Virginia Lieutenant Governor Justin Fairfax Denies Sexual Misconduct Charge

And threatens legal action against "those attempting to spread" the story

Virginia Lt. Governor Justin Fairfax (D) has denied that he sexually assaulted a woman at the 2004 Democratic National Convention.

In a statement issued very late last night, Fairfax also claimed that The Washington Post previously investigated this matter a year ago and found significant inconsistencies in his accuser's story. But the Post disputed his characterization of their findings. "The Post did not find 'significant red flags and inconsistencies within the allegations,' as the Fairfax statement incorrectly said," wrote Post columnist Theresa Vargas.

According to the Post, editors decided not to run with the story because they couldn't find anyone to corroborate it. The incident took place in Fairfax's hotel room: No one else witnessed whatever occurred, and the accuser did not confide in anyone. In her telling, the encounter began as consensual kissing, but Fairfax eventually forced her to give him oral sex against her will. In his telling, the encounter was consensual throughout, and the accuser later expressed a desire to have some kind of ongoing relationship.

"The same person called me sometime later and wanted to meet with me, wanted to come visit me… wanted to come to New York City to meet with me, wanted me to meet her mother," said Fairfax in a press conference on Monday, according to The Richmond Times-Dispatch. He also threatened "legal action" against "those attempting to spread" the rumors.

The accusation did not come to light until a friend of the accuser informed the conservative website Big League Politics about it. Big League Politics also broke the news last week that Virginia Gov. Ralph Northam (D) had apparently appeared in a racist costume for his medical school yearbook in the mid 1980s. Northam initially apologized but has since denied that he was in the photo. Many have called for him to resign; if he did so, Fairfax would become governor.

Big League Politics obtained a Facebook post, allegedly written by Fairfax's accuser, in which she expresses anger at the idea that the man who sexually assaulted her is about to "get a big promotion." The alleged accuser did not immediately respond to a request for comment, and it is not clear if she has consented to have her identity and her story made public at this time.

If she comes forward and provides more information about what happened, then the public will have to evaluate her credibility. In the meantime, there isn't nearly enough information to render any kind of judgment about whether the accusation is true. As I've written many times previously, it is neither appropriate to automatically believe or disbelieve accusations of sexual assault. We should accept that when trying to determine the truth of events that transpired years and years ago, we will often be frustrated by the sheer unknowability of it all.

    She clearly confided it in someone or no one would know about the allegation. And since when is the failure to report it at the time something that the Post considers disqualifying for a rape allegation. These people have a lot of nerve if nothing else.

              You're right. There's also no presumption of innocence before losing your job over unfounded allegations. Not legally. But, morally, ethically, and just for selfish reasons, one should extend said presumption, regardless.

      She might be. The fact that she continued to be associated with him is not preclusive of this having happened. Rape victims often do that for reasons I could not hazard a guess why.

      It is hard to say how credible she is. We don't even know who she is. I think the Post was right not to print this allegation. The problem is that they went into a feeding frenzy over a much less credible allegation against Kavanaugh. And they would have done the same thing had this guy been a Republican.

    A woman named Vanessa Tyson, who is a fellow at Stanford University, says that a man who allegedly sexually assaulted her at the 2004 Democratic National Convention is now an office-holder about to get a "very big promotion," according to a screenshot provided by a tipster.

    There's no real mystery about how Vanessa Tyson's story got 'leaked' to the press. Why do we wholly name Justin Fairfax but not Vanessa Tyson? Why is it such a mystery whom she 'confided in'? It's not like charges have been filed or there's an official police investigation or anything.

        Well, Adria Scharf, a community activist in Richmond claims to have Tyson's permission to have shared the Tweet publicly.

        Just to be clear, the law on the books currently is that if you think a child or elderly/disabled person is the victim of a sexual assault, you are legally compelled to notify the authorities.

        The waiting 13-yrs. and leaking not-so allegations through a friend-of-a-friend (who also happens to be a community activist) via Twitter bullshit has got to stop.

            An NPR morning story says Vanessa Tyson ? the woman accusing current Lt. Governor Justin Fairfax of sexually assaulting her in a Boston hotel room during the 2004 Democratic National Convention ? has hired the D.C. firm of Katz, Marshall, and Banks. It's the same firm from whom lawyers counseled Christine Blasio Ford on her allegations against now-U.S. Supreme Court Justice Brett Kavanaugh when he was a nominee. A source with the firm tells NPR they are advising Tyson on "the next steps".

            I'm split. There is the craven hypocrisy of the media, but if rape culture exists, these are the women are effectively abetting it. I'm not saying she should be brought up on charges, of course, but there needs to be a healthy dose of strong women (and men) out there calling bullshit and shaming the shit out of this behavior for lots of reasons.

          I feel the same way about this as I do most college rape cases I hear about.

          Is it possible this was consensual but wasn't completely thought through? Next day she had some buyer's remorse, he said he wasn't looking for a relationship with her, and then she starts spreading it around to her girlfriends (but not cops) that this guy took advantage/sexually assaulted her?

          I don't want much; just give me evidence that can be corroborated beyond the mere accusation.

On the other hand, what's wrong with taking a 30 year old diagnosed with a mental illness to a strip club after he keeps asking you to introduce him to an attractive woman?

    This is a bit of a tangent, but I just returned from Paterson where a Muslim man in traditional garb tried to give me a Koran and teach me about Islam. I engage him in a fun theological debate about sex and politics for about half an hour before he insisted that he had to leave to pray.

He also said that he has no objection to the Book of Mormon, because Mormons are Christians, and that autonomous revelation is a legitimate source of new morality, and that there was no prophecy after Mohammed.

        No, the last time I met a Muslim man face to face who wanted me to wear something special for him, it was the Jordanian religious police officer guarding the entrance to the Temple Mount. He wanted me to wear a dress for him, because that outfit would make him and his colleagues smile, but green is not my color, and I only cross-dress during my performances or if I'm doing it for a date I really like who's into that sort of thing.

        I wouldn't introduce anyone to a proselytizer. Even when my boyfriend started questioning his faith early in our relationship, I let him figure things out himself. Did you hear the rumor about gays recruiting people to their team because they can't conceive and raise new gay people?

        The way I see it, 21 is the upper bound for protecting someone from dangerous ideas. Otherwise, some parents will try to use the psych system to prevent visits to gay bars and strip clubs, trips to planned parenthood, love marriages, interracial relationships, and interfaith dating that they have no right to prevent.

    Fairfax is saying that Northam leaked this allegation to make it harder to force him out of office. This is getting very entertaining. Northam meanwhile assures everyone he wants to kill babies of all races and will smear anyone regardless of race of a serious crime if that is what is necessary to keep himself in office.

    I'm having a hard time believing that WaPo found no one who could corroborate the claim, especially since the guy admits that sexual encounter (consensual) did occur.

    This is why the left's fetish with consent law is so dangerous. Can Fairfax prove that he obtained affirmative consent? Did she ever verbally say "yes" to having sex?

    She could choose to play semantic and insist that she never agreed to have sex, even though she did just that, for all intents and purposes. And we DARE not ask why she or her friend took this long to bring up this allegation again.

    I don't know who to believe at this point, but if we play this by the other side's rule, Fairfax is cooked.

      That is what is so galling. This *is* their rules. If the guy's a Democrat, bury the story.

      This was contemporaneous with the Kavanaugh story. So while they were conspiring to leak the accusations about Cavanaugh and passionately covering the idea that a 30 year old allegation of a non criminal assault that not only could not be corroborated, but that any facts that were firmly alleged were refuted by others, they were deciding to bury a credible allegation with a willing Witness about a somewhat prominent Democrat.

      I thought the national conversation was important? I guess not. At least, not if it harms the Democrats.

      This has nothing to do with term limits and everything to do with tar and feathering people for past transgressions or mere accusations. It just happens that those who first started this, the Democrats, are now being castigated by their own rules. Additionally, Northam ran specifically on painting his opponent as a racist, with little evidence, so it is also poetic justice. I also believe this individual, Fairfax was quick to condemn Kavanaugh's, and is now being held to the same standard.

    We should accept that when trying to determine the truth of events that transpired years and years ago, we will often be frustrated by the sheer unknowability of it all.

      Did she graduate from Stanford or an Ivy? Advanced degree? Faculty position? Does she speak in a faux-little girl voice? How does her class and intersectionality score stack up against Fairfax's ?

    Like, the accuser couldn't say where it happened, and all the people she claimed were witnesses said it never happened? That kind of inconsistencies?

    I'm curious how the party of "Affirmative Consent" squares their stance on that with this. I mean, this isn't a case where the parties are disagreeing on basic events. They both admit to having sex. It is a disagreement about whether she consented to it whether at the time or later after processing her trauma. This is a perfect opportunity for progressives to have a serious discussions about consent, power, and privilege without the messiness of partistan politics corrupting the issue.

    Certainly the progressive media outlets are queueing up their think pieces on this.
