A Baton Rouge police officer is under investigation after getting caught on body camera video saying she could search a vehicle without probable cause and say anything she found was in plain sight. When Robin Ducote said she wanted to search a truck, another officer asked if she had probable cause. "Yeah, they are both f****** passed out," Ducote responded. "So, if we find something, we say it's in plain view. Who gives a s***, we're writing this report."

In 2014, we interviewed Ducote after she graduated from the BRPD academy.

Why?

District Attorney Hillar Moore said he was awaiting the results of the police department's investigation. Moore said Ducote is a decorated officer with multiple awards for her service to the community.

It's not good that the DA, in commenting on the case, comments on the number of decorations, as though police don't decorate each other as a way to insulate from the rare scrutiny they might get for wrongdoing.

The DA's probably thinking about all the cases he will have relitigate based on the video. I guess it is the reason these videos are not released.

It's bad enough the commentariat doesn't read the articles, but you'd think the guy posting the article would at least read the damn thing.

Police confirmed in an email that the matter involving her was under investigation.

See, the matter is under investigation, the police officer is not. If the police officer were under investigation, they'd be looking for wrongdoing on her part. If the matter is under investigation, there's no reason to believe that the officer is in any way at fault here. Procedural guidelines were improperly ambiguous or incomplete would be my guess, nothing a little training won't fix.

And now we all know exactly why the police are so opposed to body cameras.

It isn't the one-off chance that they'll get caught using excessive force. That's a pretty rare event for most police, and can easily be handled by making sure the camera is off.

But the off-hand comment that reveals casual corruption? That's way too tough. They all make such comments all the time, and would rarely notice that something they said could be embarrassing or dangerous to their career if it came out.

These cops clearly didn't think violating the 4th amendment was unusual in any way. There's the story.

Cops don't give a shit about our rights. Not one bit. They know that they are shielded by qualified immunity which grants them the power to do whatever they want, lie about it, and then get away with it. They are trained to put boilerplate language in their reports to justify whatever they do. Language like "I feared for my life" or "it was in plain view." And nothing else happens.

There is nothing shocking about this. Ask any defense attorney, prosecutor, or judge. They all know that every police report is a work of fiction, but accept that it will be treated as the word of God.

What's shocking is that they let this get out to the public. If enough of this kind of stuff gets out, courts and juries might stop treating police reports and/or police testimony as divine writ.
