How Texas Women Are Circumventing the State's New Abortion Law
Plus: free speech history, against regulating social media like phone companies, and more...

Mail-order pills and trips out of state are helping Texas women who want to terminate a pregnancy but can't under the state's new abortion restrictions. The controversial Texas law bans abortions after fetal cardiac activity can be detected, which means just a few weeks after conception and before many women may know they're pregnant. Researchers found that in the first month after the law was passed, abortions in Texas were down 49.8 percent from the same month the previous year.
But while the law (SB 8) halved the number of abortions obtained at abortion clinics in Texas, it did not so dramatically curb the number of abortions obtained by Texans. Two new studies suggest the drop in abortions obtained by Texas women has actually been much lower—closer to 10 percent, according to a New York Times analysis. That's because Texans seeking abortions still found other ways to obtain the procedure after six weeks.
Some visited abortion clinics in neighboring states. Almost 1,400 Texans a month traveled out of state for abortions, according to research from the Texas Policy Evaluation Project at the University of Texas at Austin. The researchers based this figure on patient counts from abortion facilities in Arkansas, Colorado, Kansas, Louisiana, Mississippi, New Mexico, and Oklahoma.
"These data undercount the total number of Texans receiving care out of state since we did not obtain data from 10 facilities in these states, and it does not include Texans who have traveled to other U.S. states for care since September 2021," the researchers point out.
Others obtained abortion-inducing drugs by mail. According to a study published in JAMA Network Open, "demand for self-managed abortion through Aid Access increased substantially in Texas" after SB8 took effect. "An initial high increase then leveled off to a more moderate but sustained increase over pre–SB 8 levels."
For this finding, researchers looked at data from Aid Access, a group that prescribes abortion via telemedicine. "Overall, Aid Access received 1831 requests from Texas for self-managed abortion in September 2021," the researchers report.
In the first week after the law took effect, requests from Texans spiked from an average of 10.8 per day to 137.7 requests. In the three weeks that followed, "requests decreased from their peak, but remained 245% higher than the pre–SB 8 baseline."
From October through December 2021, Aid Access received an average of 29.5 requests from Texans per day.
The results of these two studies suggest that some women will continue unwanted pregnancies when abortion is banned, but many others will find ways around the prohibition. And in an era of abortion-inducing drugs and telemedicine, this is likely easier than ever before to do.

A new paper from the Competitive Enterprise Institute (CEI) warns against regulating social media companies as common carriers, a disastrous plan that's nonetheless gained a following on the right. "Common carriers" include things like railroads, phone companies, and package delivery services, all of which are subject to strict regulations that prohibit discriminating against any types of customers or users. If social media were regulated like a common carrier, it would mean these companies couldn't discriminate against content they found objectionable.
"Making nearly all objectionable content mandatory for platforms to carry would likely drive users away from platforms altogether, fundamentally undermining their business model," said CEI Center for Technology and Innovation Director Jessica Melugin in a statement. "Such a mass exit would decrease the social communication that is the central reason for the consumption and use of social media. That unintended consequence is precisely the opposite of the supporters of regulation's stated goal—the preservation and flourishing of freedom of expression online."

I don't know about Putin losing, but I agree that Putin knows he can't win. The reports that he's recruiting pro-Assad Syrians with experience fighting in urban warfare also seems to suggest he knows he can't win. We should be clear that Putin's offer to enter into a ceasefire isn't the same as ending the war. Putin would rather leave Ukraine in a pile of rubble--even if he can't win. Wait until Putin starts calling for NATO to lift sanctions as a condition of a ceasefire before we start taking his offers too seriously. If Putin isn't even willing to acknowledge that sanctions are a problem yet, he's not yet serious about making concessions. And I doubt he will ever make any concessions.
The humanitarian crisis is just getting started. There were about 40 million Ukrainians before the invasion, and about 2 million women and children have fled for foreign countries. Plenty of the 38 million left behind are without water and heat, which is why they're so desperate to make a dash for it despite Russians shelling them as they flee. Putin wants the humanitarian disaster. It's the best way he can force the capitulation of the Ukrainian people and the Ukrainian government.
I'm a big fan of the observation that governments can't violate people's rights without suffering big costs, and those costs accumulate over time. One of the costs of lording over a corrupt government is that your generals tell you they're spending billions to modernize your military, but they spend the money on mega-yachts for themselves instead. You can't engender intense hatred by targeting civilians with shelling without making the occupation extremely expensive--maybe more costly than you can afford to finance.
That being said, once you cross the Rubicon on a certain level of ruthlessness, there's a good case for never letting up. Castro died of old age. Maduro starved his own people and chased millions out of the country. He's not about to fall from power anytime soon. North Korea has been ruthless for 65 years--periodically starving their own people to death with no real worries about losing power. Stalin died of a cerebral hemorrhage in his mid-70s. He wasn't overthrown by his people. There wasn't a coup. Why should Putin capitulate to anyone's demands?
We'd like to think that Putin is feeling the negative consequences of all the suffering he's causing, both to the Ukrainians and to the Russian people, but that's because we're not narcissistic psychopaths. When Putin says the disintegration of the USSR was a great tragedy, he seems to be criticizing the decision of the Russian leaders at the time to alleviate human suffering rather than double down on the empire. It's like he believes in a Russian version of the dolchstoss myth. Putin is unlikely to make the same "mistake" under economic and political pressure as Gorbachev.
Expect Putin to be killed in a palace coup before he willingly capitulates to Ukraine or the west or his own people. If his own people get in the way, he'll just mow them down like they did in Tienanmen. At some point, the Ukrainians should stop negotiating. They're giving the western press the false expectation that Putin will ever capitulate. It must be hard when you're trying to save millions of your people from being shelled, starved, dehydrated, and dying of exposure. But if your only leverage is human suffering, you've got no leverage with Putin.

I made an argument last night about how the Russian economy only generates $1.7 trillion a year in GDP, and every billion they spend on fighting in the Ukraine is another billion they can't spend on bribery and keeping their people happy. I argued that, ultimately, the Soviet Union fell because their economy couldn't generate the resources necessary to enforce their will internally and maintain control of their satellites.
Rather than the path Gorbachev chose, there was another way they could have gone, and I think that's the path Putin will take. Instead of deciding to do what was best for the Russian people and restructuring the economy and lifting controls on freedom, Gorbachev's communists could have doubled down on communism and repression and slaughtered their own people like Stalin did by the millions.
The Chinese learned lessons from the way Russia imploded, and the lesson they took away was that although the perestroika was necessary, they should absolutely forget about the glasnost. That would be the end of the CCP. I bought a t-shirt from a Chinese student activist at UCSD at the time with bloody tank tracks across it that read, "My Parents went to Tienanmen Square, and all I Got was This Rotten T-shirt". Said they were using the money to smuggle students from Beijing University out of the country.
The question isn't whether the Russian economy will be squeezed enough to force Putin to make some ugly choices. The question is what kind of choices Putin is likely to make when he gets to that point.
