Scott may not have meant to, but that statement seems to imply the ruling went farther than it actually did. I first read this statement as thinking some grand principle against forfeiture was ruled. No, it merely overturns the principle of joint liability. If a guy running a drug business makes a bunch of money, and pays a minion a salary, the minion can’t be held jointly liable for the full amount of money the owner made illegally. Only the amount that the minion was paid, from the illegal actions.

But this doesn’t have any bearing on civil forfeiture in general.
