When The Resistance Tail Catches The DOGE
The Resistance sues a non-existent entity based on an irrelevant statute.
Mere moments after President Trump his oath, a group of progressive public interest groups filed suit to challenge DOGE. Of course, DOGE had not yet been created. It wasn't even clear what DOGE was. And who has standing to challenge a non-existent entity? But Resistance demands being the first to file.
The complaints assumed that DOGE would be some sort of advisory committee outside the aegis of the federal government. These committees may be subject to the Federal Advisory Committee Act (FACA). In 1993, a federal district court found that the President's Task Force on National Health Care Reform, chaired by Hillary Clinton violated FACA. However, the D.C. Circuit reversed that decision, finding that the task force was not subject to FACA. (This is a rare case where Judge Silberman reversed Judge Lamberth.)
But there's a problem for the Resistance. DOGE is not an advisory committee. It is not subject to FACA. The President's order explains that DOGE will be housed within the Executive Office of the President:
Sec. 3. DOGE Structure. (a) Reorganization and Renaming of the United States Digital Service. The United States Digital Service is hereby publicly renamed as the United States DOGE Service (USDS) and shall be established in the Executive Office of the President.
(b) Establishment of a Temporary Organization. There shall be a USDS Administrator established in the Executive Office of the President who shall report to the White House Chief of Staff. There is further established within USDS, in accordance with section 3161 of title 5, United States Code, a temporary organization known as "the U.S. DOGE Service Temporary Organization". The U.S. DOGE Service Temporary Organization shall be headed by the USDS Administrator and shall be dedicated to advancing the President's 18-month DOGE agenda. The U.S. DOGE Service Temporary Organization shall terminate on July 4, 2026. The termination of the U.S. DOGE Service Temporary Organization shall not be interpreted to imply the termination, attenuation, or amendment of any other authority or provision of this order.
(c) DOGE Teams. In consultation with USDS, each Agency Head shall establish within their respective Agencies a DOGE Team of at least four employees, which may include Special Government Employees, hired or assigned within thirty days of the date of this Order. Agency Heads shall select the DOGE Team members in consultation with the USDS Administrator. Each DOGE Team will typically include one DOGE Team Lead, one engineer, one human resources specialist, and one attorney. Agency Heads shall ensure that DOGE Team Leads coordinate their work with USDS and advise their respective Agency Heads on implementing the President's DOGE Agenda.
DOGE will be within the government, and be staffed by government employees. There may be "Special Government Employees," such as Elon Musk. But that is not a FACA issue.
How embarrassing for the Resistance. Will any of these groups explain to their donors how they sued a non-existent entity based on a completely irrelevant statute? I hope the Resistance takes it easy. It will be a long four years.

O, Fuck Off! How embarrassing for you that everyone assumed that Trump would do something illegal, and that the great surprise is that someone somehow managed to do something legal.

Every Josh post teaches something, and an intelligent Josh hater, if there is such a beast, would take advantage of his posts to leave scads of intelligent comments showing the errors of his ways.
Since you don't, the only logical conclusion is that you have no rebuttal and Josh must be right.

Not embarrassing at all. They can amend their complaints like everyone else does. It's also unclear if DOGE is composed entirely of "full-time, or permanent part-time, officer or employee" yet.
They shouldn't have to amend their lawsuit for foundational issues like this. It is (arguably) malpractice to have filed without knowing the legal basis for your suit in the first place.
Republican attorneys were sanctioned and disbarred for less. CREW and the other plaintiffs' attorneys should face that punishment ...

I'm referring mainly- but not exclusively- towards sanctions imposed on the nunc pro tunc efforts to challenge the 2020 election.

It's doing some work but not a lot. "The Resistance" was a pretty common self-identification before and during the first Trum administration. Most fo the pols calling themselves that are still around. It's also a recognized self-identification of the 42% of senior federal employees who admitted in a recent poll (which was discussed here on Reason but I can't find the link today) that they will ignore a legal order merely for think it "bad policy".

"The Napolitan Institute commissioned the poll, which looked at three different groups: Federal Government Managers, the Elite 1%, and Main Street Americans. Just 28% of Main Street Americans, who make up 70–75% of the population, intended to resist Trump's administration, compared to 59% who said they supported it.
Support for Trump outstripped opposition even among the Elite 1%, a group characterized by postgraduate degrees, high incomes, and urban domicile. 39% of elites said they planned to oppose the government, while 48% said they supported it. It's noteworthy that 12% of those who supported Kamala Harris in the November election stated they would back Trump's government. A quarter (26%) of Harris voters in the Elite 1% said they would be inclined to support Trump."

In today's episode, Josh thinks the Office of Management and Budget is a non-existent entity. Since it's the only defendant named in all four suits Josh highlighted, I assume that's what he's referring to. If he meant something else, he'd look pretty stupid to anyone checking the facts.

Today is the day it got first stabbed. It's not going to actually die without a long hard fight, because half the people put in charge of getting rid of it think it's morally obligatory at this point.

My teen aged son routinely reminds me that, if I'd put $1000 in dogecoin when he urged me to do so, I'd have been able to retire last year. Well, we're letting him invest part of his allowance, to see if he can replicate that performance.
