Miami Township, Ohio, has agreed to pay $100,000 to settle a lawsuit brought by the family of a 17-year-old girl who was forced to strip naked then hosed down by former deputy police chief John DiPietro. He did this ostensibly to decontaminate her after she was pepper-sprayed. DiPietro also photographed a tattoo on the girl's back and sent it to a friend, but he insisted she was not naked when he did that.

Despite that, it'd be a federal crime to transmit those pictures across state lines. Even between states where it's legal for those images to exist individually.
It would also be a federal crime to transmit them using "any means or facility of interstate or foreign commerce," including teh interwebz.

Does child porn depend on the age of consent? I thought that was still 18 regardless, but I'm not sure on that. Even if it's not, I'm sure this would count as a privacy violation that should be prosecutable (such as taking upskirt shots).

It varies from state to state by what the age was listed for that location (it's 16 in New York, for instance) and if it crosses any of the invidible federal lines, it becomes federal crime if it's say, legal in your state (but less than 18) and you use the internet to move it elsewhere in your state.
