For many years President Obama said he supported equal rights for gay couples, except for the right to call their relationship a "marriage." That is exactly the policy he now says is unconstitutional. In fact, says Senior Editor Jacob Sullum, a Supreme Court brief filed last week by the Obama administration argues that a policy of marriage by another name violates the principle of equal protection more clearly than a policy of withholding any legal recognition of same-sex couples.
