Industrial Band Skinny Puppy Sues Pentagon for Using Its Music as "Torture" at Guantanamo
Writing at Radio.com, Scott Sterling reports that long-running industrial thrashers Skinny Puppy have filed suit against the Pentagon over the use of the band's music against detainees at Guantanamo Bay. He writes:
It was revealed today (Feb. 6) that the band, which paved the way for acts like Marilyn Manson and Nine Inch Nails, has sent a bill in the devilish amount of $666,000 to the Pentagon after learning that its music is being used as a form of torture during interrogations at Guantanamo Bay.
"We sent them an invoice for our musical services considering they had gone ahead and used our music without our knowledge and used it as an actual weapon against somebody," Cevin Key, one of the band's founding members, explained in an interview with CTV News.
"I wouldn't want to be subjected to any overly loud music for six to 12 hours at a time without a break," he continued, adding that the band members were "offended" that their music was being used to "inflict damage."
No word yet on whether Barney the Dinosaur is planning a similar lawsuit.

I'm trying to figure out what claim they might have other than the usual infringement. I'm also wondering if there's a legitimate argument that using music for torture constitutes a fair use.
Defamation? The government is making an implicit claim that their music is so bad it is an instrument of torture, after all.
Of course, is that claim defaming to a band like Skinny Puppy?
No, that's protected speech. For instance, an insane person might say they hate the Warty Hugeman body of work. Insane and wrong, yes, but not defamation unless they said the author had a loathsome disease or something.
Is diabetes really that loathsome?

No. It is pronounced as one word, stress on the first syllable. Think Jewish surname rather than superhero.

The HnR post says they are suing, but the actual article says they just sent an invoice. This is probably the last that we'll hear of it.

I read that as "They sent the invoice instead of using it as an album cover".

No, I think I'm bolstering your point. I read that as they wrote the invoice as a joke to use as the album cover, but then some lawyer told them they might have "a case," so they mailed it to the DOD. I assume they won't file an actual lawsuit (if ever) until some time has elapsed without payment.
