Wisconsin Public-Sector Union Law on Hold
The Milwaukee Journal Sentinel reports that Dane County Circuit Judge Maryann Sumi has issued a temporary restraining order blocking the implementation of Wisconsin's new labor law:
Sumi's order prevents Secretary of State Doug La Follette from publishing the law - and allowing it to take effect - until Sumi can rule on the merits of the case. The next hearing on the case is slated for March 29.
Dane County District Attorney Ismael Ozanne, a Democrat, on Wednesday filed his complaint seeking to block the law because he said a legislative committee violated the state's open meetings law in passing the measure. The committee voted for it March 9, the Legislature quickly passed it and Walker signed it March 11.
Sumi said Ozanne was likely to succeed on the merits of the case.
"It seems to me the public policy behind effective enforcement of the open meeting law is so strong that it does outweigh the interest, at least at this time, which may exist in favor of sustaining the validity of the (collective bargaining law)," she said.

Figures. If it sounds too go to be true...it must be a lie about budget sanity.
Yeah, but you should hear Circuit Judge Sumi belt out "I Dreamed a Dream".
Pretty funny coming from the side that trashed the capital, beat people up, made death threats and broke into the capital to disrupt the vote.
Oh, and that whole fleeing senators thing.
hip hip hurray
ooh ooh judicial ac-tiv-ism !
Hello, dumbass!
I wish I could bet on things like that, where I already know the outcome!
What da fuck r u people bitch'n bout?
You all a bunch of fuckin' coca-roach. You know why? You don't have the guts to be what you wanna be? You need public unions like me.
You need unions like me so you can point your fuckin' fingers and say, "That's the bad guy."
So... what that make you? Good? You're not good. You just know how to hide, how to lie. Me, I don't have that problem. Me, I always tell the truth. Even when I lie.
So say good night to the bad guy!
Come on.
The last time you gonna see a bad guy like this again, let me tell you. Come on. Make way for the bad guy. There's a bad guy comin' through! Better get outta his way!
Hahahahaha you teafaggots just got what you deserve. Obama/Biden 2012!
Be sure to clean after yourself, I don't want any stains on the bed sheets. They don't clean themselves, you know!
Ch....
Why use such bad language?
Poor spoofing. Tony isn't a swearer, wouldn't drop the fag bomb, and would try to conceal the naked "obama/biden" partisanship. 5.5/10
Which means that, if the District Attorney's complaint prevails, the House and Senate can simply start over and pass the bill in open meetings. Ta-da!
i'm sure the dems left da state already... So, Na-Na!
Nope. One of the Dem state senator in the article is quoted as saying he would not leave this time. He was the one Walker negotiating. The GOP only needs one of the Ds to stay. Since they're already here, they can just repass it with quorom
We'll c.
They didn't need 1 democrat before, they won't need 1 the next time. They just need to have the correct public notification.
They just need to have the correct public notification.
This is probably bullshit as well.
They were in regularly scheduled session. While in session it is assumed they will be passing laws.
They might have broken their own senate rules but it is unlikely they broke any open meeting laws that a county judge is authorized to rule on.
"They might have broken their own senate rules but it is unlikely they broke any open meeting laws that a county judge is authorized to rule on."
Sounds about right. The unions are grasping at whatever straw they can find and found a judge who'd buy the story.
i'm sure the dems left da state already... So, Na-Na!
They don't NEED any D votes to re-pass the bill as is.
Dunno about the legal merits of the challenge -- is the notice requirements an internal legislative rule which can be waived, or is it something that is a law or in the state constitution?
It was dumb to rush it through like that, they should have been sticklers for following the rules to avoid challenges, but they still have to votes to re-pass the bill with lots of notice this time.
yup
the House and Senate can simply start over and pass the bill in open meetings. Ta-da!
I don't understand why they just don't do that today.
This happens and yet there's no penalty or fine for the fleabaggers refusing to do their job?
That's kinda fucked up.
ironically, this is just desserts to a state government that has forced union negotiations on private employers.
Sucks don't it?
I sense the tide is turning on the unions, however. They will lose in the end.
I agree Unions are Done...accept the POLICE!!!
They Will NEVER GET RID OF the POLICE UNION.
Somebody's gonna have to PROTECT The HAVE's as the HAVE-NOT list get bigger and bigger.
And, the HAVEs better pay the POLICE REAL GOOD. The POLICE Better have similar quality of Life as the HAVEs as they (the POLICE) are the ones with the GUNS!!!
The Future of this country will be something like Guatamala. Armed-Gated Communities. The regular Joe will never be able to do what the Joe from the 50s-80s enjoyed. Joe will now be working for nigger-dollars with NO BENEFITS. Better watch-out for JOE!!!
Wanna see how much u libertarians support GUN rights after JOE comes after U .... HA HA HA
Your ideas interest me.

Re: Alice Bowie,
Are you implying that poor people are a bunch of savages that require constant retraint?
Why you... you... YOU... RACIST!!!!!
I'm not referring the the classic poor. I'm referring to the neo-poor that was once part of the american middle class.
Let's see how it unfolds.

"I'm not referring the the classic poor. I'm referring to the neo-poor that was once part of the american middle class."
Uh, that would be the folks who get free medical care for life? The folks with retirement benefits at age 55? *Those* "neo-poor"?
Or the taxpayers?
Is this a terroristic threat transmitted along a series of tubes or wires?
Not at all. I trust that the war-on-the-poor in the US will fail as more and more Americans become poor. They may not become violent. However, they'll resort to some for of crime.

"Not at all. I trust that the war-on-the-poor in the US will fail as more and more Americans become poor."
Uh, who is "poor" in this matter?
"They may not become violent. However, they'll resort to some for of crime."
Ah, yes. Another claim for a protection racket.
Alice Bowie|3.18.11 @ 5:24PM|#
"...The regular Joe will never be able to do what the Joe from the 50s-80s enjoyed."
Is this sorta like the mythical 'working man'? Like, maybe the taxpayers?
"Joe will now be working for nigger-dollars with NO BENEFITS. Better watch-out for JOE!!!"
So it's a protection racket? Oh, good. I can afford better guns; JOE better watch out.
"They Will NEVER GET RID OF the POLICE UNION."
Wisconsin exempted them, but I don't think Ohio did with the bill they just passed. I don't know about the other states.
The police can obstruct justice just fine without a union, of course; the union just makes cop semen more palatable to Democrats. Republicans already have a taste for it.
Weren't there like ten thousand activists idiots wandering around the capitol at the time?
It's not like they secretly pulled this off in the dead of night.
Many, if not most, were students.
The irony being that the students learned more missing a week or two of class then they would have learned in months of class.
joshua corning|3.18.11 @ 5:33PM|#
"Many, if not most, were students."
So, they *were* idiots?
This mode of legislative deliberation is only valid and sacrosanct when progressives do it. Not to say that conservatives are above it either. But your point stands.
The Future of this country will be something like Guatamala. Armed-Gated Communities. The regular Joe will never be able to do what the Joe from the 50s-80s enjoyed. Joe will now be working for nigger-dollars with NO BENEFITS. Better watch-out for JOE!!!
moar caps, plz
No surprise, given the venue.
The Repubs can't be excited about the delay of litigating this, even though I give them good odds of winning. I think they gave two hours notice, and have a decent claim that they had good cause (in the form of rampant lawlessness and interference with the legislature by the unions) for not giving more notice.
But they can't be terribly excited about setting off another wave of vandalism and goons at the Capitol by holding another vote. Still, if they are politically adept, they should be able to get some mileage out of it.
Also, delaying implementation of this law means that unions have more time to "negotiate" some sweetheart backroom deals with their respective city and state governments.

Yep, no doubt. Short-term dying grasps. Even the lefty Chron admits it's the end of the line:
"Poll: CA public-worker benefits 'too generous'"
http://www.sfgate.com/cgi-bin/.....1ID7A3.DTL
The best argument, and by that I mean the funniest, is the meme from the left that this was passed "in the middle of the night."
The vote was held at 6pm. The teachers' union must believe that 6pm is "the middle of the night" because they can't imagine actually being at work at 6pm.
Just think if this bill was voted on in the summer! The teachers would be astounded! "What??? 6pm, in the summer??? Nobody works in the summer, let alone 6pm!"
Fire them all already, and be done with it. It's not like the supply of labor is scarce.
No kidding. While an exceptional teacher is truly valuable, and should be compensated accordingly, being an average teacher is not exactly like trying to hit a 95mph fastball. There are probably enough talented people among the currently-unemployed (probably among young lawyers alone) to make up for the teachers that cannot bother to teach for the mere $100K in total compensation that they get paid to work for 3/4 of the year.
This really does make a lot of sense.

Perhaps folks are beginning to realize that the lack of competition brought about by monopolies isn't a good thing for consumers/taxpayers and that even applies to monopolies on labor as well. Then again, maybe it's just because shiny happy people are in short supply.
That said, is the judge's name pronounced like I think it is? Sumi... Sue me, really?
really?
