New York state Sen. Jesse Hamilton has proposed a bill that would make it a hate crime to call 911 about people people of color who are found to have committed no crime. It is already illegal in New York to make false 911 calls. Hamilton says he proposed the bill after a self-described supporter of Presdient Donald Trump called police to report him for speaking with constitutients.

Police arrest you and file a police report, but they don't file charges.

The prosecutor who gets the police report decided whether to press charges or not (sometimes using a grand jury).

What the police tell you as you're being arrested might be what eventually *leads* to charges, but it doesn't have to be.

Habeus Corpus is what says that the cops can't arrest and imprison you for unduly long before pressing charges, though "unduly long" had never been well-defined. In the US it's generally about 24 hours.

No and no. The legal definition of to "arrest" is to use legal authority to deprive a person of his/her freedom of movement. At the point that you are no longer free to walk or drive away, you have already been arrested. Handcuffs are not necessary. Depending on the context, even words may not be necessary.

There is an invented-standard of "detention" in which you are not quiet free to leave but also not yet arrested but the Supreme Court has said that "detention" must be "brief and cursory" (certainly no more than 20 minutes).

But either way, arrests and detentions happen long before you are charged.

Isn't it passed time that we have a law that states "No minority, POC, LBGTQ, non-religious, persons of approved religion, or member of public service, can ever be suspected of, charge with or detained for, the commission of any act deemed to be otherwise criminal."

Funny, I thought it was already against the law to call 911 for a non-emergency, which is essentially what we're talking about here. That's why I have the regular number for my local police department in my phone's contact list, and I've only called that once in the last ten years.
