President Biden Will Transfer Power To VP Harris During His Colonoscopy
Doubts about the Presidential Succession Act remain in light of a 1995 article by Akhil Reed Amar and Vikram Amar.
Today, President Biden will undergo a colonoscopy. During this procedure, he will temporarily transfer power to Vice President Harris. At this point, doubts about the Presidential Succession Act remain. Just yesterday, Eugene referenced those views, most prominently expressed by Professors Akhil Reed Amar and Vikram Amar in the Stanford Law Review. In the event of a double vacancy, it is unlikely that Secretary of State Blinken would contest Speaker Nancy Pelosi's claim to the presidency. But during the prior administration, a potential clash between Pelosi and then-Secretary Mike Pompeo could have triggered a constitutional crisis.
In the Atlantic, Seth Barrett Tillman and I expressed our disagreement with the Amars. Part nine of our ten-part series in the South Texas Law Review will explain our position on the Succession Clause in depth.

Maybe she'll appoint Jill Biden border czar while he's under.
Would this make Harris the second woman to essentially hold the power of Acting President, after Edith Wilson?
The mere thought that she has the Football fills me with a sense of dread.
I thought the talking point was that Biden is senile? Harris being in charge is somehow worse than that?

Yes, which should tell you just how bad she is.
I imagine right-wing bigots -- the racists and misogynists in particular -- would have a difficult time with this. Vice Pres. Harris seems especially uppity.
CNN (and other media) say it’s the Biden White House that has a problem with Harris
Pelosi warming up the 25th Amendment.
This is the second time Pelosi has been a heartbeat away. The first time was when Dick Cheney was Acting President in 2007.
Nope. The 25A process to remove a president for incapacity has to be initiated by the VP and the cabinet.
Who wouldn’t listen to Pelosi or the Democratic leadership at all. Got it.
They might or might not on that issue. It isn't relevant either way.

Meanwhile, John Yoo has a new article out as well, arguing that making prisoners read ten-part articles written by Tillman and Blackman isn't torture, provided they are given the option of waterboarding instead.
I love it. Bravo!
But don't forget the requirement to exempt those advancing a religion-based claim!
Well, at least the White Christian males advancing a religion-based claim.
So that's where all the toilet paper went in 2020.
Its over, Biden woke up.
Only thing that happened is the thermostat was turned up in the White House.
SCOTUS has made clear that they have no jurisdiction on the inner workings of the legislative branch.
This seems consistent with that. The legislature and the executive have agreed, well in advance, on the line of succession. In a way that maximizes the voice of the people by favoring elected officials.
Why on earth would SCOTUS rule otherwise?
The Presidential Succession Act doesn't involve the inner workings of Congress, it involves control of the presidential powers by someone other than the President or Vice President. A President and Congress agreeing to a law doesn't rob the Supreme Court of jurisdiction regarding that law's Constitutionality.
The Supreme Court might uphold the Presidential Succession Act someday, but not for either of the reasons you provided.
First in ....
Joe Biden didn't kill himself.
The country would probably be better off if there were some way that he could transfer it to his colon.
The highlight of the short Harris administration was the Rittenhouse acquittal.
