Chicago Mayor Rahm Emanuel, Police Superintendent Still Think Jussie Smollett Is Guilty—and Are Furious He's Going Free
"Where is the accountability in the system?"

Immediately following the Illinois state attorney's move to drop all charges against Empire actor Jussie Smollett, Chicago Mayor Rahm Emanuel (D) held a press conference with Police Superintendent Eddie Johnson. Both men were blithely furious that Smollett would not be facing justice—and it was clear that they were just as angry with the prosecutors as they were with Smollett.
"Where is the accountability in the system?" asked Emanuel. "You cannot have, because of a person's position, one set of rules apply to them and another set apply to everyone else."
Emanuel explained that he stood by the Chicago police department's work in the case, and cited the 16 charges brought against Smollett by a grand jury as evidence that the case was worth pursuing. Both Emanuel and Johnson suggested that if Smollett was truly innocent, he should have been more eager to prove it in court.
This is all a bit much. Grand juries are notoriously willing to bring charges, thus the famous saying, "a grand jury could indict a ham sandwich." Moreover, Smollett should not be expected to want to go to court. It's the state's job to prove he's guilty, not his job to prove he's innocent. If prosecutors are going to just give up the case, only requiring Smollett to forfeit a small fee and do some community service, it would be insane of him to object.
Emanuel and Johnson are convinced that the police had compiled an impressive amount of evidence, and were apoplectic that the prosecution was not moving forward. Reading between the lines, it definitely looks like there's some bad blood between them and the prosecutors. State's Attorney Kim Foxx recused herself from the case after exchanging text messages with Smollett sympathizers, and Chicago's police union has demanded an investigation. Foxx's offices reportedly gave police zero forewarning that the case was about to be dropped (and possibly waited to make the announcement until top brass were otherwise disposed).
The state's attorney has tried to frame the abandonment of the case as a win for the city, taking solace in the fact that Smollett agreed to perform community service. It's also a matter of priorities.
"Here's the thing—we work to prioritize violent crime and the drivers of violent crime," said Assistant State's Attorney Joe Magats. "Public safety is our number one priority. I don't see Jussie Smollett as a threat to public safety."
Magats maintained that there was no issue with the evidence.
"We stand behind the investigation, we stand behind the decision to charge him and we stand behind the charges in the case," he said. "The mere fact that it was disposed of in an alternative manner does not mean that there were any problems or infirmities in the case or the evidence."
Without being able to see the evidence, it's tough to say which side is right. But none of this really changes what the public knows about the Smollett case. Whether or not the state's attorney wanted to bring the matter to trial, it remains fairly indisputable that the culprits were two Nigerian brothers who knew and worked with Smollett. If the actor was involved—something that still seems likely—the best remaining option for bringing him to trial is the FBI's investigation of the threatening letter he received in the mail.

We should certainly be careful not to torture language, particularly with any inappropriate goal in view. Indeed, everyone knows that "twisting words to stir up controversy" can be a crime, a fact that highly competent New York prosecutors made clear in our nation's leading criminal "satire" case. Fortunately, the charges in the New York case were not dropped, which is why Chicago law enforcement authorities are right to be upset at the awful legal president that has just been set. What is needed now is a concerted effort by law enforcement authorities everywhere in America to suppress, punish, and ban any kind of inappropriate "hoax" that can damage a reputation or distract the public from our great national journey towards unity and the celebration of real, strong values and leadership.
Incidentally, UCLA's Eugene Volokh, one of the great, principled, conservative voices in America, has put forward many excellent arguments for criminalizing libel?and clearly he is right to ignore the foolish arguments to the contrary put forward by so-called "human rights" groups around the world. Since libel should be criminalized, all the more reason why false accusations of the sort involved here should be punished with jail, to say nothing of fines, incarceration, forfeiture and prosecution in the press.

This guy actually did something illegal (file a false report), a crime that had the potential to cause an injustice (conviction of innocent parties) had the truth not been discovered. It almost certainly put investigations of other real crimes with real victims on the backburner.
Prison is not necessary but admitting his guilt, and making restitution for the resources expended investigating his lies would be justice.

Chicago is run by a Democratic party machine that does party machine things for party machine reasons. The prosecution may have decided not to prosecute because prominent parts of the machine urged him not to prosecute.
Prosecution probably just wasn't politically expedient. We might presume otherwise if we were talking about somewhere in Kansas, but the party machine in Chicago is so powerful, Rahm Emanuel can only take whatever the machine decides to give him.

If it is ever proved I doubt but this non-crime crime is not being prosecuted only because of politics. A call form Smollett to a friend to a member of Michelle Obama's team to the Illinois state DA and suddenly the there has been no crime committed. Hopefully the federal justice department will investigate and then if Smollett is at the bottom of the attack on himself he will receive justice not vengeance.
It's wasn't an attack if it was staged and the letter was fake too so there was never a threat made. It was all staged. I don't see how the feds can get involved unless he made false statements to the feds.
The feds are investigating a separate incident a few months earlier where Smollett mailed an 'anonymous' threatening letter to himself at the studio. The letter contained a powdery substance later found to be crushed aspirin.
Nevertheless, since 9/11, that kind of hoax threat is a big deal and he likely lied to the feds. It also didn't help that he did this through the US nail system, which potentially adds charges.
He's still in a lot of trouble.
If sent through the USPS or across state lines and intended to defraud, it would violate 18 USC 1341.
Yeah, but the evidence proving Smollett and the brothers sent the letter was was a magazine cut out collected by the Chicago PD. If the PD has kept the evidence or forwarded it to the FBI, then the feds can go ahead.

That kind of "logic" always gets me in these cases, and I know we should guard against that kind of thinking. Somebody may have accidentally given away a get out of jail card for free. I find that hard to believe. Common sense tells me that we should never assume malice when simple incompetence might explain the same thing, but Occam's razor is telling me that the simplest explanation is that somebody got something in exchange for this.

This is fairly common. I ran into it myself on a bogus traffic ticket.
I got nabbed for running a red light... that I definitively did not run. I was prepared to do battle. (I was young at the time).
The DA offered me a choice.
Come back another day for a court hearing (and potentially be on the hook for court costs, plus the fine, plus another day off from work)....

All traffic tickets got the same court time. 8:30 am.
And the DA took all the cases with attorneys first. So these attorneys walked up with stacks of tickets and said "we are gonna plead these to faulty equipment, these to 10 over the speed limit, these not guilty" and the DA signed off on whatever they asked for.
When you saw the size of the stacks, you could see why they arrived at such an arrangement. It would have taken days to clear just one of the attorney's client lists. Plus, they were probably getting $350 per case, times dozens of cases. Nice work for the price of showing up for a half hour.
Then came the cases they couldn't handle that way.... mostly DUI cases. Every DUI got some variation of a prayer for judgement or dismissal before going before a judge. Even the guy who was on his 5th arrest and hit an entire family in a minivan.
Finally, the plebes without attorneys. One girl who was all of 21 got bullied into pleading guilty to DUI and didn't ask for an attorney. She got 30 days in jail for a borderline first offense.

Aside from maybe a few cases involving potential police misconduct, I don't think I've seen this much chasm between the prosecution and the police. And I can't recall any recent criminal case in which the prosecutor dropped charges after receiving what's essentially a confession from the co conspirators. They have a list of items alleged to have been used in the attack!
I'm tempted to say "It's the Chicago way" or something like that, but even in a cesspool this kind of blatant incompetence can't go unnoticed. Best case scenario is that this is political favoritism / malfeasance and the worst is that there was bribery and collusion involved. The major and the police sup' were pissed for several reasons: 1) they heard about this after it was covered by media, 2) the State's Attorney claimed after the fact that the evidence was solid (so why not go to trial?), 3) Smollett did a speech right after the deal saying he was innocent all along and 4) the case was sealed so they and the general public have no idea why the case was dropped. BTW, the community service was 16 hours of chatting with folks at Jesse Jackson's Operation Push.

Smollett had been charged with 16 felony counts for allegedly lying to Chicago police about being victim of a hate crime, but all the charges were dropped earlier this week in a controversial decision made by the Cook County state's attorneys office.
In a letter signed by Mayor Rahm Emanuel's senior legal adviser Edward Siskel and addressed directly to Smollett, the city claims Smollett's "false statements" led to police "diverting resources from other investigations and undermining the criminal justice system."
CPD is convinced Smollett knowingly filed a false police report and orchestrated the hoax attack and requests payment to the city in seven days "of the $130,160.15 expended on overtime hours" on the case.
