In the March issue (not yet online), I wrote about a husband-and-wife team of Pennsylvania dairy farmers who were challenging a law that required them to contribute to "Got Milk?"–style advertisements. Now the Institute for Justice reports that they've won their case [PDF] on First Amendment grounds.

I'm with the Ayatollah on this one. It burns me up to know that my taxes are going for those ONDCP drug-free America ads, especially when opposing ads are banned from public transit venues, etc.

Don't take my money to sponsor speech that I oppose!

That's one small step for man, one giant leap for milk shakes.

    Nice going, IJ!

Now if they had only gone a step further and told the government to get the hell out of promoting specific foods. Honestly, how was this justified as a legitimate expense again?

So can they sue to get back all the money they paid into this program over the years?

  6. Grant Gould   21 years ago

Any links to the actual decision? All I see is the press release, and only fools and reporters trust press releases.

Ah, to answer my own question, http://www.ca3.uscourts.gov/opinarch/032522p.pdf

I have been a long time supporter of IJ. They win in courts what politicians fear to address.

Now if only I can quit paying for those drug free america ads.
