I hope SCOTUS' ruling will be extremely narrow. Of course, there really is no reason for a state to be prevented from regulating a social medium platform as a telegraph, telex, or email has been regulated. Massachusetts regulates an ISP in a number of ways, and an ISP is an ICS.
Transparency is important: for example, the voices of those advocating a novel interpretation of the Fourteenth Amendment, should be amplified no more than those advocating a novel interpretation of the provision that "each House shall be the Judge of the Elections, Returns and Qualifications of its own Members." Is it more proper to delay (or set aside) the will of the French Laundry Oligarchy's selection of Feinstein's replacement or to delay (or set aside) the preference of millions of voters? Is it proper for private actors to stifle discussion of the matter?
As Reuters notes "Any move by Schumer to fill Feinstein's seat on the [judiciary committee] with another Democrat would need Republican cooperation in a vote by the full Senate." Should such cooperation come before or after the verdict in the Colorado case? before or after the Senate sits as a court of impeachment?
