The court also found the fact the legislation was not enforced did not "render it redundant".

"Legislation remains important in reflecting public sentiment and beliefs," according to a summary of the judgement.

What sentiment does unenforced legislation reflect? Good for the state to have a law in its back pocket if they can't find anything else to get someone, or maybe as a bargaining chip against someone in a prosecutor's sights.
