reduce that burden and you reduce the need to skim. It hurts your business valuation and access to financing when you under report sales, so many wouldn't need to do it.

It'll start with eliminating condiments (if they can't charge extra for them) as well as extras on the burgers (pickles, etc). They'll cut portion sizes, eliminate less profitable menu items, cut operating hours, etc. When they still get in the red, it'll be time to shut the operation down.
They aren't trying to prohibit restaurants from passing their new costs along to customers, they're simply prohibitting retaurants from saying where those new costs are coming from. Restaurants can raise their prices, they can't ssay why/i they are raising their prices.

One problem with our system that's existed from the beginning is that the states have "police power," which means a much, much broader legal right to meddle in everything than the federal government is supposed to have.
Yes, municipalities can set wages as long as they're not contrary to state or federal regulations. So while they couldn't set a minimum wage below the federal minimum wage, they can set one higher than the federal minimum wage.
Every time this comes up, the busybodies rant about how no one can raise a family of four on anything less than $15/hr.
So if we use govt to force employers to pay $15/hr to a kid right out of high school, can't we also then force the kid to take in 3 people to be his "family"? I'm sure there will be lots of extra people who need a house/job after the new law goes into effect.
My common sense proposal would make sure that they wouldn't be left out. They'd still have somewhere nice to go and someone to provide for them.

The market always hates 'uncertainty' far more than 'known, painful regulations'. People in government never fucking understand this. They will write abominations like Dodd-Frank, then spend 10 years debating "what parts and how much of it to enforce". I've mentioned here before using an automated ordering system 20 years ago at the Taco Bell in Marietta, Georgia. The system was made by a local company so this was a test location - I ate lunch every day at this Taco Bell simply because the lunch-hour rush made it impossible to get in and out of any other place in under 30 minutes and this place was a 5 minute wait at most. A serpentine line with touch-screen kiosks along the line, you placed your own order and it spit out a ticket, by the time you reached the front of the line and handed your ticket to the single cashier at the counter, the 20 guys in the back already had your order ready. At that time, the kiosks didn't have a payment option, you still had to pay at the counter, but with the ubiquity of debit cards the process could only be faster now.
As it will be shortly in LA.
Because of a schedule which is beyond my control, I end up eating fast food in LA once a year. Except for last year, when the line at the Dennys was such I ended up grabbing something in Santa Clarita.
But this time next year, I'll be the lines are the kiosk will be minimal, and they might get the order right (NO CHEESE! Did you hear me? NO CHEESE!)
Already most grocery stores and pharmacies have automated checkout, so they have to hire maybe one checker for the whole store. I see no reason why fast food isn't going to go that route, with just enough human support to prevent theft but otherwise customers doing everything themselves (and if they automate the food delivery bins, even less need for that).
In a way, these minimum wages are a good way to force businesses to invest in productivity. But what's going to happen to the increased glut of unskilled, unemployed people will not be pretty.
If this increase was the boon that its proponents claim, there would be no phase-in period required.

Im reminded of when I worked for a different deli than the I currently work in. I worked part time and I wanted more than the 35 hours a week they would let me have. They couldn't give me more than 35 hours because then theyd have to give me benefits of a full timer. Im so glad the state of Massachusetts was there to protect me from myself. I'm okay with this as long as the people that wanted this get to suffer all of its consequences, positive and negative. I don't want to see endless waivers and exemptions and riders.
Anyone favoring this hike should be asked "why not $20 an hour?" Or "why not $30?" And if they're intelligent enough to answer "at a certain level it will cost jobs because many jobs are not worth that much but are still worth say $23 an hour to the employee" then ask how they got the magic number $15. Because the only way such a hike can work is if the jobs currently paying below that hourly wage are worth more than $15 to the employer and it's only a glut in the labor force that is keeping wages from rising. But even a lot of leftists agree that $15 is too high and will cost more in jobs lost than it will gain for the employees getting the raises.

I'm not sure we will.....experimenting on a few urban islands in the midst of a vast country doesn't tell us how this policy would work if it were applied country-wide. Maybe when we squeeze the balloon of a particular city, that city will still look ok, and the surrounding areas absorb the low-wage workers. Fewer McDonald's and Chik-fil-a-s and Wal-Marts in the city, but that's a good thing in progressive eyes, right? Damn right-wing capitalists. Out of town on a rail. What is even worse, in regards to unions asking to be exempt from the law to negotiate lower wages, is that these union employees will be earning less than their non-union counterparts, but also required to pay union dues. But i guess if you're making minimum wage, you probably ain't smart enough to figure out that the union is screwing you twice, without a reach around either time.
70% of the people work for private employees, they pay extra so that 30% of the people, public employees, get the same raise and give back half in taxation, while 1% of the population/hamburger flippers get a raise in a job that will reduce employees.
Winner= Government. Public Dem voters.
Losers= 70% of the population.. and of course, the very people the Union people are saying this raise is needed for.
The progressive communists have an endless list of demands which are paid for by other folks.
