Scott may not have meant to, but that statement seems to imply the ruling went farther than it actually did. I first read this statement as thinking some grand principle against forfeiture was ruled. No, it merely overturns the principle of joint liability. If a guy running a drug business makes a bunch of money, and pays a minion a salary, the minion can't be held jointly liable for the full amount of money the owner made illegally. Only the amount that the minion was paid, from the illegal actions.
But this doesn't have any bearing on civil forfeiture in general.
Well, that whole "what they can prove" begs the question of whether they can prove it beyond a reasonable doubt or whether they merely need the preponderance of the evidence. The problem was never that the cops couldn't prove the assets were ill-gotten gains, it's that the proof frequently consisted of "because I said so".
