What's this with celebrating birthdays of inconsequential Justices?
June 14, 1943: West Virginia State Board of Education v. Barnette. Discuss, please. And why June 14 was deliberately chosen as the day to announce the decision.
That does seem like a better choice for today, especially since we still have so many who are obsessed with seeing other people properly genuflect to our symbols of government.
During the 1988 campaign Michael Dukakis took a principled stand in support of this decision. George H.W. Bush ran a platform of overturning it, requiring the Pledge of Allegiance to be said, and also amending the Constitution to ban flag burning. That was practically his entire platform, and it's about where Republicans still are today. So I agree, this decision is still relevant.

If I was the federal district judge, I would have ordered Paxton personally into court, made him read Barnette out loud, and then ask whether he thinks he is high or petty.
The pledge was written by a Commie. He invented the Nazi Zieg Heil salute to accompany it. The Nazis copied this dipshit. The decision again deferred to a religion. The Nazi Salute was replaced by a more Roman hand over the heart by Congress. The Nazis sent people who refused to salute to concentration camps. Commies are the same everywhere. They requires oaths, have stupid signs, and punish any non-compliance with their tyrannies.
Hunt dissented. But the genocidal maniac jihad against blacks for 100 yeara was an all lawyer affair. They just made things up and ignored the plain English of the constitution. I support reparations from the assets of Democrat lawyers.

"Hunt's jurisprudential production (152 opinions, 7 dissents) may seem scant for a justice who served nearly a decade on the Court. But Hunt suffered a paralytic stroke in 1878, and during the next four and a half years he remained an associate justice but did not participate in any of the Court's proceedings. Hunt lacked an independent income and consented to retire only after Congress enacted a special bill granting him an early pension."
So he was capacitated enough to hold out for more money.
