    Fair Weather Property Rights Defenders?

    So last night I posted this link at the end of the body armor discussion:

    “TransCanada Corp., the Canadian company behind the Keystone XL pipeline, filed eminent domain proceedings against an estimated 90 Nebraska landowners Tuesday to secure the right to build the controversial project across their property.”

    Interestingly (or perhaps not), a lot of our Right-leaning posters rushed in to argue…nothing to see here, no big deal. I mean, as Gilmore said “Everyone’s keeping overall ownership of their land whether or not ED gets used. Everyone’s going to ‘get paid,'” or as SIV put it “You can still farm and graze over the easement”, or as The Late P Brooks says “it presents a fairly small intrusion into the daily lives of the people whose land it crosses.”

    So there you have it. Property rights are important to libertarians and all, but when the government forcibly takes your land and gives it to a third party business for something Really Important to ‘Society’it’s really not a big deal, especially when you can still use it for stuff.

    Fair weather property rights supporters.

      Well, I for one am against eminent domain here. If TransCanada wants to lay pipe it has to get affirmative consent first.

      Hell, the gas company is about to rip up our yard in a couple of weeks and there isn’t a damned thing I can do about it. The gas lines are fine, fucks. They don’t need to be replaced!

      This I disagree with. It’s fine for the company to purchase rights to cross peoples land, but wrong for them to get the gov’t to strong-arm property owners to give an easement through private property.

      I’d like to know how much the use of ED is simply as a workaround to other existing, poorly thought-out (as if there were other kinds) Federal policy. I’ve heard it mentioned before that the review process for these types of projects necessitates complete knowledge of the route before construction begins, and any changes start the whole process over.

      With the wheels of government moving as they do, it means that absent ED a series of intransigent landowners can torpedo a project with no realistic option available for infrastructure builders. If this is the case, it’s another case of bad policy being used to remedy the effects of bad policy.

        I think this gets to the heart of it. Plus, imagine a landowner gaining a ring around a city and shutting down all transit into/out without a large fee. Easements have to be part of private property ownership and sometimes it is justifiable to use force to gain them. Not sure about the Keystone case, yet, but common law should have some precedents, right?

    I say ‘libertarians’ because surely Gilmore, SIV and Brooks are libertarians, I’m not going to question that! The fact that this particular mass taking is something the GOP is currently prominently pushing and that the Democrat Party is prominently opposing (for stupid, non-property rights reasons of course, they are the Democrats after all) surely has nothing to do with this curious stance.

    OT: Fun Fact, US Passports set off metal detectors – probably from the RFID screening mesh in the cover. It’s really annoying crossing through a checkpoint without realizing I should have tossed the passport in the plastic tub with my keys.
