  • Whatever. Everybody's moved on to cronuts.

Edward Snowden told the South China Morning Post that he specifically took the job at Booz Allen Hamilton in order to track down evidence of the National Security Agency's secret surveillance program. President Barack Obama said today the administration is pursuing the "appropriate legal channels" to get Snowden back. "Appropriate legal channels" is code for "release the drones," isn't it?

  • Damon Root noted earlier the Supreme Court pushed an affirmative action in education case back to lower courts for more scrutiny. But they did rule on a workplace discrimination case, requiring that a claim that involves an employee's supervisor must show that said supervisor had actual control over the employee's hiring or firing.
  • The Supreme Court also ruled that generic drug manufacturers cannot be held liable for injuries caused by their products, given that they're following Food and Drug Administration's rules that require the content and labeling to mimic the brand-name manufacturer.
  • Italy's former Premier Silvio Berlusconi has been convicted of sex with an underage prostitute. He was sentenced to seven years of prison and is further barred from holding public office, but he still has appeals ahead.
  • Twinkies will be back on the shelves on July 15. They're marketing it as "The sweetest comeback in the history of ever." We'll just have to see.
  • The Colorado Civil Rights Division has ruled that an elementary school discriminated by blocking a transgendered girl, age 6, from using the girls' bathroom.

Zingers are the best Hostess product.

        1. Fist of Etiquette   12 years ago

WRONG. (Which ones are Zingers again?)

          1. Hyperion   12 years ago

Just proves that FOE smoked more weed than I did during the 70s. I remember what zingers are...

            1. C. Anacreon   12 years ago

Actually, Zingers were originally from Dolly Madison. I think that company got swallowed up, so to speak, by Hostess sometime long after my childhood.

Remember, they had Peanuts characters on Dolly Madison products, and different ones on the different kinds of Zingers. I think Charlie Brown was the chocolate ones (no, not Franklin) and Linus was on top of the Raspberry Zingers?

              1. Hash Brown   12 years ago

They used to run commercials during the Charlie Brown specials on tv. The Halloween one had a kid in a witch mask disappearing through a wall with a shopping cart. Freaked me out.

          2. A Serious Man   12 years ago

Basically Twinkies only with icing on the top and not as soft and mushy.

Ellen Page says Naughty Dog stole her likeness for Ellie in The Last of Us
I love this game. Almost at the end, I think.

    1. Hyperion   12 years ago

Isn't that an action FPS? I took a quick glance at it, but it didn't look like there were any RPG elements, so probably not for me...

      1. Matrix   12 years ago

        Third-person.

Not real RPG elements. It's very linear. I mean, you can upgrade some characteristics and weapons.

Very compelling story, though. And the voice acting, for the most part, is fantastic, especially from the main characters.

    2. C. Anacreon   12 years ago

That might be her face but it is definitely not her rack.

      1. Matrix   12 years ago

        what rack?

    3. Not an Economist   12 years ago

From what I've read, Naughty Dog based Ellie off the actress Ashley Johnson and made a few changes. The actresses do look similar. Unfortunately the changes made the character look like Ms. Page.

  6. Fist of Etiquette   12 years ago

...an elementary school discriminated by blocking a transgendered girl, age 6, from using the girls' bathroom.

The stand at the restroom door. Call in the National Guard.

    1. Rights-Minimalist Autocrat   12 years ago

I'm highly sympathetic to the struggle and confusion that transgendered people must go through, but I find it hard to believe that a 6 year old has exited that struggle and found her identity. "I want to be a girl" is about as meaningful from a 6 year old as "I want to be a fireman" is.

      1. Matrix   12 years ago

If that kid wants to be a fireman, then we better make it happen PRONTO! Throw some gear on and send him into a burning house to put out a fire and drag people trapped inside to safety. Nevermind he can't physically handle the job. It's his feelings that matter most!

      2. Fist of Etiquette   12 years ago

I don't pretend to know psychology of the transgendered mind, but at six years old, do kids even really need to be separated by gender at potty time?

        1. Thane-kin   12 years ago

Yes. Otherwise their sweet little minds will be corrupted and they will be turned into sex fiends.

Maybe that's what happened to your mom?

        2. Hyperion   12 years ago

The question that pops into my mind first, is does a 6 year old even need to understand what the term transgender means?

I guess I must just be an old fashioned unenlightened geezer or something.

          1. Fist of Etiquette   12 years ago

Imagine growing up you, but in a different body, the wrong sex. What age would you recognize the problem? Myself, I have no idea.

              1. PapayaSF   12 years ago

As they say, the reason men don't have breasts is that if they did, they would just play with them all the time and nothing would get done.

            3. lap83   12 years ago

I can't imagine knowing what it's like to have parts I've never had. To me, transgendered feelings border on religion.

          2. Zeb   12 years ago

Well 6 year olds do generally fall into fairly typical gendered behaviors. Girls play house and boys play war, that sort of thing. Not universal, but it's not as if gender is not meaningful to 6 year old children. But "transgendered" doesn't seem like a necessary concept at that point. Just let him be a boy who likes girly stuff for a while and see how it all works out.

            1. Hyperion   12 years ago

When I was 6 years old, being a boy playing with dolls and acting like a girl would have gotten you teased incessantly or even roughed up a little every day. Not saying that is right, just the way it was.

              1. Rights-Minimalist Autocrat   12 years ago

I'd imagine claiming to actually be a girl and wanting to use the girls' restroom would be even worse.

        3. Andrew S.   12 years ago

There is brain scan evidence that shows that the brains of transgendered individuals are similar to those of the opposite gender.

(But I'm not sure if that's the case here at all, and I don't know about that kind of psychology in a 6 year old)

      3. Red Rocks Rockin   12 years ago

I find it hard to believe that a 6 year old has exited that struggle and found her identity.

Look up the background of the parents and their kids. All of the kids have some sort of issue, whether it's autism, transgenderism, or one of them having mental issues from being dropped on their head at four months old(seriously).

The parents are basically the equivalent of SWPL white trash--treating their kids like social experiments and projecting their dysfunctional emotional issues onto innocent kids.

        1. Hyperion   12 years ago

Maybe the parents think that they will get attention, special treatment, or even money out of it. Pretty sick, from the way it sounds.

          1. Red Rocks Rockin   12 years ago

Maybe the parents think that they will get attention, special treatment, or even money out of it.

            Mission accomplished, apparently.

        2. Rights-Minimalist Autocrat   12 years ago

Oh, I had little doubt it was far-left activist parents behind it.

      4. Rhywun   12 years ago

I'm highly sympathetic to the struggle and confusion that transgendered people must go through

Me too. I had a male college roommate once who was a female when I saw her a couple years later. We weren't close or anything but it got me thinking. And being gay myself, I had my own issues to deal with but surely nothing on the level of this kid - regardless of how much the parents may or may not have fucked him up. However I am dubious that this accomodation is the "right" way "forward".

        1. Rights-Minimalist Autocrat   12 years ago

For sure. I had a high school classmate named Justin who is Carla now. The general assumption I make is that gay is probably really confusing, and transsexual is probably really really confusing. Transitioning from boy to man was awkward enough while straight, and I knew I wanted my penis to go into the socially acceptable orifice.

I pretty much meant what I said literally. I can easily imagine this being a geek kid who just doesn't like roughhousing with the boys and would rather do things like read or help mom cook. And so one day he says, "I want to be a girl." And it's possible that the kid really is transsexual, or maybe is gay, but I can't believe he knows it at 6. I mean, for fucks sake, can a 6 year old even understand the difference between trans and gay? Or a heterosexual transvestite?

Some kids who say they want to be firemen actually become firemen. But not most.

I wish I'd thought of this when I was 6. I could have used the girls' locker room throughout high school. Probably wouldn't have made up for getting my ass kicked every other day, though.

    2. playa manhattan   12 years ago

"compartmentalizing a child as a boy or girl solely based on their visible anatomy is a simplistic approach to a difficult and complex issue, the report said"

It's one thing to sign a contract and stumbling on illegal activity. It's another to sign a contract with the intent to break it. I have sympathy for him either way, and appreciate what he's done, but it seems he was fraudulent in his agreement.

He shouldn't have admitted this. It's yet another distraction from what he was trying to accomplish.

        1. Pro Libertate   12 years ago

I can't figure if this guy is all pure and light or if he's at least part scum. We'll likely never know for sure.

          1. hamilton   12 years ago

Like everyone he's probably partially scum. But that doesn't change the value of the message. In any case the government will almost certainly continue to release little tidbits of information about his scumminess. This is a delicate affair - they need stuff that will piss off most of the population, but is not so ham-handed as to look like an obvious ploy for a hate session. Hence all the "look he's thinking about going to CUBA! or RUSSIA!!!" shit.

My earlier prediction was that they'd get the (hot poledancing) girlfriend to say he was abusive or something. But now I am leaning towards something dangerously ideological that will alienate most of the country and tag him as a looney tune.

I therefore suspect they'll out him as a libertarian.

It's really ignorant for anyone to believe that Snowden being in Russia, or even staying indefinitely in Russia is because he's some type of anti-American traitor.

He has no other choice, except to be captured and tortured by the US, or killed by the US.

It's easy to say, he should do this, or that. But put yourself in his position, then it's not so easy.

              1. Pro Libertate   12 years ago

I suppose the best course of action would've been to stick it out here and face the heat, but with all of the "national security" claims and exemptions to, well, the Constitution, not sure he'd have gotten anywhere near the bully pulpit that most defendants get. The mistreatment of previous whistleblowers contributed to his flight, too, I'm sure.

The 14 most ridiculous things the police bought with asset forfeiture.

Under civil asset forfeiture, police can seize property suspected of involvement in criminal activity. Unlike criminal asset forfeiture, with civil forfeiture, people don't have to be convicted?or even charged?with a crime to permanently lose their cars, homes, or cash.
Even worse, in many cases, police get to keep what they seize through asset forfeiture. As long as cops get to keep what they seize, civil asset forfeiture will keep on spawning scandals.

In defense of San Francisco's Techies

    Read the comments, and weep:

The gays and hippies (as mentioned in another comment) did not come to SF to make money. And they did not displace tens of thousands of people by unleashing a wave of legal and illegal evictions. And they enhanced the culture, created culture, made the city a more interesting place.

I hate to generalize, but I meet tech people every day on my job and there are certain commonalities. The average ones seem to have been here for two months, have ADD, have no curiosity about the culture of their adoptive city, are completely humorless, dismissive of others not of their kind, have their face buried in a device, are poorly read, and demonstrate no political awareness other than a knee-jerk libertarianism bestowed upon them by their corporation.

The "hipster" tag is just silly. There's nothing hip about a corporate gig or rabid money-seeking. Recently, a Zynga employee talked my ear off about the "artistry" of the "creatives" at her firm. These were mass-produced computer games she was referring to. Puh-leeze! And buying high-priced tickets to Burning Man so you can go wild once a year does not make you hip, it makes you look like a sucker.

    1. NeonCat   12 years ago

Sounds like San Francisco should have turned itself into a lefty amusement park and kept out those money grubbing taxpayers - unless they were just visiting, of course.

    2. Irish   12 years ago

That comment can be boiled down to one sentence:

WHY CAN'T EVERYONE BE A DUMBASS SOCIALIST HIPPY??!?!

I also like that he claims San Francisco techies are libertarians. I guess that's why Silicon Valley gave so much money to Obama.

      1. PapayaSF   12 years ago

Yeah, as a San Francisco sort-of-techie, I can only wish that it were true.

    3. Thane-kin   12 years ago

        Yes?

        1. Thane-kin   12 years ago

Yeah, but indie games are still "mass produced".

          1. jesse.in.mb   12 years ago

Because you can download an unlimited number of exe or apk files?

I suppose that's technically correct, but unnecessarily pedantic. People use it to mean formulaic and lacking originality more than factory made rather than carved from elephant tusk by an artisan (like our canes were). We know the difference between a paint-by-numbers romance novel and a well crafted original story and we identify that with "mass produced" even though formulaic would probably be more technically accurate.

            1. Thane-kin   12 years ago

I know. I was just making fun of him for being a stupid dirty hippy douche.

"I began to wonder if the reason the NSA activities didn't upset me more on a visceral level, as opposed to an intellectual one, was that my default assumption of day-to-day experience was that I was being watched. Watched by Big Brother? Not so much. But being watched, observed, surveyed, seen? Yes. Welcome to what it's like to be a woman, gentlemen."

Research shows that plants possess an innate ability to do math in order to calculate food storage.

Overnight, when the plant cannot use energy from sunlight to convert carbon dioxide into sugars and starch, it must regulate its starch reserves to ensure they last until dawn.

Experiments by scientists at the John Innes Centre, Norwich, show that to adjust its starch consumption so precisely, the plant must be performing a mathematical calculation - arithmetic division.

"They're actually doing maths in a simple, chemical way - that's amazing, it astonished us as scientists to see that," study leader Prof Alison Smith told BBC News.

Acting Labor Secretary invokes FDR to argue for hiking minimum wage.

Seventy-five years ago today, during one of his fireside chats, President Franklin Roosevelt spoke about the Fair Labor Standards Act, calling it one of "the most far-reaching ... far-sighted program[s] for the benefit of workers ever adopted."

Roosevelt signed the bill the next day, setting the nation's first federally mandated minimum wage at 25 cents an hour and establishing bedrock labor protections that have kept our middle class strong and workers secure for decades. No longer could employers impose punishing working conditions at what FDR had called "starvation wages." FLSA also included the nation's first major restrictions on child labor and introduced the concept of premium pay for overtime work - if you worked more than the standard 44-hour workweek (later reduced to 40 hours), you were entitled to time-and-one-half pay.

FDR called out critics of the measure. He urged Americans to ignore the "calamity-howling" of those who "tell you that a wage of $11 a week is going to have a disastrous effect on all American industry."

Indeed, none of FDR's New Deal wage and price fixing had any detrimental effect on the economy whatsoever nor did it drag the Depression on for 8 years.

    1. Gojira   12 years ago

I wasn't aware that employers were ever able to impose punishing working conditions or starvation wages on anybody.

Were people not allowed to quit their jobs back then?

    2. Red Rocks Rockin   12 years ago

25 cents in 1938 was $4.13 an hour in today's dollars.

Funny how Harris never addresses that particular bit of math, especially the fact that $4.13 an hour went a hell of a lot farther back then.

setting the nation's first federally mandated minimum wage at 25 cents an hour and establishing bedrock labor protections that have kept our middle class strong and workers secure for decades.

Can someone please explain to me how a minimum wage helps the middle class at all?

If you earn double the minimum wage today you barely qualify as middle class as you would come in around the 35th percentile of incomes and I suspect the same was true in 1938.

To the extent that a minimum wage could benefit anyone it would be the poor, not the middle class

      1. Agammamon   12 years ago

Minimum wage doesn't benefit anyone except maaayyyybeeee those who are earning *just* below the MW.

Otherwise if you're below that cut-off you lose your job and if you're above it either it doesn't affect you or its money that could have been used for your raise or to hire a someone to do part of your job - either way you lose.

The whole "its good for the middle class" is just a phrase thrown out to try to get you to stop thinking too much about it - like "for the children".

        1. Rhywun   12 years ago

I remember my college days in Buffalo - minimum wage was a big deal because that is your wage if you're (a) in a low-cost city with a depressed economy and (b) looking for an easy-to-get, part-time, no-skill job. Later I discovered that the same sorts of jobs in a city like SF or NYC start at around double minimum wage.

    4. lap83   12 years ago

    4. The Immaculate Trouser   12 years ago

Eh, he has something of a point.

To Ayn Rand, empathy as such was basically useless, and the only value was in whatever pleasure a person derives in his actions towards others. Moreover, she places a lot of blame for the problems in the world at the feet of supposedly irrational abstract empathy.

Of course when she was called on it by libertarians and non-libertarians alike, she played semantics and redefined empathy and selfishness to the point where neither one is particularly useful or recognizable to anyone not steeped in the terminology of Objectivism.

IRS scandal is worse than previously indicated.

WASHINGTON (AP) ? The Internal Revenue Service's screening of groups seeking tax-exempt status was broader and lasted longer than has been previously disclosed, the new head of the agency said Monday.

An internal IRS document obtained by The Associated Press said that besides "tea party," lists used by screeners to pick groups for close examination also included the terms "Israel," ''Progressive" and "Occupy." The document said an investigation into why specific terms were included was still underway.

In a conference call with reporters, Danny Werfel said that after becoming acting IRS chief last month, he discovered wide-ranging and improper terms on the lists and said screeners were still using them. He did not specify what terms were on the lists, but said he suspended the use of all such lists immediately.

That's an excellent point, and I feel extra-guilty (as a Bucs fan) for forgetting about Brad Johnson when lamenting the lack of UF/FSU NFL QBs of quality. I think he was a much better QB than he's been given credit for. Mostly a bench player at FSU, too.

Miley Cyrus's new video is racist, but if you point it out, you're sexist.

    1. Thane-kin   12 years ago

Or is she just hoping for street cred? Note that she is wearing white, in the spotlight, the star of the video ? and they are treated as props, a background for her to shine in front of.

"But it's that song's video that really represents both Cyrus' most decisive attempt to position herself as a rebel..."

If an adult former Disney star wants to really position herself as a "rebel" maybe she should not be trying so hard to be a rebel. It seems more that she's desperately trying to conform with what an "adult" pop singer's shtick is supposed to be, not make her own personality.

dittybopper: He's actually kind of right: A democracy unbridled by strong individual rights applied equally can turn into a tyranny of the majority, and Jim Crow is a perfect example of that.

This is not what he said. He didn't say "Democracy has vulnerabilities" or "democracy has weaknesses". That would be ok, because while it recognizes the issues in there, it still shows some awareness that every governmental system has some form of abuse possible, but democrac is a pretty good way to handle it.

But he didn't say that. He said he doesn't believe in democracy. That's because he's a Randian (pun not intended). He seems to fundamentally believe in the truth that there is a class of people, the Maker class, which is actually better, and better suited to govern. It's like an inverse Marxism.

    1. Mad Scientist   12 years ago

The president plans to raise your power bill

On Tuesday, President Obama will announce his plan to increase everyone's power bill. Or, as he puts it, "a national plan to reduce carbon pollution, prepare our country for the impacts of climate change and lead global efforts to fight it."

If you accept the science of global warming, then you accept the fact that the president's unilateral action on climate change will have absolutely no effect in terms of adjusting the global thermostat to a temperature Obama finds desirable. The rest of the developing world, anchored by India and China, are building carbon-burning factories, power plants and even whole new cities that will overwhelm any new rules the president may impose on Americans and our struggling economy.

New craze in 'love pillows' depicting male characters

They're swiftly gaining popularity in the West, and not among men. Bizarrely, it's female fans of various male characters who are ordering these pillows. They range from mildly disturbing to hilarious, and I can't imagine that anyone would actually be shameless enough to buy them, but clearly I'm wrong.

So if you've ever wanted to be able to sleep with Batman, or Thor, you're in luck. And, if you're a fan of Benedict Cumberbatch, you'll have to choose whether you love Sherlock or Khan better, because they have both. Also, characters from The Hobbit, Doctor Who and Supernatural.

The Shrieking Harpy has claimed another foreskin:

Thank you, Ron. Apologizing is hard, and you sucked up and did it.

    [snip]

Feminists talked about the dangers of marginalizing women's voices, and CFI created the Women in Secularism Conference specifically to combat that. It's always been a smart organization that sees the intersections between secularism and feminism clearly. That's why it was frustrating to feel like that was all being pissed away because of a knee-jerk desire to placate misogynists?a desire that we've all experienced, but one that has to be resisted if positive change is to be achieved.

She is so classy when it comes to accepting apologies, don't you think?

    1. Coeus   12 years ago

Dumbass. They were all ready to take their ball and go home. Why the hell did he do that? They were gonna have their own conferences, where everyone walked on eggshells, and the feel good vibe of "wimmen power" would have paled quickly in comparison to the sterile atmosphere. Everybody wins.

And I don't hunt her down online - I occasionally stumble across her.

What I think decent people in the skeptic movement in the US should do is have nothing to do with her until she makes adequate recompense, perhaps by way of grovelling essay, for her disgraceful remarks.

That's what I mean by treating her as a pariah.

I missed how it was she got involved with the skeptic movement. How *did* that happen?

A self-described male feminist at a skeptics' conference dispassionately pointed out that several concepts near and dear to the feminist movement ("privilege" and "patriarchy", for example) aren't really all that well-defined and tend to be overused, and pointed out the problem with misandry in the movement.

Obviously, the correct course of action was to heap scorn on his head rather than address his points.

        1. SugarFree   12 years ago

If he had a point they would have addressed it, since they didn't address it, he must not have had a point.

Proof that men and women are different, a scene you'll never see:

Wow, the article descends into the mad realms by the second paragraph.

"Perhaps some women are lacking in a basic wanking education."

I'm sorry, uh Amanda - no-one teaches guys how to wack-off, we're able to figure it out all by our lonesome (literally).

". . .but societal pressure keeps them from creating too much friction."

WTF? Its not like guys get to brag about when or how often they rub one out. Yes guys masturbate, a lot, and yet if you're caught (or even suspected) you get made fun of. Women get masturbation aids advertised on tv for chrissakes.

    3. Zeb   12 years ago

Is it even possible to answer a question that starts with a conditional clause that is false?

Now, I'm no evolutionary psychologist, but it seems to me that it makes a whole lot of sense evolutionarily that men would be more interested in frequent sex and/or masturbation and less picky about sexual partners since biologically he is capable of reproducing several times a day, where a woman can only do so once a year or so.
