Media Try To Cancel In-N-Out Burger Over Refusal To Enforce San Francisco's Vaccine Passports

The knives are coming out for popular California burger joint In-N-Out after the company announced it opposes vaccine passports and media outlets reported that In-N-Out donates to Republican political candidates, the two worst things an American company can do in 2021. The controversy over the famous regional fast-food joint began earlier this week when news broke that its only San Francisco location was temporarily shuttered for refusing to check customers' vaccine status as required by local health authorities.
The restaurant has since been allowed to partially reopen, but its indoor dining room remains closed. This minor kerfuffle might have escaped notice but for the company's strident statement about why it was not checking customers' papers when they try to order a burger.
"We refuse to become the vaccination police for any government. It is unreasonable, invasive, and unsafe to force our restaurant Associates to segregate Customers into those who may be served and those who may not, whether based on the documentation they carry, or any other reason," said the company. "We fiercely disagree with any government dictate that forces a private company to discriminate against customers who choose to patronize their business. This is clear governmental overreach and is intrusive, improper, and offensive."
California's lockdowns last year sparked episodes of organized non-compliance from small businesses that had been ordered to close. Mandated vaccine passports have thus far proven less controversial. Certainly, no other corporate chain has openly sparred with health officials over the policy.
In-N-Out's refusal to enforce the Bay Area's vaccine mandates has drawn fire from some Bay Area liberals who say the company's stance on vaccines is only its latest expression of political wrongthink.
On Thursday, the San Francisco Chronicle's online home page prominently featured not one, not two, but five stories about In-N-Out.

That included a lead story about the company's donation of $40,000 earlier this year to the California Republican Party during the recall campaign against Gov. Gavin Newsom.
There's nothing objectionable about reporting on publicly available campaign finance data, but that donation's sudden newsworthiness is more puzzling considering the recall campaign against Newsom failed and In-N-Out's donations to California Republicans have circulated in the media for years. It's seemingly part of a trend whereby business owners that do object to pandemic mandates are then subject to obsessive reporting on their politics.
Certainly, the Chronicle's campaign finance story is providing fodder for the newspaper's columnists, who see the donation to the state GOP as a reason to boycott the restaurant entirely.
Tony Bravo, the writer of the Chronicle's Datebook column, suggests In-N-Out's donations over the years to the Republican party, taken together with the Bible verses it prints on its burger wrappers, signals the company's opposition to not only vaccine passports but basic human rights as well.
"There are Bible verses on its packaging, something that has felt like a conservative dog whistle to many LGBTQ people," writes Bravo, adding that "In-N-Out may not be guilty of supporting anti-LGBTQ causes in the same overt way as Chick-Fil-A, but there is certainly guilt by association."
Deeming someone guilty by association is usually considered a bad thing, yet the Chronicle's restaurant critic Soleil Ho goes further, arguing in a separate column that In-N-Out's cult following should have ended long before its stance on vaccine mandates became known. "I can empathize with people wanting to ignore all of the abstract, even unethical stuff about a company when the product they create is really great," writes Ho, but neither In-N-Out's burgers or fries are really worth the moral stain that comes on the side. "It's time to deprogram yourself," Ho writes. "In-N-Out sucks. Get over it."
On the other side of the country, New York magazine has breathed a sigh of relief that the city doesn't have any In-N-Outs of its own to resist New York City's first-in-the-nation vaccine passport system.
In-N-Out's refusal to play vaccine cop might cause the company even more problems than bad press. By not complying with public health orders, it runs the risk of the government shuttering more of its dining rooms. An In-N-Out in Contra Costa county has already been fined for refusing to check customers' vaccine status. The hypercharged, hyperpolarized politics around vaccine mandates could also end up alienating more customers.
In-N-Out's critics, including the Chronicle's columnists, say that they don't want to eat in an environment where they feel unsafe. That's obviously their right. In a more perfect world, customers who aren't as concerned about the risks of eating in a restaurant without a vaccine requirement could continue to patronize In-N-Out (provided they like the food).
But the Bay Area's binding public health order precludes that live-and-let-live option. Luckily for In-N-Out and its many employees, past efforts to boycott the chain over its donations to the California Republican Party have flopped. Heck, Vice President Kamala Harris patronized the restaurant on a trip back to California to oppose the recall that In-N-Out supported.

Republican and Democratic administrations taking a hard line on China isn't doing much good for oppressed peoples trying to flee that country. In fiscal year 2021, which runs from October 2020 to September 2021, the U.S. accepted zero Uyghur refugees. The Dispatch has the news:
A recent State Department report on admissions details countries of origin for refugees who were resettled from the beginning of October 2020 through the end of September 2021. According to that document, not a single refugee of Chinese nationality—including Uyghurs and other ethnic minorities from Xinjiang—was resettled in America through the program in that time.
Asked why no Uyghur refugees were resettled, a White House spokesman referred The Dispatch to the State Department and said it is "something we take very seriously and something the president is committed to."
Refugees from China have consistently represented a slim portion of total admissions in recent years, but a downward trend has been especially noticeable since 2016. There were none admitted through the program in fiscal year 2020, one in 2019, six in 2018, 24 in 2017, and 57 in 2016.
COVID-19
Speaking of vaccines, federal public health authorities are approving more rounds of them. On Thursday, the U.S. Centers for Disease Control and Prevention (CDC) officially endorsed people's ability to get booster shots of the Johnson & Johnson and Moderna vaccine. It also endorsed people who'd gotten one of three approved vaccines to choose a different brand for their booster shot, reports the Washington Post.
"The evidence shows that all three COVID-19 vaccines authorized in the United States are safe—as demonstrated by the over 400 million vaccine doses already given," said CDC director Rochelle Walensky said in a statement Thursday night.

I was just pondering yesterday, all of the ways that the FDA and American medical establishment in general have squandered their credibility over the years. Those elderly folks out there can remember when eggs were the "Incredible, Edible Egg", then they were bad for you because of cholesterol, then there was "good cholesterol" and bad. Not to mention the 20-30 billion dollars spent on Crestor and related drugs, when early on the studies showed yeah, it lowered cholesterol, but had zero effect on long term illness or mortality.
Only 25% of Americans are salt sensitive, and a smaller percentage of those go on to develop high blood pressure because of it, but we are still under ever tightening government mandates to lower salt in every food item. And the FDA has approved tests to determine salt-sensitivity, but like the DNA markers, they won't allow the public access to the tests because of vaguely worded fears of self-harm, from knowing information about yourself.
The FDA (along with the class action lawyers) have clobbered simple vaccines for Lyme Disease, have drug out approvals for needed medicines for decades while afflicted people died, have thrown up obstacles and banned payment, literally killing people on organ transplant waiting lists with their inaction and mealy-mouthed ethical maunderings. At the same time, doing the drug warriors' bidding and leaving people in real pain, suicidal levels of pain, with their ridiculous regulatory hoops to make getting pain relief difficult for abusers without regard to people who actually need the drugs.
So when I see Fauci up there, running his mouth about stuff he is manifestly unqualified to speak on, I don't think that he is destroying the credibility of the government to speak on health issues. I'm thinking, what credibility is there at all, and why should I be listening to this clown? The claim that eggs are bad for you has always been unscientific quackery. People have been eating eggs for nutrition going back to the caveman days.
Our obesity epidemic is due far more to the wide availability of refined sugars and heavy consumption of junk food and soda, not things like eggs. This is why the mandates over the vaccine are so stupid--we lose 600,000-700,000 people every year from heart disease and diabetes. If the Branch Covidians were really all that concerned about human lives, they'd be demanding that everyone be required to do a one-hour workout every day.
It's really been telling how Covidian fat asses start making excuses for why this doesn't apply, because being obese is either due to addiction and is a mental health issue, or just suddenly happens to skinny people when they get old. I would make the observation that many on the left are so psychologically dependent on maintaining their imagined superiority that it actually changes their perceptions. Their intense anxiety of the politics of the owners causes nausea and they associate that with the chicken. In a documentary about WWII I watched this weekend that used restored footage to show the horrors of the war, including images of dead and mutilated bodies, there was a warning at the beginning that the documentary also showed (gasp) smoking.

Virginia Democrats are pressing Gov. Ralph Northam to waive the witness signature requirement for absentee ballots cast by mail for next month’s statewide elections.
According to local outlet InsideNova, the Fairfax County Board of Supervisors voted in a 9-1 decision to submit a letter to Northam, claiming that acquiring a witness signature puts individuals at risk of catching the Wuhan virus.
“No one should have their ballot rejected because they’re unwilling to risk their health and safety to vote,” said the letter’s original sponsor, Chair Jeffrey McKay. “We want to be a county that promotes voter participation and doesn’t punish people.”
“During the 2020 election cycle, Virginia made historic strides to expand voting access while protecting the health and safety of our residents as well as the integrity of our electoral process. This progress should be extended to the signature requirement,” he added in a separate statement.

Herrity also added that waiving the requirement now would be “problematic,” given that early voting in the state began in mid-September and many absentee ballots have already been mailed to Virginia voters.
“To do this in the middle of an election process in the name of COVID I think is nonsensical,” he said.

I hate these mandates as much as you and have been fighting against the justifications for them, but the Texas order does not make government imposed mandates illegal. It is a government imposed restriction that business owners cannot choose who works for them based on vaccination status. It takes us further from the dock when it comes to liberty. If Texas was somehow able to restrict the government from imposing these mandates then we would have a different discussion, but what we have here is further restriction on the rights of individuals to make choices that work for them. If I own a small HVAC company and decide that it will be an advantage to employ only vaccinated individuals and tout that in my marketing, then I should have the right to do so. This order restricts that ability.
I understand the covert fascism argument on this as well. On a lot of topics, we are arguing between being overtly or covertly regulated in our lives. The trouble that I see is if our end goal is more liberty, then adding more layers of government control only makes our job harder. The path out of tyranny is not through adding more layers of tyranny. The Texas EO is just another example of overt fascism because it controls the decisions that business can and cannot make.

I completely acknowledge that we have a massive issue with covert fascism. I have struggled with this situation a lot. For me, it still comes down to answering the question: Does giving any government more overt power increase or decrease their ability to covertly regulate our lives? The answer is pretty clear. If the government has more overt power, it can wield way more covert power. If Abbott had been able to directly target government power, I would have been completely on board. The problem is that his EO was fascism itself. If you do not do as the government tells you, you get to feel their wrath. At some point we need to draw a line in the sand. We can't get into the position of fighting fascism with fascism. The citizens will lose.
I also like to ask the question: If the most evil person on the planet was given this legal precedent would I be ok with that? According the EO, the penalty falls under “ Sec. 418.173. PENALTY FOR VIOLATION OF EMERGENCY MANAGEMENT”. This sets the fine to $1000 for compelling an employee to get vaccinated. Not massive, but it still restricts the ability of the business to make its own decisions without being penalized by the government. Even if something has changed, and it works as you explained, there is still a punishment for not doing what the government said to do.

You are ignoring the most important point I made. Violating OSHA regulations is considered an egregious violation by the Texas Workforce Commission that oversees unemployment insurance claims. Get fired due to an OSHA violation for not being vaccinated and you will not collect a penny of unemployment. Many employer policies also have caveats that employees fired for cause cannot claim benefits like outstanding vacation and sick days or even unpaid commissions or bonuses.
Biden's OSHA mandate will see employees fired with nothing except their last paycheck. That is the intention. It is pure fucking evil and Abbott had the the balls to stand up to them.

This is from TX EO 40.
The $1000 fine does change things. While this EO may be a finger in the eye of Biden, it is still fascism. The government is dictating that a private entity must comply with the demands of the government or receive its wrath. This sets a horrible precedent that can then be further taken advantage of to restrict our rights. Abbott is 100% restricting the rights of private businesses. This may have reinstated some rights to the employees and is in some way fighting the fascist EO from Biden, but it is still the textbook definition of fascism.
As I said in my original post, America is now getting into the awkward position of arguing between being overtly and covertly regulated by the government. That is the significant passage. Because of the rest of the wording, it will void the inevitable TX-OSHA mandate based on Biden's instructions to the federal OSHA regulators. One of the best surgeons in the hospital where I used to work was an obnoxious narcissist, but being supremely confident under extreme pressure was almost certainly part what made him a great surgeon. Like most Americans who supported Trump in 2020, I did so in spite of not liking him personally. Being a narcissist made Trump willing to go against everybody, like he did when he negotiated a peace deal with the Taliban or refused to invade and occupy Syria. Trump has also suffered for his narcissism. If he'd bowed out graciously, in 2020, his approval ratings would far higher than they are now.
I suspect Trump's TRUTH Social will suffer from the same problems. The idea of a social network targeting populist America is a great idea. That market is being way underserved. From where I'm standing, the problem appears to be that it's set up as a mouthpiece for Trump himself rather than a real social media platform meant to serve the needs of users. He might have been better off naming it after himself than "TRUTH Social". He'd do better with a legit social media alternative to Facebook and Twitter, but his ego is getting in the way again.
TRUTH Social is built on Mastodon, which isn't like Facebook. It's like Twitter. Instead of "tweets", the messages people read on TRUTH Social will be called "truths". And like with Twitter, the point isn't interaction between people, so much as it's about celebrities projecting their own message to millions. The Democrats won't be able to take it down as people create their own nodes, but this isn't about individuals coming together to create communities. It's about Trump sending "truths" to his followers. TRUTH Social isn't a business model. I suppose it's a meme stock, for the moment, but, really, it's just the Trump 2024 campaign.

Like Zuckerburg with the 2020 elections, the Bill and Melinda Gates Foundation spent hundreds of millions of dollars to write Common Core, write tests and curriculum matching it, successfully lobby federal and state officials to make it mandatory (including with former Gates Foundation staffers inside the Obama administration, in violation of Obama’s own ethics rules), and create a media and activism “echo chamber” that surrounded the entire process with Astroturfed, paid promoters praising the effort.

As much as I hate government running anything, the US really should look into how Canada runs it's elections. The one area that shouldn't be run by companies and volunteers.
- There enough voting places to ensure that there are no line-ups longer than five minute.
- Elections Canada has four years of planning between elections to make sure that they go smoothly. They hire temporary workers to staff the sites who are trained, made to swear an oath and are adequately compensated. No billionaire financial assistance necessary.
- Every citizen automatically gets mailed a voter card based on their address in their last income tax filing. If you didn't file or your address changed you can request one.
- Everyone has to show their voter card and proof of ID before they are handed a ballot.
- The ballots are paper and you mark them with a pen.
- observers from all parties observe the hand count. There may be as many as a dozen parties and independents running. Nobody has the authority to eject the observers.
Last year, my wife and I received several dozen different mailings from various nonprofits in PA (that neither of us ever heard of) encouraging us to register to vote and to vote by mail (with applications included), with many/most of these mailings containing false and derogatory comments about Trump.
I've suspected that Mark Zuckerburg funded most/all of those mailings.
And of course, the PA Department of State and Allegheny County
(both of which are controlled by partisan Democrats) also sent multiple mailings urging us to vote by mail, and sending us applications with self addressed and stamped return envelopes.
But the PA Dept of State never informed us where to vote in person (even though most poll locations were changed) and Allegheny County waited until the week before the June primary and the November general election to inform us (on a post card addressed to "resident") where we had to vote in person.
Nothing like suppressing votes for the GOP, while manufacturing more votes for left wing Democrats.
Perhaps good elections should be like good school exams: relatively frequent and always unannounced.
And kids are so much smarter now.

I think In n Out is great, am against vaccine passports but for vaccine mandates for govt , large corporations, and any other businesses employees that want to have them, and public universities and for mask mandates in schools at the present time.

I don't know when they were donating, but the Boy Scouts caved to the woke years ago. I myself failed to understand how an organization whose oath included chastity could worry about sexual orientation in the youth. As far as the leaders are concerned, don't ask, don't tell is the only option. You are not doing much to protect the chastity of the youth by promoting that sexual activity between boys is acceptable.

Contrary to this story, In-N-Out is not defying the "Bay Area's" rules. It's just Contra Costa County and SF County and their respective, grasping health officials. You're happy to visit a store in, say, Santa Clara County without having to flash your vaccine documentation. In fact, I think I'll drop by tomorrow for my usual amazing Double-Double because I'm sure all the principled people will be avoiding it in terror (medical and political). Or possibly they won't.

If only there were somewhere other than In-N-Out to eat in that entire county. Or if only the place had a drive-thru where they could get food without having to brave the perils of an indoor space where they could encounter a micro-organism of some sort. Going somewhere else spares them the indignity of eating food from packaging which has printed references to a scripture they might not believe in anyway (printed in places so unobtrusive, I'd been going there for 10 years before learning it existed).
If only they had the ability to prepare and eat meals inside their own homes (or maybe they feel unsafe there because of the presence of their kids who are too young to be given a vaccine with an unproven safety record to protect from a virus that's demonstrably not likely to be a threat anyway.
