The Most Vile and Inhumane Immigration Story You Will Read This Week
Felipe Montes lived and worked in the United States for nine years. During that time, he held a full-time job, paid his bills, and fathered two children with his wife, Marie. He failed, however, to pay several traffic tickets, or to acquire a driver's license or car insurance. As a result, a 2010 traffic stop ended with Montes being taken to a detention center where he was scheduled for deportation.
Marie Montes gave birth to the couple's third child while her husband was behind bars. Six weeks later Felipe Montes was deported. Two weeks after that, the Allegheny County child welfare department took all three children from Marie Montes on the grounds that she could not afford to take care of them, and put them in foster care, where two of them have already been abused.
Color Lines, the publication put out by the immigration reform think tank Applied Research Center, interviewed Montes, his wife, and their neighbors in Sparta, North Carolina. "He was a real good guy and as a worker he could do anything," said Montes' former boss. "He loved those kids more than anything. We'd be doing tree work and it'd be kind of dangerous and he'd say, 'I'll do this but if something happens you have to take care of the kids, ok?'"
"I love my kids to death," Montes told Color Lines. "When they were born, it's something so wonderful you can't explain."
Apparently, love and dedication doesn't qualify Montes to be a dad anymore, as the state of North Carolina is putting his children up for adoption:
Allegheny County has already convinced a judge to end family reunification efforts with Marie Montes. She wants the children to be placed with their father. "If they can't be with me, I want them to be with him," she said. "Nobody is a better father than he is."
But next week, on February 21, the county's Department of Social Services plans to ask a judge to cease all efforts to reunify the family and put the children into adoption proceedings with foster families. Though Felipe Montes was his children's primary caregiver before he was deported and has not been charged with neglect, the child welfare department nonetheless believes that his children, who have now been in foster care for over a year, are better off in the care of strangers than in Mexico with their father.
For Montes, this feels tantamount to kidnapping.
"I cannot find the words to tell you how important my kids are to me. I would do anything for them," he told Colorlines.com, speaking on his cell phone in Mexico while on a break from his job at a farm.
"In this world there are many injustices. At the very least, I would like them to send my kids to Mexico."

It isn't when there are millions of illegal immigrants in the country. A few high-profile deportations to bolster the image of a few politicians as tough on immigration plus a few thousand deportees caught mostly by accident do not constitute real enforcement.

Well, ending catch-and-release would be one thing. Not releasing criminal suspects on bail so that they can disappear is another. Building a border fence is yet another. Not undermining good faith efforts by the border patrol to enforce the law is another. And how about not harassing and persecuting states that are trying to deal with their illegal immigration problems in lieu of action by the Feds?
So, you want to deny criminal suspects something they're guaranteed in the Constitution.

You wish it was just one organization, then it would be possible to try to change the culture and procedures of that organization.

Different jurisdiction and different laws. The seizure of the children is by the state child services (or whatever the fuck it is called), not by ICE. Also, the kids are US citizens who have never lived in Mexico. This is really not parallel to Elian Gonzales at all. But still awful and just fucked.

Elian Gonzalez was going to be allowed to stay in the U.S. until the government of Cuba took a special interest in Elian and specifically demanded that the Clinton administration send him back. For whatever reason, the Clinton administration immediately reversed its position on Elian's return and forced Elian's return at the point of a gun. It really is a different case than that of Montes because in the case of Gonzalez, the kid was being sent back to the Cuban government, not to his father.

I've seen a few custody hearings invovling similar situations. I never saw anything this screwed up. Typically, there is either a relative in the US who can family-foster the kids, or the kids go with the custodial parent to the home country.

I don't know. Elian's mother tried to bring her son here, his relatives in the U.S. tried to keep him, and the government decided that Dad had superior rights. The citizenship issue doesn't seem to be the key issue, as I believe he was eligible for asylum.
Being eligible for asylum, that is, argue for, doesn't seem to be nearly as solid as full citizenship. But his father or mother would have to petition for him, and clearly the father didn't want that at all.

Having been through the process on behalf of my foreign born wife I can tell you that nothing about the process is automatic. Certainly not residency and even less citizenship.
If he was in the country illegally when the marriage took place, he would either have to go back to his native country and apply at a consulate there.
If he applied at an immigration office here he would be deported and subjected to a shitload of penalties before his petition would be considerd.
Even following the procedures getting a Green Card as a family member takes years and those are years you will spend separated from each other.
Frankly, getting legal status is a time consuming and expensive pain in the ass. It's no wonder so many people don't bother too.

It is cheaper labor that allowed many businesses to keep prices competitive despite the balooning monetary base and the massive malinvestment of the 90s and 2000s.
Do you want to guarantee higher prices and a lowering of the standard of living? I note that the story conveniently doesn't mention whether Mr. Montes was here legally or illegally. If he was here legally, deportation was probably an excessive penalty for the infractions he supposedly committed.
However, if he was here illegally, I submit that Mr. Montes created his own problems, and those of his children himself when he took it upon himself to enter the country illegally. Sure, it sucks for the kids, but they need to take that up with their old man, who's the asshole who created the unfortunate situation in the first place...

Why can't people understand that if you sneak into a country that the same thing will happen. I agree that immigration law is messed up, but when people come here illegally they by choice place themselves into an easily abused underclass. I am a big fan of the new aggressive laws in Arizona, but not for the same reason as most. I think that when we are able to get most of the illegal out we'll realize how much they do and the public will demand that we have real immigration reform to get them back.

My skepticism is born of experience. For decades, the national broadcast media and most of the print media was dominated by ideological leftists. During that time, the left got used to being able to lie and distort with impunity. The right, although it does occasionally spin things, doesn't come close to the dishonesty of the left because during those same decades any factual slip up or misrepresentation by the right was forcefully rebutted. At times, even factual treatments by the right were characterized as inaccurate or mendacious.
So when an organization which constantly uses the words "social justice" and "racial justice", never stops talking about race and the racist nature of America and American society, has a campaign to abolish the use of the word "illegal" in connection with immigration even though the legality of immigration is central to the issue starts promoting a personal sob story and starts throwing around horrific sounding numbers - yeah, I'm skeptical.
Perhaps you are too young and need to be reminded that with regard to numerous other issues (abortions, homeless, children who would be thrown on the streets if welfare reform were enacted, husbands who beat there wives during the Superbowl, high school students in the U.S. who have been sexually harassed, partial birth abortions, etc.), the left just pulls numbers out of their asses and expects sympathetic media outlets to publish their ass numbers without investigation and generally the media cooperates.
Incidentally, I agree with the opinion that this is really a problem with the social service organizations that are quick to take kids away from their parents, not with immigration per se.

The immigration system itself is the slap in the face to legal immigrants. The fact that countless numbers of people can't afford the thousands of dollars required and/or don't specifically meet any of the limited categories qualified for immigration means demand will always exceed supply. As the government has been unwilling to fundamentally reform the legal immigration process to make it easier to come here, people will find black market ways to get around it.
How this is a "slap in the face" to people who are qualified and do have the means is beyond me. I would be nothing but happy for them to avoid our horrific experience.

For some reason I don't think we are getting all the facts. The difference between this one and the boy from Cuba is that the boy from Cuba was born in Cuba. What I don't understand is why the mother just didn't pack up and go to Mexico when the dad was deported. When a US citizen chooses to marry someone who is here illegally and then have children, then you should understand there is a chance the one here illegally will be deported. I have seen this happen with some I know, but then people need to accept responsibility for their own actions and how those actions will affect their families.

Technically, Article 1, Section 8 referring to naturalization has been construed by courts to include immigration, even though that is not explicitly a function or power of government.

AS someone who works in immigration and has personally dealt with thousands of illegals, I can tell you my opinion for what it's worth: make legal immigration easier. Our irrationally restrictive immigration policy prompts many families to break the law when they otherwise would not, and I would bet that every single one of you who are on your moral high horse shouting "criminal" would do the same thing to help your family. The policy of keeping kids in the US while deporting their parents is stupid and destructive. I totally agree that families should be kept together (unless the parents want to put the kids up for adoption, which is unlikely to happen).
It is not an argument for open borders though. You can have controlled borders without producing stories like this. Just deport the kids with the parents.

I came to this country with a few suitcases, a handful of cash, and not much else. I started at the bottom. I worked in shipping and receiving, as a receptionist, file clerk, any shit job I could get just to get some work experience, and I worked my way up from there to where I am now. I followed the rules, i obeyed the law, I worked my ass off, and I tried to make good decisions along the way. And I did that without a college degree, a trust fund, or any other safety net. So, the system works, as tough and complicated and inconvenient as it may be.
I am very sorry to hear what situation your children are in right now, honestly. I agree they should not be in this mess. However, the only reason they are is a direct result of your decisions and choices in life. That I cannot feel sorry for.

All I hear now days from the illegal advocates are the worse story they have on record and because of this one incident we should overlook our laws ? We shouldn't hold illegals responsible for the crime and accidents they cause ? OUTRAGEOUS.
They know they are here illegally, they know America has requirements and they get more free stuff than our own citizens. I might have sympathy for one of two individuals, but don't have sympathy for this group.
I came here at age 9 with strangers, was lost and then detained, all in an attempt to find my mother who came to the US to escape the terror of Hurricane Mitch.
When I finally found my mom at age 9 in Georgia, she had started a new family,
and though I love her, I was not accpeted. I now live with another American family. In
spite of many challenges I have a 4.0 GPA in an IB high school, where I am in
the National Honor Society. I have produced a video about my engaging and
compelling story that I hope will help The Dream Act and kids like myself.
