You say that Reagan was the beginning of the departure from moderate judicial nominees. At the risk of entering a debate over "They started it! No, you did! No, they did!", I seem to recall that one of the first few US Presidents (Adams? Jefferson? Madison? not sure) made a bunch of midnight appointments before leaving office to guarantee that judges favorable to his party would sit on the bench.

It's always nice to look back on the "good old days." It's almost as nice to blame the departure from "the good old days" on the other side. But I wonder if there ever were any "good old days."

The period from World War II to Reagan was characterized by much greater comity in judicial nominations, if I understand correctly. When Senate Republicans complain about "unprecedented" roadblocks, they are referring to the way things were during this period (well, on the Senate's side, anyway. They aren't complaining about the president departing from the tradition of nominating widely-respected, easily confirmable figures). Perhaps this period was the departure from the rest of American history, and the return of acrimony from the Bork nomination to present is a reversion to normalcy. But I think the system clearly worked better in the 40s, 50s, 60s, and 70s than today.

Joe--I think you've got it wrong. Getting a judge through these days is not about nominating those "who are acceptable to a broad segment of society." At present it's about nominating those who displease the majority but please Democrats on certain issues: for instance, a judge who would allow any hindrance to abortion, or who wouldn't let government judge people by the skin color, will be filibustered.

The courts, for better or worse, (and I don't know for how long, but at least since Bork) have placed themselves squarely in the middle of many hot issues that we can no longer vote on, and so have become predictably politicized. As long as parliamentary rules allow 41 Senators to easily prevent a vote, this will continue.

Any judge who interprets the Constitution in terms of a historical standard like original understanding will be a "radical" that most of the public disapproves of. This is true of anyone who follows an originalist course in strictly enforcing the Fourth Amendment against Aschroft, or the Tenth against Dianne Feinstein. So apparently the only recipe for success is to appoint a historicist who believes in a "living constitution"--which is to say, no constitution at all.

Hell, I wouldn't have ratified the damn thing in 1787-88 anyway. But since it's already there, I at least want it to be treated as an absolute prohibition on the government, imposed on it from above by the people--not as a malleable instrument that means whatever the government and the dominant legal culture say it means at any given time.

A "living consitution" is "no consitution"? I'd say a living consitution is any constitution--conditions and understandings always change, and courts will face literally unprecedented situations. Interpretation is necessary in any case (and the Supreme Court tends to take the most controversial), so any constitution through necessity will change through time.

Yes, Kevin, mainstream Americans disagree with you. You are part of a small minority. You are not going to get everything, or even most of, what you want. Deal. And I don't mean "Deal with it." "Hostitlity to government action"? Well, that kind of goes with defending civil liberties, doesn't it?

When Ass-crap was up for confirmation, the one thing that actually made me sympathize with him was Kennedy's expressions of moral outrage over his pro-gun statements. "What kind of extremist actually thinks Americans might need guns to defend against our own government?"

I just wish there was some discernable trace left in Ashcroft of the person who once believed Americans might legitimately fear their own government as a threat to their liberties.

Before I checked the link, I figured Brown had expressed some strong pro-Second Amendment views, and THAT was the reason for the liberals' ire. Well, if there's going to be any kind of pro-civil liberties coalition of right and left against the Patriot Act, it's either going to include pro-gun people on the right, or its going to be a one-wing bird.

That no judge should ignore the Constitution when doing so suits their ideological agenda is a philosophy all nominees must accept. So must all senators. For they too have taken an oath to uphold the Constitution, the whole Constitution, and not just the parts that, for the moment at least, lead to results they happen to like.

Without getting into the wisdom of this particular nominee...

There are two ways out of the mess that judicial nominations have become. One is for the president (and future presidents) to only nominate judges who are acceptable to a broad segment of society. If a nominee isn't going to get 80 votes easily, then her name shouldn't be submitted. If this rule of thumb were again to become the norm (I'd say it Reagan's nominees, taken as a whole, mark the beginning of the departure), then the advise and consent function would return to a focus on qualifications and temperment (as Republicans now say they want the process to be about). The opposition party would also avoid the kind of mass-attrition/vacancy-preserving that was carried out against Clinton nominees, since there would be no reason to suspect that a win in the next presidential election would result in a significantly different series of nominees.

The other way out would be an amendment to 1) require nominees to get a floor vote and 2) require nominations to be approved by a supermajority. The near-certainty of public defeat, and the desire to save political bullets for policy fights, would discourage presidents from nominating people who are not within a broad consensus.

Both of these would have the result of increasing the numbers of moderates and centrists on the courts, while tending to make sure that those few nominees who are outside the mainstream are truly excellent, rather than the radical, wet-behind-the-ears mediocrities that Bush has made the center of his judicial strategy.
