Media Try To Cancel In-N-Out Burger Over Refusal To Enforce San Francisco's Vaccine Passports

The knives are coming out for popular California burger joint In-N-Out after the company announced it opposes vaccine passports and media outlets reported that In-N-Out donates to Republican political candidates, the two worst things an American company can do in 2021. The controversy over the famous regional fast-food joint began earlier this week when news broke that its only San Francisco location was temporarily shuttered for refusing to check customers' vaccine status as required by local health authorities.

The restaurant has since been allowed to partially reopen, but its indoor dining room remains closed. This minor kerfuffle might have escaped notice but for the company's strident statement about why it was not checking customers' papers when they try to order a burger.

"We refuse to become the vaccination police for any government. It is unreasonable, invasive, and unsafe to force our restaurant Associates to segregate Customers into those who may be served and those who may not, whether based on the documentation they carry, or any other reason," said the company. "We fiercely disagree with any government dictate that forces a private company to discriminate against customers who choose to patronize their business. This is clear governmental overreach and is intrusive, improper, and offensive."

California's lockdowns last year sparked episodes of organized non-compliance from small businesses that had been ordered to close. Mandated vaccine passports have thus far proven less controversial. Certainly, no other corporate chain has openly sparred with health officials over the policy.

In-N-Out's refusal to enforce the Bay Area's vaccine mandates has drawn fire from some Bay Area liberals who say the company's stance on vaccines is only its latest expression of political wrongthink.

On Thursday, the San Francisco Chronicle's online home page prominently featured not one, not two, but five stories about In-N-Out.

Landing page of the San Francisco Chronicle right now is really something. Not only is In-and-Out not totally onboard with the vaccine passports, they're also Republicans! pic.twitter.com/MD7s4UmrJY

— Christian Britschgi (@christianbrits) October 21, 2021

That included a lead story about the company's donation of $40,000 earlier this year to the California Republican Party during the recall campaign against Gov. Gavin Newsom.

There's nothing objectionable about reporting on publicly available campaign finance data, but that donation's sudden newsworthiness is more puzzling considering the recall campaign against Newsom failed and In-N-Out's donations to California Republicans have circulated in the media for years. It's seemingly part of a trend whereby business owners that do object to pandemic mandates are then subject to obsessive reporting on their politics.

Certainly, the Chronicle's campaign finance story is providing fodder for the newspaper's columnists, who see the donation to the state GOP as a reason to boycott the restaurant entirely.

Tony Bravo, the writer of the Chronicle's Datebook column, suggests In-N-Out's donations over the years to the Republican party, taken together with the Bible verses it prints on its burger wrappers, signals the company's opposition to not only vaccine passports but basic human rights as well.

"There are Bible verses on its packaging, something that has felt like a conservative dog whistle to many LGBTQ people," writes Bravo, adding that "In-N-Out may not be guilty of supporting anti-LGBTQ causes in the same overt way as Chick-Fil-A, but there is certainly guilt by association."

Deeming someone guilty by association is usually considered a bad thing, yet the Chronicle's restaurant critic Soleil Ho goes further, arguing in a separate column that In-N-Out's cult following should have ended long before its stance on vaccine mandates became known. "I can empathize with people wanting to ignore all of the abstract, even unethical stuff about a company when the product they create is really great," writes Ho, but neither In-N-Out's burgers or fries are really worth the moral stain that comes on the side. "It's time to deprogram yourself," Ho writes. "In-N-Out sucks. Get over it."

On the other side of the country, New York magazine has breathed a sigh of relief that the city doesn't have any In-N-Outs of its own to resist New York City's first-in-the-nation vaccine passport system.

In-N-Out's refusal to play vaccine cop might cause the company even more problems than bad press. By not complying with public health orders, it runs the risk of the government shuttering more of its dining rooms. An In-N-Out in Contra Costa county has already been fined for refusing to check customers' vaccine status. The hypercharged, hyperpolarized politics around vaccine mandates could also end up alienating more customers.

In-N-Out's critics, including the Chronicle's columnists, say that they don't want to eat in an environment where they feel unsafe. That's obviously their right. In a more perfect world, customers who aren't as concerned about the risks of eating in a restaurant without a vaccine requirement could continue to patronize In-N-Out (provided they like the food).

But the Bay Area's binding public health order precludes that live-and-let-live option. Luckily for In-N-Out and its many employees, past efforts to boycott the chain over its donations to the California Republican Party have flopped. Heck, Vice President Kamala Harris patronized the restaurant on a trip back to California to oppose the recall that In-N-Out supported.

Republican and Democratic administrations taking a hard line on China isn't doing much good for oppressed peoples trying to flee that country. In fiscal year 2021, which runs from October 2020 to September 2021, the U.S. accepted zero Uyghur refugees. The Dispatch has the news:

A recent State Department report on admissions details countries of origin for refugees who were resettled from the beginning of October 2020 through the end of September 2021. According to that document, not a single refugee of Chinese nationality—including Uyghurs and other ethnic minorities from Xinjiang—was resettled in America through the program in that time.

Asked why no Uyghur refugees were resettled, a White House spokesman referred The Dispatch to the State Department and said it is "something we take very seriously and something the president is committed to."

Refugees from China have consistently represented a slim portion of total admissions in recent years, but a downward trend has been especially noticeable since 2016. There were none admitted through the program in fiscal year 2020, one in 2019, six in 2018, 24 in 2017, and 57 in 2016.

COVID-19

Speaking of vaccines, federal public health authorities are approving more rounds of them. On Thursday, the U.S. Centers for Disease Control and Prevention (CDC) officially endorsed people's ability to get booster shots of the Johnson & Johnson and Moderna vaccine. It also endorsed people who'd gotten one of three approved vaccines to choose a different brand for their booster shot, reports the Washington Post.

"The evidence shows that all three COVID-19 vaccines authorized in the United States are safe—as demonstrated by the over 400 million vaccine doses already given," said CDC director Rochelle Walensky said in a statement Thursday night.

The real heroes are not the guys that risk their lives in burning buildings and freezing water to save lives. The real heroes are unionized public school teachers that push CRT in the classroom. And Jen Psaki.

      1. Derp-o-Matic 6000   4 years ago

Well, the unionized teachers are putting their lives at risk by interacting with unvaccinated children everyday. They're basically equivalent to the Marines.

Hey are SQRLSY or Mike, or any of the other "Libertarians" around to wail endlessly about the evil state of California punishing the free association of businesses with their customers? Or can we only complain about it when a Republican does it?

They all say authoritarianism is fine when done by the left through good intentions.

        1. Derp-o-Matic 6000   4 years ago

Somewhat OT, but people always refer to the Left's "good intentions." I've seen no evidence that such good intentions exist. They all come off as vindictive, miserable assholes to me.

          1. JesseAz   4 years ago

They use good intentions of idiots such as homeless savior propagandists, but their primary goal is to breed dependency on the state. They would rather give fish than teach how to fish. And they will always steal most of what they use to help.

Seattle spends over 50k a year on every homeless person. Most of this money goes to liberal allies who in turn donate to politicians that money. It is why Obama also allowed the doj to direct settlement money to leftist causes.

            It is all graft.

"It is why Obama also allowed the doj to direct settlement money to leftist causes."

Ideally, Obama and most of his administration, including Biden, should end up living out the rest of their lives in prison cells. Ideally in isolation at a SuperMax facility.

And if we fire too many emergency room nurses for not being vaccinated, we'll just have to find some way to ration access. Maybe check patient vaccination status? Panels of experts of some sort?

Politics aside, you have to wonder about the competency of any emergency room nurse who doesn’t want to be vaccinated.

Perhaps they considered the over 1 million adverse events associated with vaccines including 17,000 deaths, or perhaps they are considering pregnancy and following the vaccine manufacturer's advice to avoid taking the vaccine since there is no data regarding pregnant women and won't be until the safety studies are completed in late 2023.

Ceauşescu wasn't "strung up." He and his bitch wife Elena were given a speedy public trial, followed by an even speedier public execution by firing squad, more than they ever gave their millions of victims. NAZI Trump supporter with Hitler stache discharged from military for role in Jan 6 insurrection:

Naval investigators began looking into Hale-Cusanelli after receiving a tip from an information who said Hale-Cusanelli admitted to breaking into the Capitol as part of the mob attack. Hale-Cusanelli showed the informant videos on his cell phone that depicted Hale-Cusanelli "making harassing and derogatory statements toward Capitol Police officers both inside and outside the Capitol building," according to the NCIS affidavit.

Hale-Cusanelli also allegedly told other pro-Trump rioters to "advance" during the attack, giving both "voice and hand signals to other rioters in the raging crowd, federal authorities have said.

The attack by supporters of then-President Donald Trump disrupted Congress' certification of the presidential election.

Prosecutors alleged Hale-Cusanelli's extremist ideology was the "driving force" in his life. Authorities say he posted YouTube videos promoting far-right and anti-Semitic views and spoke to the informant about the need for a civil war in the United States to achieve a "clean bill of health" for society, quoting Thomas Jefferson that the "tree of liberty must be refreshed from time to time with the blood of patriots and tyrants."

Interviews with Hale-Cusanelli's co-workers at Earle revealed a history of racist and anti-Semitic remarks and behavior, including when he allegedly showed up to the base sporting a "Hitler mustache" in 2020, according to prosecutors.

A Navy petty officer told investigators with the NCIS that Hale-Cusanelli once said, "Hitler should have finished the job."

Republican and Democratic administrations taking a hard line on China isn't doing much good for oppressed peoples trying to flee that country.

I agree, we should accept them.

I have seen comments from right-wing commenters here recently saying we have to be super cautious about screening refugees from Afghanistan because they might be terrorists pretending to be refugees.

Also, in past conversations about accepting immigrants from Latin American countries, I have seen right-wing commenters many, many times claiming that they will bring socialism with them, because they obviously love their socialism, despite the fact that they are trying to flee their current socialist country.

I have seen comments from right-wing commenters here recently saying we have to be super cautious about screening refugees from Afghanistan because they might be terrorists pretending to be refugees.

Here is White Mike charging in to move the goalposts. Here is hint, douchebag, the Afghani are not commies. But they are Islamic fundamentalists.

Unlike those fleeing the commies in California, they tend to understand the value of individual liberty and don’t want the commie garbage repeated in their new home.

The problem is that their kids end up getting indoctrinated in the precepts of cultural Marxism anyway. Same with most any other immigrant group, regardless of where they came from.

I was just pondering yesterday, all of the ways that the FDA and American medical establishment in general have squandered their credibility over the years. Those elderly folks out there can remember when eggs were the "Incredible, Edible Egg", then they were bad for you because of cholesterol, then there was "good cholesterol" and bad. Not to mention the 20-30 billion dollars spent on Crestor and related drugs, when early on the studies showed yeah, it lowered cholesterol, but had zero effect on long term illness or mortality.

Only 25% of Americans are salt sensitive, and a smaller percentage of those go on to develop high blood pressure because of it, but we are still under ever tightening government mandates to lower salt in every food item. And the FDA has approved tests to determine salt-sensitivity, but like the DNA markers, they won't allow the public access to the tests because of vaguely worded fears of self-harm, from knowing information about yourself.

The FDA (along with the class action lawyers) have clobbered simple vaccines for Lyme Disease, have drug out approvals for needed medicines for decades while afflicted people died, have thrown up obstacles and banned payment, literally killing people on organ transplant waiting lists with their inaction and mealy-mouthed ethical maunderings. At the same time, doing the drug warriors' bidding and leaving people in real pain, suicidal levels of pain, with their ridiculous regulatory hoops to make getting pain relief difficult for abusers without regard to people who actually need the drugs.

So when I see Fauci up there, running his mouth about stuff he is manifestly unqualified to speak on, I don't think that he is destroying the credibility of the government to speak on health issues. I'm thinking, what credibility is there at all, and why should I be listening to this clown? Triple masking, 2 year olds masking after they been vaccinated, vaccines are better than natural immunity: the more nonsense that comes out, the more I know nothing they say at all can be trusted.

And let's not get started on the lung flutes ...

Those elderly folks out there can remember when eggs were the “Incredible, Edible Egg”, then they were bad for you because of cholesterol, then there was “good cholesterol” and bad.

The claim that eggs are bad for you has always been unscientific quackery. People have been eating eggs for nutrition going back to the caveman days.

Our obesity epidemic is due far more to the wide availability of refined sugars and heavy consumption of junk food and soda, not things like eggs. This is why the mandates over the vaccine are so stupid--we lose 600,000-700,000 people every year from heart disease and diabetes. If the Branch Covidians were really all that concerned about human lives, they'd be demanding that everyone be required to do a one-hour workout every day.

        1. Red Rocks White Privilege   4 years ago

It's really been telling how Covidian fat asses start making excuses for why this doesn't apply, because being obese is either due to addiction and is a mental health issue, or just suddenly happens to skinny people when they get old. Besides the obvious bullshit claims here, it's a lot easier to get jabbed with a flu therapeutic every three months than it is to exert yourself to an extent greater than what's needed to waddle from the recliner to the fridge and back.

        2. Chumby   4 years ago

Fatties have had a year and a half to flatten their curves. But it is just easier to demand healthy folks take unnecessary precautions.

But Dan Cathy, president of the popular fast food chain Chick-fil-A, has done just that, saying on a radio show that “we’re inviting God’s judgment on our nation when we shake our fist at him and say we know better than you as to what constitutes a marriage. "Their chicken sorta sucks and they’re kinda creepy the way they’re so nice."

You can always tell the partisans when they do this. If they were really principled, they would say, "I like Chick-Fil-A but the beliefs of their leaders are too much, so I call on everyone to sacrifice."

But they cannot do that- why? Because people like Strudel believe that a person having a wrong idea makes them untouchable and irredeemable. In his crypto-religious outlook, there aren't people making different decisions based on different inputs. There are good people, and there are bad people. And obviously if you are a bad person, it means that you can't even make good chicken.

It really is the laziest form of thinking. Strudel is so incapable of nuance that he cannot stomach making tradeoffs- so he has to delude himself that good chicken sandwiches aren't that good, and that nice people are actually "creepy"- as it is the only way he can believe that these people are really the ideological lepers he wants them to be.

I would make the observation that many on the left are so psychologically dependent on maintaining their imagined superiority that it actually changes their perceptions. Their intense anxiety of the politics of the owners causes nausea and they associate that with the chicken. Their dis-ease at being in the restaurant causes the friendliness of the staff to feel scripted and unreal.

It is projection, 100%. It is sad what social media has done to these people.

The aggravating thing is that Baldwin pointed the prop and pulled the trigger but will allow it to be characterized as a tragic accident. Meanwhile, he and his ilk are all for regular gun owners being charged with felonies and even murder if their property were to be used completely without their permission or knowledge.

How can we possibly believe we have freedom when an active participant in a death is not culpable and a victim of theft whose property is used in a death is culpable?

        1. perlhaqr   4 years ago

I'm sure Baldwin will insist on being treated according to the rules he advocates for others.

    8. mad.casual   4 years ago

If Baldwin deliberately cocked and fired the weapon that isn’t an accidental discharge.

This is just mind blowing. Just absolutely fucking mind-blowing. They don't even need a gun *or bullets* that actually shoot. I mean, in the 80s when you could pop into a hardware store and get something for $50, it kinda made sense to use a real firearm and that debris in the barrel could be lethal if you put the gun to your temple. But in 2021, when you can print a plastic replica, that would to nothing but explode with live ammo, that would cost fractions of a penny on the dollar?

      Just astoundingly stupid.

    9. Cronut   4 years ago

This was not an AD. It was a negligent discharge. Assume all weapons are loaded. Personally inspect any weapon anyone ever hands you. Never point a gun at anyone unless you intend to kill them.

I'm sorry this happened, and I'm sure Alec Baldwin is wracked with unbearable guilt, but he's responsible for failing to handle the weapon safely. He was negligent.

Virginia Dems Push To Ditch Witness Requirement For Absentee Ballots As Youngkin Gains Ground
    https://thefederalist.com/2021/10/20/virginia-dems-push-to-ditch-witness-requirement-for-absentee-ballots-as-youngkin-gains-ground/

Virginia Democrats are pressing Gov. Ralph Northam to waive the witness signature requirement for absentee ballots cast by mail for next month’s statewide elections.

According to local outlet InsideNova, the Fairfax County Board of Supervisors voted in a 9-1 decision to submit a letter to Northam, claiming that acquiring a witness signature puts individuals at risk of catching the Wuhan virus.

“No one should have their ballot rejected because they’re unwilling to risk their health and safety to vote,” said the letter’s original sponsor, Chair Jeffrey McKay. “We want to be a county that promotes voter participation and doesn’t punish people.”

“During the 2020 election cycle, Virginia made historic strides to expand voting access while protecting the health and safety of our residents as well as the integrity of our electoral process. This progress should be extended to the signature requirement,” he added in a separate statement.

The board’s lone Republican Pat Herrity voted against the measure, saying that revoking the requirement would be a “blow to election integrity.”

“Witness signatures are important as they provide another line of defense against voter fraud,” he said. “They’ve been deemed important enough by the General Assembly that they were reestablished outside the state of emergency.”

Herrity also added that waiving the requirement now would be “problematic,” given that early voting in the state began in mid-September and many absentee ballots have already been mailed to Virginia voters.

“To do this in the middle of an election process in the name of COVID I think is nonsensical,” he said.

One way to fix this, empty US grocery store shelves:

    https://thefederalist.com/2019/11/13/how-a-russians-grocery-store-trip-in-1989-exposed-the-lie-of-socialism/
Now compare that footage to the images of Yeltsin shopping at a U.S. supermarket. The contrast is undeniable. Yeltsin’s experience that day ran contrary to everything he knew. A longtime member of the Communist Party who had lived his entire life in a one-party system that punished dissent harshly, Yeltsin had been taught over and over that socialism wasn’t just more equitable, but more efficient.

His eyes were opened that day, and the revelation left the future Russian president feeling sick.

“When I saw those shelves crammed with hundreds, thousands of cans, cartons and goods of every possible sort, for the first time I felt quite frankly sick with despair for the Soviet people,” Yeltsin later wrote in his autobiography, “Against the Grain.” “That such a potentially super-rich country as ours has been brought to a state of such poverty! It is terrible to think of it.”

Yeltsin was not the only person fooled, of course. There is copious documentation of Western intellectuals beguiled by the Soviet system. These individuals, who unlike Yeltsin did not live in a state-controlled media environment, saw the Soviet system as both economically and morally superior to American capitalism despite the brutal methods employed in the workers’ paradise.

“I have seen the future, and it works,” the Progressive Era journalist Lincoln Steffens famously said.

The comparison aside, this really shows a critical weakness to the just-in-time supply system, and the short-sightedness of our economic relationship with China. Shutting things down for any length of time and then imposing restrictions on the links in the logistical chain ends up throwing huge amounts of sand in the gears of that machine.

It doesn't help matters that the Calitards have imposed "green" regulations on the trucking industry, and that it's the closest port area between Chinese suppliers and the rest of the US.

The only way to fix this is to start ramping back manufacturing operations in China so California can't fuck up things for the rest of us by bottlenecking the supply lines. Ideally, this would be followed by giving the SF-SD spine the Carthage treatment and rebuilding from scratch, but that's a solution for another day.

Harvard Trained The People Overseeing China’s Genocide Camps
    https://dailycaller.com/2021/10/19/harvard-fellowship-recipients-xinjiang-detention-camps-genocide/

Two officials who oversee detention camps accused of committing genocide against Uyghur Muslims in Xinjiang, China, previously received fellowships from Harvard University, according to research by an Australian think-tank, The Financial Times reported.

Between 2010 and 2011, Yao Ning studied as an Asia fellow at Harvard University’s Ash Center for Democratic Governance and Innovation while pursuing a doctorate degree, according to a report by the Australian Strategic Policy Institute (ASPI), the Times reported.

Yao completed his studies in 2014, and he was later “appointed (Chinese Communist Party) Secretary of Maralbeshi County, a small and predominantly Uyghur county where ASPI researchers have identified nine detention facilities built or expanded since 2017,” according to the ASPI report, the Times reported.

Posted here apparently in agreement that this is bad.... but attacks Texas for making mandates illegal. Choose a damn lane.

    1. Stonebraker   4 years ago

I hate these mandates as much as you and have been fighting against the justifications for them, but the Texas order does not make government imposed mandates illegal. It is a government imposed restriction that business owners cannot choose who works for them based on vaccination status. It takes us further from the dock when it comes to liberty. If Texas was somehow able to restrict the government from imposing these mandates then we would have a different discussion, but what we have here is further restriction on the rights of individuals to make choices that work for them. If I own a small HVAC company and decide that it will be an advantage to employ only vaccinated individuals and tout that in my marketing, then I should have the right to do so. This order restricts that ability.

I understand the covert fascism argument on this as well. On a lot of topics, we are arguing between being overtly or covertly regulated in our lives. The trouble that I see is if our end goal is more liberty, then adding more layers of government control only makes our job harder. The path out of tyranny is not through adding more layers of tyranny. The Texas EO is just another example of overt fascism because it controls the decisions that business can and cannot make.

The only winners in Abbott issuing that EO are the two main political parties. They can now use this as a fresh battle to beat on their political opponents. In the end, the American people lose.

      1. Mike Laursen   4 years ago

"that business owners cannot choose who works for them based on vaccination status"

Give me one example outside of vaccine manufacturer, where an employees vaccination status matters to the companies bottom line, and I'll believe you.

        1. Stonebraker   4 years ago

I am actually not even saying that vaccination status will matter to the bottom line of the employer. That is up to the market to decide.

Here is where I will go full on Milton Friedman. Every company should be allowed to fully exercise their bigotry or discriminatory behavior, and the market should also be fully allowed to either punish or reward those behaviors.

It may make no sense (and may be detrimental to the bottom line) for a business to mandate vaccines for their employees, but I want to give them that freedom and let the market decide. I don’t want this decided by some desk jockey in a government building.

          1. Chuck P. (The Artist formerly known as CTSP)   4 years ago

Except that Biden's order to OSHA removes their freedom which Abbott's order attempts to restore. You have to completely ignore the order in which the events occurred to think that Abbott is abridging anyone's freedom.

Plus, see below. Abbott's order doesn't do what you claim it does.

            1. Stonebraker   4 years ago

"Every company should be allowed to fully exercise their bigotry or discriminatory behavior, and the market should also be fully allowed to either punish or reward those behaviors."

That would be true if it was the companies bigotry or discriminatory behavior, but it isn't and you and I both know it.

I'm actually angered by your response. As I said above to White Mike, when the Federal government orders private companies to act in certain ways, without there being a law passed or so much as a single regulation promulgated, this isn’t “voluntary private corporate action”.

You too are a phony free marketer. Insisting corporations should be able to do things at the behest of the Democrats that you would lose your shit over if the government did directly instead.

You can come back to me with your argument when federal government compulsion isn't on the table.

            1. Stonebraker   4 years ago

I actually agree with basically everything you said here except the phony free marketer stuff.

I completely acknowledge that we have a massive issue with covert fascism. I have struggled with this situation a lot. For me, it still comes down to answering the question: Does giving any government more overt power increase or decrease their ability to covertly regulate our lives? The answer is pretty clear. If the government has more overt power, it can wield way more covert power. If Abbott had been able to directly target government power, I would have been completely on board. The problem is that his EO was fascism itself. If you do not do as the government tells you, you get to feel their wrath. At some point we need to draw a line in the sand. We can't get into the position of fighting fascism with fascism. The citizens will lose.

I also like to ask the question: If the most evil person on the planet was given this legal precedent would I be ok with that? While I am sympathetic to the intent of Abbott's EO, it sets a terrible precedent. At some point Texas will turn blue and that precedent will then be wielded by someone with much worse ideas.

      3. Chuck P. (The Artist formerly known as CTSP)   4 years ago

It is a government imposed restriction that business owners cannot choose who works for them based on vaccination status.

That is a lie. Texas employers can terminate any employee for any reason. What they can't do under Abbott's order is justify that termination as being 'for cause' and so abrogate their contractual responsibilities to provide benefits and unemployment insurance, nor avoid their obligations under the ADA.

        1. Stonebraker   4 years ago

According the EO, the penalty falls under “ Sec. 418.173. PENALTY FOR VIOLATION OF EMERGENCY MANAGEMENT”. This sets the fine to $1000 for compelling an employee to get vaccinated. Not massive, but it still restricts the ability of the business to make its own decisions without being penalized by the government. Even if something has changed, and it works as you explained, there is still a punishment for not doing what the government said to do.

This is in response to your post above: I agree that Biden EO is more evil than Abbott’s because it takes all choice away for anyone that falls under it. Abbott’s EO gives more choice back to the employee but still robs the employer of their rights. My main issue is that you do not fight tyranny with more tyranny. If we truly believe in liberty, we now have to fight to get rid of two government impositions.

A hypothetical situation, let’s say that Biden’s EO is rescinded, not fully executed or struck down in court but the Texas law is not. Are Texans more free in that situation? I would definitely say no since the business owners rights are still not being respected.

          1. Chuck P. (The Artist formerly known as CTSP)   4 years ago

This sets the fine to $1000 for compelling an employee to get vaccinated.

Does that negate anything I said? Texas is an at will state. They can ask nicely for vaccination records and then terminate any employees who don't produce them. It says nothing about compelling the records.

A hypothetical situation, let’s say that Biden’s EO is rescinded, not fully executed or struck down in court but the Texas law is not.

Irrelevant. Jeffy gets called out on this shit all the time. Your hypothetical is complete bullshit. Look at the actual events that transpired in the correct order.

You are ignoring the most important point I made. Violating OSHA regulations is considered an egregious violation by the Texas Workforce Commission that oversees unemployment insurance claims. Get fired due to an OSHA violation for not being vaccinated and you will not collect a penny of unemployment. Many employer policies also have caveats that employees fired for cause cannot claim benefits like outstanding vacation and sick days or even unpaid commissions or bonuses.

Biden's OSHA mandate will see employees fired with nothing except their last paycheck. That is the intention. It is pure fucking evil and Abbott had the the balls to stand up to them.

If you want to continue to assert that Abbott is restricting freedoms, you are welcome to autoerotically asphyxiate yourself until all brain functions cease.

            1. Stonebraker   4 years ago

Maybe I am missing the version of the EO you are describing, but the one that I have seen has the two main points:

"1. No entity in Texas can compel receipt of a COVID-19 vaccine by any individual, including an employee or a consumer, who objects to such vaccination for any reason of personal conscience, based on a religious belief, or for medical reasons, including prior recovery from COVID-19. I hereby suspend all relevant statutes to the extent necessary to enforce this prohibition.
              2. The maximum fine allowed under Section 4 1 8. 173 of the Texas Government Code and the State’ s emergency management plan shall apply to any “failure to comply with” this executive order. Confinement in jail is not an available penalty for violating this executive order."

This is from TX EO 40.

The $1000 fine does change things. While this EO may be a finger in the eye of Biden, it is still fascism. The government is dictating that a private entity must comply with the demands of the government or receive its wrath. This sets a horrible precedent that can then be further taken advantage of to restrict our rights. Abbott is 100% restricting the rights of private businesses. This may have reinstated some rights to the employees and is in some way fighting the fascist EO from Biden, but it is still the textbook definition of fascism.

As I said in my original post, America is now getting into the awkward position of arguing between being overtly and covertly regulated by the government. The thing you need to ask yourself is: does giving the government more overt power increase or decrease their ability to wield covert power? The answer to that is clear. The more overt power they have, the more they can covertly control businesses and people. Expanding the power of the TX gov may seem like it has some short term benefits, but the citizens lose in the long run.

I believe that my hypothetical is completely relevant. I am not at all ignoring the conditions that lead to this, but you have to assess all expansions of government power through multiple lenses to determine where things actually stand. The TX EO on its own is a horrible creeping of government power. It should be rejected even if the intent was valid. If this EO limited the power of the government somehow, I would have defended it.

              1. Chuck P. (The Artist formerly known as CTSP)   4 years ago

What the fuck are you going on about? There is nothing in what you just posted that restricts any employer from firing whoever they want whenever they want just like they could 2 weeks ago.

I hereby suspend all relevant statutes to the extent necessary to enforce this prohibition.

That is the significant passage. Because of the rest of the wording, it will void the inevitable TX-OSHA mandate based on Biden's instructions to the federal OSHA regulators. So, in Texas, you can't be fired for refusing to be unvaccinated as a willful violation of an OSHA regulation. BUT, and this is the big BUT you keep ignoring, you can still be fired for GASP! no reason at all.

If a Texas employer wants to fire you because you are unvaccinated, they can. Without incurring a fine. As long as they don't try to use your refusal as the excuse to avoid the unemployment claim and your rights under the ADA.

Why is that difficult to understand? Do I have to fire an unvaccinated employee for no other reason to prove it to you?

                1. Stonebraker   4 years ago

Actually going back through the thread, I realize that you are just wanting to have a semantics battle over the law. I was inadvertently trying to drag you into what I thought was a more interesting discussion - fighting fascism with fascism.

I will agree that I should have been more careful with my original wording. Texas employers CAN fire unvaccinated employees even for the sole reason of being unvaccinated, but the employer will be fined since they were requiring (compelling) their employees to get vaccinated. Sure you can side step the law, but that does not make it non-existent or non-fascist. Technically you CAN murder someone or not pay your taxes, but if you are found guilty, you will face consequences.

If Abbott's EO had stopped at directing TX-OHSA to not work with Fed OSHA on the mandate, I would have been very happy with that. I do have a massive problem with punishing businesses for requiring vaccines though. This is coming from someone who owns multiple businesses and has no intention of requiring the vaccine.

    https://answerstoall.com/technology/what-is-clenched-fist-syndrome/

    What is clenched fist syndrome?
Abstract. The clenched fist syndrome is an entity in which the patient keeps one or both hands tightly clenched. It is seen in all groups; hand dominance or compensation is not a factor. It usually follows a minor inciting incident and is associated with swelling, pain, and paradoxical stiffness.

Why do Alzheimer patients clench their hands?
Dementia makes it very difficult to process stimuli and new information, causing many people with Alzheimer’s disease to become anxious. This anxiety often manifests itself in the form of restlessness, pacing, hand-wringing, and rocking.

    ---Wall Street Journal

    https://www.wsj.com/articles/trump-social-media-spac-poised-for-second-day-of-huge-gains-11634906876?

One of the best surgeons in the hospital where I used to work was an obnoxious narcissist, but being supremely confident under extreme pressure was almost certainly part what made him a great surgeon. Other doctors, who couldn't stand to be in same room with him, otherwise, would send their family to him when they needed surgery. He was a great success both because of the way he was and in spite of himself.

Like most Americans who supported Trump in 2020, I did so in spite of not liking him personally. It was mostly because 1) I liked some of his policies a lot, and 2) because I hate the authoritarian socialism of the progressive alternative. Being a narcissist made Trump willing to go against everybody, like he did when he negotiated a peace deal with the Taliban or refused to invade and occupy Syria. Trump has also suffered for his narcissism. If he'd bowed out graciously, in 2020, his approval ratings would far higher than they are now.

I suspect Trump's TRUTH Social will suffer from the same problems. The idea of a social network targeting populist America is a great idea. That market is being way underserved. From where I'm standing, the problem appears to be that it's set up as a mouthpiece for Trump himself rather than a real social media platform meant to serve the needs of users. He might have been better off naming it after himself than "TRUTH Social". He'd do better with a legit social media alternative to Facebook and Twitter, but his ego is getting in the way again.

TRUTH Social is built on Mastodon, which isn't like Facebook. It's like Twitter. Instead of "tweets", the messages people read on TRUTH Social will be called "truths". And like with Twitter, the point isn't interaction between people, so much as it's about celebrities projecting their own message to millions. The Democrats won't be able to take it down as people create their own nodes, but this isn't about individuals coming together to create communities. It's about Trump sending "truths" to his followers. TRUTH Social isn't a business model. I suppose it's a meme stock, for the moment, but, really, it's just the Trump 2024 campaign.

It will have heavy use, but everyone will be using aliases.

    2. Briggs Cunningham   4 years ago

Never underestimate the power of brand. I have no idea how well this will work. If, however, people see using it as a way to show their political brand or give the finger to people of other brands, it will make a fortune regardless of how well it works.

      1. Ken Shultz   4 years ago

I don't think profitability is the intent. I think he's building a way to get around the Democratic party using the coercive threat of antitrust breakups to shut him down on social media--so that he can address the people who support him. Who associates the shit people say to each other on social media with the truth?

They wouldn't call the tweets on TRUTH Social "truths" if they were primarily concerned with getting people to talk to each other on their social media platform. They're calling them "truths", presumably, because the platform will primarily be about Trump speaking "truths" to his supporters, and they're using Mastodon, so the Democrats can't kick it off the internet like Parler.

    3. Mike Laursen   4 years ago

This seems "too good to be true" for anyone who is looking for a "gotcha" against Trump, but reports are coming out that TRUTH Social has ties to China. The CEO's office seems to be located in Wuhan, of all possible places:

      https://www.newsweek.com/donald-trump-truth-social-connected-china-1641496

"The company, founded in 2019, is incorporated in the Cayman Islands—an offshore tax haven—and has its headquarters in the Chinese city of Wuhan in the country's central Hubei province."

      1. JesseAz   4 years ago

        From his post:

U.S. Securities and Exchange Commission filings posted online revealed seemingly indirect connections to potential business</b< in China.

        Walls are closing in Mike.

        1. JesseAz   4 years ago

          Also from his news article:

It remains unclear whether Yunhong will play any part in the day-to-day operations or direction of Truth Social.

Did you even read this mike??

          1. Mother's Lament   4 years ago

Probably not. He saw "Wuhan" and figured he could associate it with Covid or something.

      2. Mother's Lament   4 years ago

        ???
Literally so what? I know that you think you have some sort of "gotcha" but I'm not getting what it is. Do you think people will catch Covid from it or something?

        1. Ken Shultz   4 years ago

Shrike often regurgitates shit he reads without understanding it, too. It's further evidence to support the hypothesis that while progressive trolls may be intellectually dishonest, that's complicated by their ignorance and inability to understand what they read. The chances that whatever Shrike quotes will contradict the conclusion he draws from it are probably over 85%. And that seems to be pretty typical of progressive trolls. They're only here to disrupt anyway, but they couldn't contribute anything substantial even if they wanted to do so.

I guess I’m “Shrike” in this rant, even though I’m not that clear who Shrike is/was.

I clearly presented the story as something that might be too good to be true, and not something I’m sure I believe.

            1. Sevo   4 years ago

Actually, you're "stupid" in this discussion.

            2. Mother's Lament   4 years ago

    4. Mike Laursen   4 years ago

Really? They are calling their posts "truths"? Another instance of the Right copying the habits of the Left; in this case, redefining the meaning of common words.

      1. Mother's Lament   4 years ago

Probably calling it that because truth frighten you guys, and makes you mad.

    5. CE   4 years ago

How do they judge if the truth is true before it is fact checked though?

      1. Ken Shultz   4 years ago

If Trump says it, then you know it's true? That seems to be the implication, which I would find off-putting.

There is something to the idea that news media has been doing an awful lot of lying about Trump for a very long time.

It might even be fair to say that when it comes to Trump, the news is a bunch of lying liars who lie about their lying.

    https://thefederalist.com/2021/10/20/leftist-shadow-governments-control-a-lot-more-than-our-elections/

In the 2020 election, Facebook zillionaire Mark Zuckerberg used this strategy to deploy nearly half a billion dollars to help Democrat activists infiltrate local government election apparatuses, literally paying for election equipment and the salaries of partisans who counted ballots. This kind of tax-exempt political interference is now standard practice for the world’s far-left ultra-rich, and it’s affecting a whole lot more than elections. It’s constructed essentially a shadow government that pits elected officials against their voters on behalf of moneyed interests.

...One of the pioneers of this strategy has been Bill Gates. He used it extensively to control how states and the federal government run public schools, effectively using one man’s trillions to outweigh the votes and voices of millions of American citizens. His crowning achievement was Common Core.

“For years, Bill Gates focused his education philanthropy on overhauling large schools and opening small ones. His new strategy is more ambitious: overhauling the nation’s education policies,” The New York Times reported in 2011 after the Common Core project was already locked in at the federal level. “…In some cases, Mr. Gates is creating entirely new advocacy groups. The foundation is also paying Harvard-trained data specialists to work inside school districts, not only to crunch numbers but also to change practices. It is bankrolling many of the Washington analysts who interpret education issues for journalists and giving grants to some media organizations.”

“We’ve learned that school-level investments aren’t enough to drive systemic changes,” Allan C. Golston, the president of the foundation’s United States program, told the Times. “The importance of advocacy has gotten clearer and clearer.”

Like Zuckerburg with the 2020 elections, the Bill and Melinda Gates Foundation spent hundreds of millions of dollars to write Common Core, write tests and curriculum matching it, successfully lobby federal and state officials to make it mandatory (including with former Gates Foundation staffers inside the Obama administration, in violation of Obama’s own ethics rules), and create a media and activism “echo chamber” that surrounded the entire process with Astroturfed, paid promoters praising the effort.

As much as I hate government running anything, the US really should look into how Canada runs it's elections. The one area that shouldn't be run by companies and volunteers.
      - There enough voting places to ensure that there are no line-ups longer than five minute.
      - Elections Canada has four years of planning between elections to make sure that they go smoothly. They hire temporary workers to staff the sites who are trained, made to swear an oath and are adequately compensated. No billionaire financial assistance necessary.
      - Every citizen automatically gets mailed a voter card based on their address in their last income tax filing. If you didn't file or your address changed you can request one.
      - Everyone has to show their voter card and proof of ID before they are handed a ballot.
      - The ballots are paper and you mark them with a pen.
      - observers from all parties observe the hand count. There may be as many as a dozen parties and independents running. Nobody has the authority to eject the observers.

    2. Bill Godshall   4 years ago

Last year, my wife and I received several dozen different mailings from various nonprofits in PA (that neither of us ever heard of) encouraging us to register to vote and to vote by mail (with applications included), with many/most of these mailings containing false and derogatory comments about Trump.

I've suspected that Mark Zuckerburg funded most/all of those mailings.

And of course, the PA Department of State and Allegheny County
(both of which are controlled by partisan Democrats) also sent multiple mailings urging us to vote by mail, and sending us applications with self addressed and stamped return envelopes.

But the PA Dept of State never informed us where to vote in person (even though most poll locations were changed) and Allegheny County waited until the week before the June primary and the November general election to inform us (on a post card addressed to "resident") where we had to vote in person.

Nothing like suppressing votes for the GOP, while manufacturing more votes for left wing Democrats.

'One person was killed and another injured on the set of a movie being directed by Alec Baldwin after the actor accidentally discharged a prop gun' There is no such thing as an 'accidental discharge,' Baldwin, unless the evidence shows otherwise, had the gun in his hand, and pulled the trigger. Negligent discharge, maybe. Involuntary homicide seems likely.

Chik-fil-A's sin was making donations to the Boy Scouts and the Salvation Army, two institutions that were uncontroversial and widely admired once upon a time.

    1. Mickey Rat   4 years ago

That was before LGBT activism became sacred writ, and anything that even mildly disapproved or disagreed with them became heresy that must be expunged from society. See the Dave Chappelle controversy.

    2. Chuck P. (The Artist formerly known as CTSP)   4 years ago

I don't know when they were donating, but the Boy Scouts caved to the woke years ago. I myself failed to understand how an organization whose oath included chastity could worry about sexual orientation in the youth. As far as the leaders are concerned, don't ask, don't tell is the only option. You are not doing much to protect the chastity of the youth by promoting that sexual activity between boys is acceptable.

Contrary to this story, In-N-Out is not defying the "Bay Area's" rules. It's just Contra Costa County and SF County and their respective, grasping health officials. You're happy to visit a store in, say, Santa Clara County without having to flash your vaccine documentation. In fact, I think I'll drop by tomorrow for my usual amazing Double-Double because I'm sure all the principled people will be avoiding it in terror (medical and political). Or possibly they won't.

  52. B G   4 years ago

People in Contra Costa "don't want to eat in an environment where they don't feel safe"?

If only there were somewhere other than In-N-Out to eat in that entire county. Or if only the place had a drive-thru where they could get food without having to brave the perils of an indoor space where they could encounter a micro-organism of some sort. Going somewhere else spares them the indignity of eating food from packaging which has printed references to a scripture they might not believe in anyway (printed in places so unobtrusive, I'd been going there for 10 years before learning it existed).

If only they had the ability to prepare and eat meals inside their own homes (or maybe they feel unsafe there because of the presence of their kids who are too young to be given a vaccine with an unproven safety record to protect from a virus that's demonstrably not likely to be a threat anyway.
