Making a Murderer's Jerry Buting on New Evidence, Reddit Theories, and What the Documentary Left Out
Reason TV sits down with Steven Avery's defense attorney.
A celebration erupted in Manitowoc County, Wisconsin on September 11, 2003, as Steven Avery walked out of the prison where he had been locked up for 18 years. Wrongfully convicted of a heinous sexual assault, Avery was ultimately exonerated by DNA testing nearly two decades after his conviction.
Avery sued police and prosecutors for misconduct to the tune of $36 million and was likely to win an enormous judgement. And then 25-year-old photographer Teresa Halbach disappeared after visiting Avery's property.
Along with his nephew Brendan Dassey, Avery was ultimately convicted of mudering Halbach. This saga was the subject of last year's hit Netflix documentary series Making a Murderer, which presented evidence of police misconduct and crime scene tampering, thus casting doubt on the verdicts. The film became a national sensation, and it has been lighting up the internet ever since, including speculation about other possible suspects.
Avery's defense attorneys, Jerry Buting and Dean Strang, won over viewers with their principled and hard-fought defense. They are currently touring internationally, hoping to further the discussion started by the documentary.
Reason TV's Justin Monticello sat down with Jerry Buting to talk about the Avery and Dassey cases, updates since the documentary series aired, and what the cases reveal about the criminal justice system.

I haven't yet seen this documentary, and frankly have avoided it because I've come to a place in my life where I actively avoid depressing topics (aka 'nutpunches').
I feel I need to take a look at it.
And yet here you are, on a site that talks about the massive tardation of our political system on a daily basis where the groups with the answers are so far out of power as to not even be in the national consciousness.
I come for the comments.
To be fair, that is about 80% of why I come regularly as well. Nothing kills your soul faster than the average internet comment thread about an even slightly cerebral topic.
Definitely nice to have some smart and rational people in the Commentariat.

My take is that he probably killed her, but the cops/prosecutor wanted to stack the deck because they felt burned about the prior case.
And probably equals reasonable doubt in my mind.
As far as Avery goes, I think the cops believe he killed her (for some reason they did not present at trial) and wanted to stack the deck against him to ensure a conviction. Their reasons for doing so are not clear. What is clear is that the case they presented did not happen. Yet somehow they were able to get a conviction. The nephew...he just got railroaded.

Excellent interview. Buting's comments at the end are especially moving and thoughtful.
As much as I thought the Netflix doc was biased towards Avery - which could reasonably arouse suspicions about his guilt as much as the criminal case itself would - given everything I've read and seen so far on the case, I highly doubt the prosecution could make nearly as convincing a doc given the same time, money and motivation.
How did they know there was a rape apart from the 'confession' and the obvious desire for an inflammatory story, for example? Anyway, Reddit has this all covered and then some, but motivation for her murder remains an open question, unless the motive was to frame Avery before he won big money. I think she died for the job security of a few scumbags working in law enforcement.
