Fascinating little crime story by Julia Reischel in Boston's Weekly Dig. A frightening creep (described as wearing "torn designer jeans and a white sweater that went down to his knees) made rounds in the city getting shopgirls to show him their feet while he snapped out a camera. And the shattered innocents who complied with him aren't getting much from the cops because the law doesn't know quite what to do with foot fetishists.
Feet, as the law sees it, just aren't a sexual zone… unfortunately for the Harvard Square fetishist's two victims, feet aren't on the assault side of that line. You can chalk this blind spot in the law up to the Bay State's fundamental prudishness about kink, and it cuts both ways for the fetish community. On the one hand, says Princess Kali, the local organizer of New England's premier foot fetish event, Footnight, it protects responsible foot fetishists -- the kind that don't force themselves upon strangers -- from persecution.

On the flip side, because the law doesn't acknowledge the existence of their very real sexual feelings about feet, foot fetishists can't be open about their particular proclivities. For foot fetishists, there's no clear boundary between permissible ogling and assault as there is with, say, a T&A man.

It was a little more than tricking them and snapping photos. He was also grabbing their feet without permission, and even pulled one woman's sock off. I'm not sure why the article seems to focus an the photo taking, though.
The fondling seems to bring the sexual issue more into focus. Unwanted touching seems to only be a crime if the touching is sexual or causes harm.

I have heard that the male gaze can be considered assault if the gaze lasts too long. When "dirty old men", such as myself, look at a pretty young female for more than about 5 seconds, some people could consider this an unwanted sexual advance, especially if the observed female person is less than say 18 years old.

By answering the question of where "sexual preference" comes from you also answer that question. They aren't, in my opinion, distinctly different categories.
Just think of all those poor pre-industrial humans with the genes for latex fetishism dying before Goodyear invented vulcanizaion. Not to mention Hindus with a leather fetish.

I am an anthropolgist/sociologist and study the human foot (in health and disease) and a shoe hisptorian with an interest in the psychosexual aspects of shoe design. Foot assaults as described here are not usually sexually motivated but do constitute a physical assault on an individual which contravines the law. Traditionally the judiciary (not the police) has dismissed this behaviour as aberrant (uncharacteristic) and
not brought them to prosecution. The increase in the crime of "up skirting" and "happy slapping" has forced a change in their thinking and brought the matter to public attention. Neither of these crimes however consititute a sex crime. There is certainly no evidence to the best of my knowledge to suggest paraphilias such as high level foot fetishism is hereditary (the same goes for homosexuality and paedophilia).
Foot assualts are reported more frequently (across the world) and which may have more to do with better policing than an epidemic of foot assaults. Something which has not been studied in depth is 'graduation' or the incremental increase in the series nature of assaults. The profile of serious sex criminals would suggest many start off their criminal career with minor offences such as stealing knickers (snowdropping)then progress to rape and murder.

I can easily accept that there is no genetic role in the development of fetishes, but I cannot see how homosexuality can be likened to a fetish. By casually including it in your parenthetical along with pedophilia, are you equating them?

There is enough political propaganda and pseudo-science so that a lot of people think homosexuality is provably genetic. I was goofing on that widely held belief with my comments above.
1) I thought unwanted touching was just classed "battery".
2) So, it's a violation of personal space and blah blah blah, so I can see it being a crime, but isn't this the kind of thing that is more appropriately dealt with by a punch in the face?

Foot fetish is common everywhere but there should be laws for the protection of women from
forceful foot fetish guys and those who take pictures of there feet in market and sell them even to other foot fetishist.
In response to the comment made by someone above i would like to state that there is no evidence so far which proves that homosexuality is genetic and the guy who made that theory was a homosexual himself and he did that just to cheat people about being homosexual.But foot fetishism cannot be campared to homosexuality as its much lesser offence and the level of harm to the indivisual is lesser from a foot fetishist the a homosexual and both are not proved as genetic by any scientist.
