LAPD Had "No Idea" Who They Were Shooting At In Dorner Pursuit, Says Victims' Attorney

"It's 100 percent clear that they had no idea who was in that vehicle and just lit it up," says attorney Christopher Driscoll.

Driscoll is representing Maggie Carranza, 47, and her mother, 71-year-old Emma Hernandez, the two women who were shot on Thursday, Feb. 7 in Torrance, CA by LAPD officers. The officers were on the hunt for Christopher Dorner, and claim to have mistaken Carranza and Hernandez's truck for Dorner's.

"They had a description of the suspect, they had a description of the suspect's vehicle. The two women obviously do not match that description in any way," Driscoll says. 

ReasonTV's Tracy Oppenheimer sat down with Driscoll to discuss how this tragedy could have happened.

"When an officer is injured, or goes down, or is threatened, the team mentality really steps up," Driscoll says, "you have that concern that individual citizens' rights are going to get trampeled when the officers are attempting to get justice for their brothers.

I'm not so sure about the whistle blower part. He didn't come forward until after he got a bad evaluation and none of the complaintent stories match. There were also non-police witnesses who testified no brutality occured (although they were employees of the location where the incident occurred).

I'm not sure about that. Dorner has quite publicly made threats on the life of high-ranking police and police in general, has the firearms expertise to follow through on those threats with little warning, has stated that he does not care about dying, and has already killed three people including one cop.

If it were known to be Dorner approaching the home of one of his targets, I would consider that to be a good shoot. Problem is, it obviously wasn't, and the reasons for thinking it was were so flimsy as to make these cops a greater danger to public safety than Dorner is.

The standard in the military is positive ID (I can tell what I'm looking/shooting at) AND a threat (its trying to kill me or is in a category where being armed or even existing [like uniformed military] means it's always ok to kill it. Dorner obviously was not in the targeted vehicle. Since neither the vehicle nor its occupants even vaguely resembled the description of Dorner and his vehicle, we're looking at a remarkable level of incompetence.

It's far worse than that, though. Even if Dorner had been in the vehicle, police had absolutely no right to open fire, clearly attempting to execute the occupants. Obviously the unarmed occupants had not fired at police. It's remotely possible that they made some move that was misinterpreted by police, but even then the response--if it was a response--would have been grossly disproportionate.

These police officers probably will receive slaps on their hands and be put back on the street. They ought to be jailed.

There was a case here in maryland where two FBI agents stopped a car, ordered the occupants out, with one yelling "freeze" the other "hand up" and one of the occupants got shot (in the neck I believe - luckily, he lived).
No one fired, no one prosecuted. I think he got some small compensation from suing...

The police officers receive firearms training, but they probably almost never use guns. Most of them will spend their days writing tickets, pulling people over, and doing other mundane duties. The recent shooting incidents is fresh on everyone's mind. "Armed and dangerous" is might as well be "the return of Lanza." Perfect recipe for disaster.

Dorner was prefect cop because he was in more combat situations. It's a shame that he resorted to vigilantism.

First, a well trained unit such as in the military routinely are engaged in exactly the same situation as the LAPD officers face today. Yet, they are not out randomly shooting and ramming innocent people and vehicles.
