Brickbat: Move It Along

For almost 20 years, stone benches have graced the sidewalks of San Francisco's Bernal Heights neighborhood. They were first placed there by residents to make the place more attractive and to give them places to socialize. The sidewalks are very wide. One local TV station measured the distance from the curb to the benches and found it was nearly 14 feet. But after an anonymous complaint, city officials have told residents that no one ever got a permit to place the benches there. The people who own the homes near the benches will have to pay $1,400 for an encroachment permit or have them removed.

In the criminal justice system, bench based offenses are considered especially heinous. In San Francisco, the dedicated detectives who investigate these vicious felonies are members of an elite squad known as the Sidewalks Unit. These are their stories.

You don't own your neighborhood, the bureaucrats do.
And they occasionally need to remind you of that; just to maintain the proper order of things.
Sitting on benches on the sidewalk is white supremacist. If you want to socialize with your friends, hang out on your porch or squat in the corners.
Wow, between the awnings in Chinatown suddenly, after being up for decades, receiving a rash of anonymous complaints and the benches in Bernal Heights, after being up for decades, receiving an anonymous complaint in the same month, I hope there aren't any more totally random anonymous complaints waiting in the wings somewhere.
Good point; cynic that I am, it still didn't occur to me that the city employees are actually the ones making the "anonymous" complaints.
Saaaaay... you don't suppose local sockpuppets, snitches and narcs would've stooped to telling the Sheriff that Afroman had narcotics and slaves hidden under Mama's lemon pound cake... do you?
Don't beat yourself up. I blame the rolling back of defense against libel accusations, the dwindling availability of FOIA requests, and the increased ability for conspiratorial actors to act in unison without carrying membership cards or electing their own leadership.
Really, we're probably just lucky to hear about the code violations.
After that much time, isn't there a legal thing called "laches" or "adverse possession" that works in favor of the status quo? Like, the property owner (the city) had all that time to be aware of the situation, and so by not complaining ratified it?
There was a time when SF labor goons shrieked against letting Chinamen into California. The outcome is that Chinese law prevails. Then British dope dealers were invited to leave in 1836: "On examination we did not find any laws which allow barbarian merchants to live (during the whole year) in Canton. The usage has sprung up by indulgence in direct opposition to the laws." So now until a law entitles benches to a place at the sidewalk, no lawee, no benchee! Quing law prevails.
