We're not at war with Iran. We're merely bombing the country. Iran's nuclear program has been effectively destroyed. We will keep bombing the country if it doesn't give up its nuclear program. We seek peace and diplomacy with Iran. We might have to overthrow Iran's government if it doesn't do exactly as we say or fights back in any way.

The above is only a slightly flippant summary of the rhetoric President Donald Trump and his subordinates are using to sell the war they launched against Iran over the weekend, which began Saturday evening (early Sunday, Iranian time) with a series of strikes on three of the country's nuclear sites.

A "very successful attack," declared Trump in a Truth social post on Saturday, adding that "NOW IS THE TIME FOR PEACE!"

As Reason's Matthew Petti dryly noted over the weekend, "There was peace eight days ago." That was before Israel, and now the U.S., started bombing Iran.

To hear Vice President J.D. Vance tell it, that peace was never shattered because we're not even at war. "We are not at war with Iran. We are at war with Iran's nuclear program," was the veep's go-to line in interviews with reporters on Sunday.

U.S. Defense Secretary Pete Hegseth echoed this sentiment at a press conference, saying the weekend's strikes "did not target Iranian troops or the Iranian people."

It might strike some as absurd to argue that America is not at war with the country it's bombing, particularly given that our ally Israel is very much striking Iranian troops and Iranian people.

Ridiculous as it sounds, it's not a new idea.

Recall that the Obama administration argued its 2011 aerial bombardment of Libya didn't amount to actual hostilities because U.S. troops weren't put at risk. Therefore, the administration didn't need congressional approval to continue its non-hostile bombing campaign.

Given that Congress wasn't consulted about Trump's weekend strikes on Iran either (more on that in a bit), the administration's "we're not at war" insistences allow it to pretend it's not completely ignoring the Constitution.

Limited forever war. Having started a war with Iran, the Trump administration is now trying to have its yellowcake and bomb it too.

It wants to tell a war-skeptical public that its war aims are limited and have basically already been achieved. It also wants to threaten Iran with limitless death and destruction if it doesn't effectively just roll over.

This is how Hegseth can say "Iran's nuclear ambitions have been obliterated," while U.S. Secretary of State Marco Rubio can say that "if Iran is committed to becoming a nuclear weapons power, I do think it puts the regime at risk. I think it would be the end of the regime if they tried to do that."

Trump himself raised the potential for regime change, saying in a Sunday Truth Social post that "if the current Iranian Regime is unable to MAKE IRAN GREAT AGAIN, why wouldn't there be Regime change???"

Indeed, while Iran's nuclear sites have been badly damaged, The New York Times is reporting that initial intelligence assessments show that they remain at least partially intact. Multiple outlets are also reporting that the Iranians appear to have removed equipment from the targeted nuclear facilities before they were bombed.

Vance seemed to concede to ABC's Jonathan Karl that Iran's stockpiles of enriched uranium that would be needed to build a bomb survived the attacks. Israeli Prime Minister Benjamin Netanyahu has said the same.

For all the victory dancing, there are still plenty of Iranian nuclear targets that might qualify for future strikes.

"The U.S. could find itself in a long-term game of whack-a-mole to stop a dispersed Iranian nuclear program," writes Petti.

Over at Unheard, Sohrab Ahmari, Arta Moeini, and Dan Caldwell write that avoiding a wider U.S.-Iranian war "depends on precision, discipline, escalation management, and a willingness to take diplomatic off-ramps that may appear unsatisfying at first."

These are "traits not often associated with wars that begin amid great fanfare and inflated expectations," they pessimistically note.

When asked by Karl what he'd say to people worried about a protracted war with Iran, Vance said, "How do you achieve long-term peace? How do you prevent the spiraling Middle East conflict? Is it through overwhelming military power targeted to an American objective, or is it by sort of walking yourself into these long-term protracted military conflicts?"

According to the vice president, this is a binary and Trump is choosing the former option. It's just as likely the president is choosing both options: "targeted" force that begets a protracted conflict.

Remembering the Constitution. Under the old U.S. Constitution, which is still technically in effect, Congress, not the president, has the power to declare war.

The 1973 War Powers Act attempted to affirm this principle by laying out three circumstances when the president could insert military forces into hostilities: (1) a declaration of war, (2) specific statutory authorization, or (3) a national emergency created by attack upon the United States, its territories or possessions, or its armed forces.

As Reason's Eric Boehm wrote over the weekend, none of these conditions cover Trump's Iran strikes:

The first two options provided by the law are clearly not involved here, as Congress did not declare war against Iran and did not pass an authorization for the use of military force (as was done to allow the invasion of Iraq in 2002).

The third circumstance also does not apply to Trump's attack on Iran, which was not carried out in response to an attack on American troops and did not respond to a crisis threatening American soil.

Nevertheless, Republican Congressional leaders have cheered on Trump's unconstitutional attack on Iran. Most rank-and-file Republicans have offered support as well, with a few notable exceptions like Rep. Thomas Massie (R–Ky.), who got roasted by Trump on Truth Social for his trouble.

Congressional Democrats have, to their credit, vocally condemned Trump's unilateral decision to attack Iran. Rep. Alexandria Ocasio-Cortez (D–N.Y.) has even said it's grounds for impeachment.

That's all well and good. The fact that opposition to Trump's Iran strike is (mostly) along partisan lines is one more indicator that Congress as a whole is uninterested in safeguarding its own institutional prerogatives over declaring war and peace.

      Iran has attacked Israel ceaselessly and ferociously. Its neo-fascist proxies in Hamas sent a 6,000-strong army into Israel in October 2023 where they raped and murdered hundreds. Its most important proxy – Hezbollah – followed up this pogrom with barrages of missiles into northern Israel. Between Hamas’s pogrom and June of last year, Hezbollah fired 5,000 rockets and other projectiles at Israel. This caused the evacuation of 60,000 people and the deaths of scores of civilians, including 12 Druze kids. Iran itself has directly fired missiles at Israel: 120 ballistic missiles in April 2024; 200 in October 2024.

              The US dragging itself into another regime change war, if that's what comes to pass, would also be playing stupid games and winning stupid prizes, if Iran wasn't previously trying to develop a nuke.

              And I don't know if Iran was trying to develop a nuke before the bombing started. I don't have access to the intelligence reports. I'm fairly skeptical of the claim, as it fits too perfectly with the warhawks and neocons (and Israeli) desire for a regime change war in Iran. Having enriched to 60% could mean they were trying to develop a nuke, but it could also be they viewed that as a deterrent to being bombed ("we're not trying to develop one, but if you push us we can and will develop one"), and something that could be used as a bargaining chip in negotiations, such as to reduce sanctions. The latter would only work if the US hadn't already determined to join the war and was negotiating in good faith, which it appears was not the case based on what Trump has posted on Truth and X.

      I might almost be pleased if this was just one single attack and the US ends all involvement here. But I don't trust that. Once you've accepted that it's okay because Israel lacks the capacity to take out this one target, you're going to find a ton more targets that Israel can't effectively strike.

      Simply blowing up a facility does nothing to prevent Iran building more facilities in the future. And if they decide to use civilians as shields by building a uranium enrichment facility in the middle of Tehran, what then?

        It's not just the facilities that are important. The nuclear scientists required to actually build nukes take time to train, and if you kill those guys, you cripple that capability just as much as bombing the buildings.

        NK's were pretty much developed by the Chinese, because they never had the academic infrastructure to build those themselves and China wanted an extra counter-weight in the Pacific.

        It looks like it's not just the nuclear weapon facilities that are being targeted; Israel is going after their paramilitary infrastructure as well so that it makes it harder to support Hamas and Hezbollah. The irony is that Iranian militias fighting in Baghdad were a critical piece in ensuring that ISIS didn't take over that part of Iraq during ISIS's early successes.

        Russia never agreed to sell/buy uranium to/from Iran outside sanctions. They stopped providing medical isotopes even those aren't formally part of sanctions. They are not a 'reliable supplier'. In particular since trade relies on dollars and it is the US which prohibits that (including on medical supplies) and Russia just doesn't defy the US over Iran.

        Further, Israel attacked Bushehr yesterday (though not the reactor itself) so while it is doubtful that Israel wants to kill a few hundred Russians at that reactor, they are also sending a message that the reactor IS going to be a target at some point. So to Israel (and therefore the US) it clearly doesn't matter that Russia controls all the fuel at that reactor. Further, before Russia helped finish Bushehr, Iran had France, Germany, and the US doing nuclear construction work - and Iran is also interested in having China do so. Are those all going to become 'Russia-supplied fuel bypassing US sanctions and Israeli bombing'?

        This is all bullshit. The NPT does not put peaceful uses of nuclear energy under the stranglehold of 'acknowledged nuclear powers' and certainly not at the stranglehold of 'nuclear powers who aren't even part of the NPT'. There are a dozen or so countries who enrich uranium without having weapons - Netherlands, Japan, Brazil, Argentina, Kazakhstan, Ukraine, Armenia, as well as private companies. One provision of the newly proposed 'deal' with Iran would have put enrichment under a consortium of NPT countries in the Middle East so that everyone can verify (and maybe over time trust). Only the US is so blindingly manipulated into thinking that Israel has veto power over NPT interpretation.

        at any rate - that is now all too late. Israel's and the US attack mean that Iran would be dumb as a box of rocks to contain their enrichment now. Or to 'agree' on anything with Trump.

                  55-60% of the Jewish population of Israel has ancestry that is either Mizrahim or Palestinian. Meaning that the majority of the population was either already there or migrated from nearby Islamic nations to avoid persecution. And since the response from those nations was to declare a religious genocide, the migration was probably justified.

    I'll note, as others have, that Obama's bombing of Libya was never decried by Public Citizen or other groups as "right out of the authoritarian playbook". Tee HIll: "Obama approved a massive military campaign that not only attacked Libya’s capital city but also armored columns of the Libyan military. The clear intent was regime change supported by then Secretary of State Hillary Clinton, who also rejected the need to consult with Congress, let alone secure approval before launching a massive attack on another nation.

    Neither did they say boo when Biden bombed Houthi targets in Yemen.

    We can count on a few politicians to make noise when the other team does the same things their teams has done in the past ("It's OK, Democrats did it first!"), but the repeated attempts to paint each every action Trump takes as some sort of norm-defying dictatorship move rings so hollow in the face of facts of others doing basically the same things ("That's (D)ifferent!")

    Despite the clear text of the Constitution, courts have repeatedly allowed this circumvention of Article I. Congress has only declared 11 wars while allowing more than 125 military operations, including Vietnam, Korea and Afghanistan. Congress has not declared war in the 80 years since World War II.

    In my case, the Obama administration would not even refer to an attack on another nation as a “war.” It insisted that it was a “time-limited, scope-limited military action,” or a “kinetic action.” The court allowed the war to proceed.

    Both Congress and the courts have effectively amended the Constitution to remove the requirement of war declarations.

    As a result, the precedent favors Trump in arguing for his right to commit troops unilaterally. Whereas Kaine and others insist that there has been no attack by Iran on the U.S., Trump can cite the fact that Iran has killed or wounded thousands of Americans directly or through surrogates, including attacks on U.S. shipping through its Houthi proxy forces in Yemen.

    More importantly, he can cite decades of judicial and congressional acquiescence.
