I couldn't care less if the nominee has experience. I care about his intellectual capabilities. the law is not that hard, and Popehat's article amounts to launching a string of technical terms in an attempt to make this stuff look complicated. it isn't, and comparing it to surgery is egregious.

Actually, I don't agree. It's not complicated in the sense that it takes intellectual heft to understand blackletter law, but it is complicated in that the legal process is so corrupt and laws/regs/opinions/etc. are so poorly drafted and enforced.

I think the point was that law is not that complicated and the nominee might very well be qualified to be an Appellate Judge, but running a trial is more complicated.

This feels hinky. Especially because they are sending out letters without actual proof of monetary ties. They mentioned at least two cases of celebrities immediately responding that they hadn't received any goods or services for mentioning a product (which I can believe, because look at my family holiday album. You'd think we all were endorsed by Dr. Pepper).

Plus they are getting finicky on how the celebrities acknowledge their freebies. Apparently just saying thank you to the company for the free stuff isn't clear enough for the regulators. They want you to actively tag your posts with "Ads". Which doesn't really seem accurate considering a lot of these things aren't even contracted.

It's also somewhat astoundingly short-sighted and/or a blatant stopgap. At some point, someone's going to need the #Ads hashtag more than the FTC and, eventually or not, Instagram et al. can scrap the whole tagging scheme for this use. At which point the FTC is going to have to give up or go full compelled-speech a la surgeon general's warning.
