California Considers $1,000 Fine for Waiters Offering Unsolicited Plastic Straws
This sucks.

Ian Calderon wants restaurateurs to think long and hard before giving you a straw.
Calderon, the Democratic majority leader in California's lower house, has introduced a bill to stop sit-down restaurants from offering customers straws with their beverages unless they specifically request one. Under Calderon's law, a waiter who serves a drink with an unrequested straw in it would face up to 6 months in jail and a fine of up to $1,000.
"We need to create awareness around the issue of one-time use plastic straws and its detrimental effects on our landfills, waterways, and oceans," Calderon explained in a press release.
This isn't just Calderon's crusade. The California cities of San Luis Obispo and Davis both passed straws-on-request laws last year, and Manhattan Beach maintains a prohibition on all disposable plastics. And up in Seattle, food service businesses won't be allowed to offer plastic straws or utensils as of July.
The Los Angeles Times has gotten behind the movement, endorsing straws-on-request policies in an editorial that also warned that "repetitive sucking may cause or exacerbate wrinkles on the lips or around the mouth." Celebrity astronomer Neil DeGrasse Tyson (always up for a little chiding) and Entourage star Adrian Grenier have appeared in videos where an octopus slaps them in the face for using a plastic straw.
The actual number of straws being used is unclear. Calderon, along with news outlets writing about this issue—from CNN to the San Francisco Chronicle—unfailingly state that Americans use 500 million plastic straws a day, many of them ending up in waterways and oceans. The 500 million figure is often attributed to the National Park Service; it in turn got it from the recycling company Eco-Cycle.
Eco-Cycle is unable to provide any data to back up this number, telling Reason that it was relying on the research of one Milo Cress. Cress—whose Be Straw Free Campaign is hosted on Eco-Cycle's website—tells Reason that he arrived at the 500 million straws a day figure from phone surveys he conducted of straw manufacturers in 2011, when he was just 9 years old.
Cress, who is now 16, says that the National Restaurant Association has endorsed his estimates in private correspondence. This may well be true, but the only references to the 500 million figure on the association's website again point back to the work done by Cress.
More important than how many straws Americans use each day is how many wind up in waterways. We don't know that figure either. The closest we have is the number of straws collected by the California Coastal Commission during its annual Coastal Cleanup Day: a total of 835,425 straws and stirrers since 1988, or about 4.1 percent of debris collected.
Squishy moderates on the straw issue have pushed paper straws, which come compostable at only eight times the price. Eco-Cycle skews a bit more radical, with their "Be Straw Free" campaign—sponsored in part by reusable straw makers—that urges the adoption of glass or steel straws. Because we all know how good steel smelting is for the environment.
In any case, criminalizing unsolicited straws seems like a rather heavy-handed approach to the problem, especially since we don't actually know how big a problem it is. But don't take my word for that. Ask Milo Cress.
"If people are forced not to use straws, then they won't necessarily see that it's for the environment," he tells Reason. "They'll just think it's just another inconvenience imposed on them by government."
Update: Reason spoke with Voleck Taing, a senior assistant to Assemblyman Calderon, who said they intend to amend the bill to remove the fines.

From reading the article, they are not banning straws (yet); just requiring the customer to request a straw before they are given one. Kind of like the affirmative consent law. And it's only plastic straws. You are free to give paper (or any other material) straws to customers.
Seattle is banning plastic straws this summer. Between mandatory $15 minimum wage, sick leave, soda tax - Seattle is a great place to run a business!

Just as we have to ask for a glass of water at restaurants during droughts, our State (and others) are trying to restrict plastic waste by making it a request item. This is just a continuation of our plastic bag bans and plastic microbead bans, which end up in our oceans. In fact, 80% off cheap plastic items end up in our oceans and are a major problem to fish life.
And, if you are a restaurant that wishes to supply a straw for your customers, there is absolutely nothing stopping you from providing paper straws like we used when i was kid. Or if you're upscale, then supply the reed straws like we used as a kid in Spain.. People sweat the small stuff on this site, and ignore the purpose for the regulation.. In fact, the author really neglected to explain why plastic is a problem.

This is a fantastic example of this sort of rulemaking happening without regard to the actual importance or consequences of the thing being regulated. Average per capita water use in the US is between 80 and 100 gallons a day, mostly from showers and toilet flushes. And urban water use (meaning household water use, commercial water use, etc) is only 20% of the non-environmental water use in California--agriculture is the other 80%. So an undrunk 8 oz glass of water at a restaurant represents 1/1600 of a typical person's daily water use, with people's daily use representing less than 20% of the state's water use.
In other words, not giving everyone a glass of water at a restaurant makes everyone feel like they're solving the problem but has an immeasurably tiny effect on that actual problem (and might make it worse if it gives people the sensation of helping and thus leads them to spend an extra couple of seconds in the shower).
Prosecution, jail time, and a $1000 fine for giving a straw to a customer?

I am reminded of a vacation trip to the Santa Barbara area years ago. We went over to Ojai for a day, had brunch at a casual spot, and chatted it up with the friendly waitress - whoops - "server". She asked where we were from (Missouri originally, but living and working in Florida at the time), and she gushed about living in Ojai her whole life and not being able to imagine living any place else.
That's when I realized that the only likely reason she could afford to live in that town is because she was born there - certainly not from waiting tables at a casual dining restaurant. I know there are good paying jobs in many parts of California, but not all of them pay enough for newcomers, that is if the newcomers have any ideas about buying a house. I looked at real estate listings in Ojai and crappy looking little houses cost several hundred thousand dollars.
As I'm sure you know, Santa Barbara real estate prices are even more insane.
Notwithstanding my post above, my wife and I were married in Santa Barbara on July 4, 2000. It was just the missus and me and the lady minister.
My first wife was a waitress, as were both of my daughters... Tips aren't great at smaller diners, but I watched a girl count out her tips at out local diner 'Humpty's Cafe' (ignore the name, the food and staff are great.) .. She had to have picked up $200 on her 6 hour shift... Do that 5 days a week and couple it with your regular salary, and life isn't too bad.. My daughters and ex can attest to that.
My wife was a waitress when we started dating and continued to be one for the first few years of our marriage. You're right, the money can be okay. My point is that a husband and wife grossing a combined $100,000 - $125,000 will find it difficult to buy a $750,000 starter home in Santa Barbara (or Ojai, or other similar places in California).
Yeah.. six years ago I was visiting froends/former residents, we saw a house almost exactly like the two bit dingbat balloon constuction slab on grade stucco outside aluminium single pane windows tract house I lived in when I was a kid in Orange County..... and for which we paid about $12,000 brand new. I asked if Friend knew the asking of the one for sale. He said he did not, but he DID know the one over the back fence, a "flipped" floorplan identical to the one in question, actually SOLD for $650,000 two months ago. I about fell over.....
In 2006ish, a friend of mine had a 1300 square foot house on a .15 acre lot in El Cajon - and it cost something like 350 grand.
Out where I live, 250 grand gets you 2600 sqft and 5 acres.
I grew up in Goleta (right next to Santa Barbara), which saw a huge explosion in property values starting I think in the late 80's early 90's (around when my family moved there). I saw an estimate at one point that 75% of Goleta's residents wouldn't be able to afford to buy their homes on the basis of their salaries. Some of it is the obvious desirability of the area, some of it is the very restrictive rules on development in the area (which protects undeveloped areas but also restricts high-density housing) and some of it is prop 13 making it very expensive from a property tax perspective to move, which limits the size of the market.
The last I heard, the typical cheap rent was about $900/room (not for a 1-bedroom apartment, for a room in a 3 or 4 bedroom apartment) which is about 50% higher than I was paying in New York City for a pretty nice place.
Compare the cost of living. My brother-in-law still lives in Commiefornia and makes nearly what I do. I've got a 1400 sq ft. house on 1/3 acre (small for here), cars, and money left over. He shares a tiny apartment has an old pos car that's falling apart and is constantly broke.
That 50% pay cut goes 3 times as far in other states where sanity exists.

And that's why lots and lots of businesses are leaving for lower cost states. A science and engineering company I worked for essentially closed down a lot of their CA operations and fired a good chunk of their CA engineers, and hired in other states.
I have a friend who was offer around $150K to work at the alphabet in CA. In chose the offer in Texas for $110K instead.
His reasons - he could spend 4k for a tiny house/shack for his wife and 2 kids or move to Texas (Houston area) and get a 3000 sq ft home for half that. Plus, no state tax and reasonable property taxes.
But the cost of living is so high, as well. A 50% pay cut may not reduce your standard of living if you move to a state where people are not taxed for breathing and the cost of living is reasonable.
Given time, your 50% pay cut will be from state and local taxes, as well as penalties for ordinary human acttivity.

It would be a lot simpler to just make straws illegal. I mean, it's stupid in either scenario but no restaurant is going to carry straws, period, if the punishment was this harsh for a simple accident.
We're obviously not going to break Cali from its nanny state culture. But wouldn't it make more sense to simply require the businesses to switch to paper straws? As one of the "little people" I would assume Mr. Calderon is aware that they exist and are 100% biodegradable.
