    I'm confused: On what grounds is the city doing this? The article completely avoids the phrase "eminent domain"...

    Nice. Their argument is that what they are doing is ok because they could be doing much worse. Huh?

    "Under an ordinance law passed last year, the city will replace its nearly 300 newsstands ? a collection of often shabby, decades-old corrugated-metal shacks, owned mostly by individuals ? with uniform stands owned, designed and maintained by a single company."

    I am also a little confused; it isn't really clear who owns the current shacks. It says "the city will replace *ITS* newsstands" yet, as it says later in the paragraph, they are owned by the individuals? Well, whose are they? And why would the city have anything to say about it if they belong to individuals? Do they lease the space on the sidewalk?

    I do believe the article mentions that the stand operators license something from the city, be it the space, the opportunity to run a shop, or some other aspect of being a business on City property. I think it mentions revenue of $160,000 from such licenses every 2 years, compared to an estimated $400 million in 20 years from the corporate / ad-selling model.

    Ugh. That's Republican government at it's worst.

    I can't imagine what ordinary citizen, left or right, would support this plan. (Even charging property tax on the newsstands would be better. Hell, anything would be better!)

    George Bush, who supports Eminent Domain for Baseball Stadiums, on the other hand, would agree completely.

    I loved my old newstand. I can't believe they're doing this. There's something about those newsstands that gave New York a unique feel.

    What's next, celebrities telling me to buckle up in cabs?

    They should sue the city, or the corporation who buys the contract, for intellectual property theft. Claim that the character of a NYC newstand was developed by the stand owners, and that they are capitalizing on the stolen "brand" or whatever you'd call it.

    irilyth, the city already owns the sidewalks. As the owner, they can decide who is and who is not allowed to use their property, and under what conditions.

    This really sucks, though. So much for the little guy. And how long will it be before conservative busybodies get the city to pull all "controversial" magazines?
