Jussie Smollett Reminds Us That Some Hate Crimes Are Hoaxes—and the Statistics Are a Mess
As the investigation turns on the Empire star, it's important not to confuse "reality" with "narrative."

Multiple news outlets have now reported that Chicago police no longer consider Empire actor Jussie Smollett to be the victim of a potential hate crime. On the contrary, they suspect he faked the January 29 incident, with the help of two acquaintances who now appear to have flipped on him.
Chicago PD has not yet confirmed any of this, and Smollett maintains his innocence. But it's increasingly difficult to believe that Smollett was uninvolved, given that the two men captured on surveillance video near the scene of the alleged attack are by all accounts Abimbola and Olabinjo Osundairo, a pair of brothers who worked as extras on Empire.
Many people, of course, suspected that Smollett was lying from the start. His claim that he was attacked by random Trump supporters in downtown Chicago at 2:00 a.m. on one of the coldest nights imaginable was hard to swallow. Those who work in right-leaning and alternative media were most vocal, though I had private conversations with several left-of-center writers who shared my doubts.
In contrast, many left-leaning politicians, celebrities, and media figures rushed to condemn Trump supporters as complicit in an obvious hate crime. GQ's Joshua Rivera declared that "The Racist, Homophobic Attack on Jussie Smollett Is Far-Right America's Endgame." He also accused all those who referred to Smollett as the victim of a "potential" hate crime of inflicting an additional "wound" on Smollett. Cautious authority figures were engaged in "a careful hedging of bets that don't need to be hedged," he wrote. Suffice it to say, this piece has not aged well.
No doubt some conservatives went looking for holes in Smollett's story because they wanted to rebut a criticism of President Donald Trump (i.e., that his rhetoric emboldens racists and bigots). But many liberal pundits and thinkers simply believed Smollett because it confirmed all of their biases about the president's supporters. On Monday, in the wake of revelations about Smollett's likely deception, The Washington Post's Jonathan Capehart told MSNBC that what happened to the black, gay actor "fit in with a narrative." Before he even finished the word "narrative," he corrected himself: "not a narrative, but a reality for a lot of people in this country since President Trump was inaugurated." Many on the left believe that Trump has unleashed a wave of racist, xenophobic, bigoted hatred across America, irrespective of the details of a single incident.
But despite Trump's very real history of making disparaging remarks about all kinds of people, there is not a lot of statistical evidence to support the notion that hate crimes are surging. While it's true that the FBI's count of hate crimes rose 17 percent from 2016 to 2017, it's important to note that 1,000 additional agencies reported information to the FBI in the latter year. It should go without saying, but as the number of agencies participating in the FBI's count of hate crimes grows more numerous, the total number of hate crimes will undoubtedly rise. This does not necessarily mean that hate crimes are surging—just that the authorities undercounted them previously.
Statistics, of course, are easily mischaracterized. A few months ago, many in the media became obsessed with a figure from the Anti-Defamation League, which purportedly showed that anti-Semitism had spiked a whopping 57 percent under Trump. But part of that statistic reflected an increase in bomb threats against U.S.-based Jewish institutions perpetrated by just one person: a deranged Israeli teenager. Anti-Semitic violence, according to the ADL's count, actually decreased 47 percent.
Hate crimes do happen. But some alleged hate crimes turn out to be mistakes or hoaxes. Quillette's Andy Ngo has compiled a useful list; in writing about free speech on college campuses, I have frequently encountered alleged bias incidents that turned out to be false. (My forthcoming book, Panic Attack: Young Radicals in the Age of Trump, contains many more examples.) Recently, virtually everyone in the media uncritically accepted claims by a Native American man, Nathan Phillips, that a group of Catholic high school boys racially harassed him on the steps of the Lincoln Memorial, but additional reporting showed his claims were wildly misleading.
None of this means that racism and other forms of bigotry are nonexistent, or even that they're rare. But reality is often quite complicated, and it's important for reporters to add context, clarification, and caveats when discussing the news—no matter how much this displeases the automatically-believe-victims crowd.

I agree that many on the far left WANT to believe these stories to be true because they help promote the narrative they want everyone to believe.
But I think it's also a mistake for people on the right to be a little too gleeful about it when a story turns out to be false.
The goal is to ALWAYS uncover the truth in every case without using them as examples of proof that the other side is always wrong.
Bigotry exists. I don't believe "hate" as a motive should be its own category that affects sentencing, but that aside, I do concede the "hate crimes" happen, and we should keep in perspective what the goal is.
It's not to stick it to the other tribe at every opportunity. That really doesn't persuade anyone who might happen upon this story and read the comments.
I'm sure everyone here's heart is in the right place and we all want a better world. Some of these comments, while I'm sure feel very satisfying to write, will only make the otherwise potentially persuadable double down on their previous bias that frequenters of libertarian sites are nothing more than hateful right wing racists.
I don't want to believe that anyone here is any such thing; I'm just reacting to what it looks like, and it changes an important conversation about truth into one about how the different tribes' bias always comes before all else.

3) There are no accurate statistics on how many reported "hate crimes" are of the petty "hurt my feelz" kind or actually false, and are the numbers ever adjusted downward after qualitative analysis?

Read this whole Twitter thread of fake hate hoaxes. Incredible! It seems that this profoundly disgusting behavior is more common than any kind of real, verified instances of such far-fetched events.
Curiously, the invaluable website fakehatecrimes.org, which I cited to years ago, went down upon yesterday's news. The site has collected a shocking number of hoaxes just like this. If I recall correctly it was up to around 100 hoaxes per year, skyrocketing since ~2015.

What percentage of reported hate crimes are hoaxes? I've been trying to get a grasp on this, to see if anyone has tried to answer this question. There are some fairly comprehensive lists of proven hoaxes out there, but there's very little evidence tracking hate crimes in which the perpetrators are caught and it's definitively NOT a hoax.
If we could compare a dataset of 2 years where the definite hoaxes are compared against the solved non-hoaxes, we could at least get some sampling. Maybe it wouldn't extrapolate properly, but we'd have some range to estimate. I can't find anyone who has done that, however.

This would be nigh on impossible to breakdown, with 10 different studies giving at least 15 different results, and every side picking the one most sympathetic to their biases as definitive.
Take for example something related- false rape statistics.
I've seen numbers as high as nearly half to less than 5% of reported rapes as being fabricated, AND THEN you have evangelist attempting to explain away the wildly divergent numbers. Are you including rape allegations where there simply isn't sufficient evidence to prosecute? Or maybe only when making false statement charges were pursued and ended in a conviction? What about instances where the "victim" recanted years after the fact, or when DNA evidenced exonerated someone already convicted?
As with most crime, there is sufficient grey to go around.
And even then, statistical numbers don't really give an accounting of every lapse, every mistake in what should be an exceedingly low error rate- beyond a reasonable doubt.

Accusations like this are much more public and often include provable elements. Even without witnesses, for example, we've been able to largely disprove Jussie tale based on: hiding some of his phone records to police (including phone calls to the two suspects), large amounts of video, elements of the crime being record (in this case, the purchase of the rope). Just like there was the instant with Covington Catholic students where the evidence was simply watching the whole video.
I want to see someone who has tracked down the number of reports into the categories of "Actually happened and prove," "Actually happened but was a hoax," and "Reported but was entirely made up." I've been looking for anyone who has catalogued that but there's nobody even attempting to give an unbiased picture that I can find on the interwebz.

Well, there might be a little to learn from this story. It would be nice if people would look at every case independently and not ROOT for a story to be true or false in order to lend credence to their preferred narrative.
But it if it makes you feel better, very few people WILL learn that lesson. So yeah, nothing will be learned from this.

Hate crimes became the criminal justice fallacy as prosecutors were less and less required to prove intent as an element of non-homicide crimes.
Imagine if prosecutors had to prove that you intentionally and knowingly exceeded the speed limit in order for you to be found guilty of a speeding violation.
The real problem with "hate crimes" is that the designation becomes not an element of the crime itself but a factor in aggravation. In other words, the mens rea (requisite mental state) for the crime exists and has been established, and in addition to that we have "hate crime" which justifies an even harsher punishment. It in fact has nothing in common with our legal traditions because it relies on factors extraneous to the act itself. If I intend to murder someone and do in fact murder that person, it is premeditated murder. The old axiom "motive is irrelevant" applies. Now, thanks to "hate crime" statutes, motive is everything. The concept does not belong in our statutes.

If you can show evidence that his words actually cause people to commit crimes who otherwise wouldn't, that would mean something to me. This story should matter to us non-Trump supporters and we should be the first to seek the truth and nothing but. We should make sure never to let our bias come before truth or we risk losing credibility and risk that our legitimate concerns about Trump are dismissed if we stupidly choose to double down on narratives that prove false.

It took me less than 30 seconds on Google to find what anyone would consider "reputable" news outlets initially reporting on the attack and using the MAGA quote which is referenced at approx the 1:30 mark in the video. Liz Plank is either outright lying or does not know how to perform a simple search. There are dozens of national and and local affiliates as well as national press using that quote in their initial reporting. VOX themselves (in their initial reporting) linked directly to a TMZ story which also references the MAGA quote multiple times. True, Vox is careful to note that the TMZ story contains "unconfirmed details," but then why link to it at all? (Answer: shift liability away from them while still being able to basically report unverified claims). In Vox's more recent "let us explain why you are all racist homophobes and we are virtuous morally superior truth-tellers" piece also contains the quote. It's pretty embarrassing.
