Five Reasons Jeff Sessions Would Be No Friend of Liberty In the Trump Administration
The Alabama senator has been touted as a possible Attorney General, Secretary of State, Secretary of Defense, or Secretary of Homeland Security.


Sen. Jeff Sessions (R-Ala.) was an early and vocal supporter of Donald Trump's presidential bid. Now that his man is headed for the White House, the 69-year-old senator seems likely to be rewarded with a plum cabinet position.
Sessions' name has been floated for a number of cabinet positions, including Attorney General, Secretary of State, Secretary of Defense, and Secretary of Homeland Security.
Here are five reasons Sessions would be no friend to libertarians if he does indeed leave the Senate and join the Trump administration:
1. He was not only for "the Wall" before Trump thought it was cool, he's against legal immigration, too.
More than a decade ago, Sessions was pushing for a fortified barrier on our Southern border, and has never let go of the dream. He has also opposed every congressional attempt at immigration reform since then, of which Reason's Shikha Dalmia wrote, "Sessions has done more than any human alive to torpedo every sensible immigration reform effort and makes no bones about his wish to basically stop all immigration. He moves the goalposts on reform constantly, recently even calling for the elimination of the H-1B visa program for foreign techies, which sent chills down the IT sector's spine."
It's not just illegal immigration Sessions opposes, he's also fond of spreading the canard that all immigrants are a drain on the economy and take the jobs which are the birthright of all native-born Americas, when in fact, the opposite is much closer to the truth.
As Nick Gillespie noted, Sessions' hostility to the free movement of people also makes him no friend of free trade. On that topic, Daniel Griswold wrote at Cato at Liberty that "Sen. Sessions supports our freedom to trade only as long as it does not affect any noisy special interests in his own state."
2. He thinks only bad people do drugs, m'kay.
After previously mischaracterizing certain countries' efforts at drug decriminalization as "legalization" and incorrectly arguing that they have "failed," Sessions lamented that Nancy Reagan's Just Say No campaign against drugs has been relegated to history and replaced by a growing tolerance for the legalization of adult recreational use of marijuana.
At a hearing earlier this year, Sessions said:
I can't tell you how concerning it is for me, emotionally and personally, to see the possibility that we will reverse the progress that we've made….
It was the prevention movement that really was so positive, and it led to this decline. The creating of knowledge that this drug is dangerous, it cannot be played with, it is not funny, it's not something to laugh about, and trying to send that message with clarity, that good people don't smoke marijuana.
Reason's Jacob Sullum wrote of Sessions' comments:
This is not the first time that Sessions, who served as a U.S. attorney during the Reagan administration, has pined for the days of Just Say No. But crediting Nancy Reagan for a decline in drug use that began before she latched onto her pet cause is scientifically problematic, and so are the messages Sessions wants the youth of America to hear—especially the idea that "good people don't smoke marijuana," which condemns at least two-fifths of the population (and probably more like half, allowing for underreporting by survey respondents).
3. He's willing to abandon his fiscal conservatism to appease Trump's plans for a YUGE increase in defense spending.
Politico has described Sessions as "a budget hawk more than a defense hawk," which would actually be in line with libertarian values of reining in the wastefulness that defines a great deal of defense spending.
But by boarding the Trump train, Sessions appears ready to abandon his fiscal conservatism and back the next president's plan to add over 70,000 troops to various branches of the military, scores of ships to the Navy's fleet, and any number of improvements to what is already the world's most expensive military many times over by adding a minimum of $55 billion in spending.
4. He's pretty hung up about "the gays."
In an appearance on Morning Joe in 2009, Sessions sympathized with those who "might feel uneasy" about the prospect of a gay Supreme Court justice, which he described as "big concern."
Unsurprisingly, he also called the Supreme Court's 2015 ruling legalizing gay marriage across the country "unconstitutional" (he had previously voted in favor of a ban on gay marriage to be enshrined in the Constitution), and was one of 31 Senators on the losing side of the 2010 Senate vote to end the ban on gays in the military.
5. He has an aversion to civil rights, and has been accused of using racially insensitive language in the workplace.
Sessions had been nominated by President Ronald Reagan for a federal judgeship in 1986, but his nomination was torpedoed after multiple allegations that he used racially insensitive language to colleagues were leveled against him.
A former US Attorney (Thomas Figures) and another Justice Department employee (Gerald Hebert) both testified that Sessions had described the National Association for the Advancement of Colored People (NAACP) and the American Civil Liberties Union (ACLU) as "un-American" and "communist-inspired." For his part, Sessions himself said during his confirmation hearings that these groups could rightfully be called "un-American" when they "they involve themselves in promoting un-American positions," particularly when addressing foreign policy issues.
Hebert also testified that Sessions had claimed these groups "forced civil rights down the throats of people," and Figures (who is black) claimed Sessions had called him "boy" and had said that he used to like the Ku Klux Klan until he found out some of its members smoke marijuana. Sessions claimed he was merely joking about the KKK.
Bonus fact: Sessions voted in favor of a ban on "flag desecration" to be added to the Constitution.

As Ken pointed out yesterday, one big reason for the proposed list of shitty cabinet appointees is Trump's pariah status among GOP bigwigs. His talent pool is relatively limited (more than usual for government even) to people who are themselves politically radioactive; Palin, Gingrich, Christie et al, people whose common thread is the fact that they have nowhere to turn but Trump to see their political prospects rise.
Yeah, he had a limited pool of washed up has-beens to choose from the short list of Republicans who supported him during his campaign. Now would be a good time for Republicans to reach out and make nice with Trump. Like it or not, policy and implementation are about Trump for the next four years--and competent leadership is important.
As much as a social conservative as Sessions is, he was loyal to Trump and he's competent--even if he's wrong. That should give him first pick or something near to it.
The other competent and loyal people aren't in cabinet level positions--Bannon and Priebus are advisers. Priebus should be on the phone looking for competent appointees and selling them on Trump.I hope some better Republicans are willing to come forward. Carson had a future, but he turned Trump down?
You can only recruit the people who will work for you, and right now, Trump's list of available appointees looks like the cast of The Expendables--old war horses who had no future to lose when they bet their political future on backing Trump.

And if I were someone like Thomas Massie or Rand Paul, I'd be reaching out to Trump if not for a post for myself to mitigate the damage that would inevitably be done by someone like Bolton or Gingrich in that position. At the very least, I'd be trying to steer Trump away from throwing his lot in with the likes of Gingrich and Bolton by offering an olive branch to work with my faction of the GOP.

Simultaneously endorsing Trump's call for less involvement in the ME and supporting John Bolton indicates a slight lack of understanding.
So (1) is Bolton nominated, or just a faint hope by the war party and temporary bogeyman for the non-interventionists?
(2) If he is in the cabinet, will force more meddling in the Middle East, or go along with his boss's non intervention ideas?

The basic strategy of immigration reform: propose legislation to fine employers who hire illegals, get your colleagues to torpedo any such legislation, and then say, "The first step is to round up 3 million violent criminals, drug dealers, and gang bangers, and bus them out of the country. Preferably to a place far away so they don't return so quickly this time. And oh - build a wall. Just got 10 feet higher, smartass."
It's a start.
My main concern with Sessions as Attorney General is that he would be reluctant to continue Obama's policy of tolerating retail marijuana (both recreational and medical) so long as retailers were complying with state and local laws.
I think that's basically an executive order level decision, and Sessions wouldn't hold the DEA back from prosecuting marijuana retailers and growers like they were Colombian cartels. He'd make an example of California and Massachusetts--where neither the Republicans nor Trump have anything to lose.
Given the Supreme Court's stance on marijuana as it pertains to interstate commerce, I wouldn't expect any sympathy from the courts either. At worst, if people can find seeds, they'll be able to grow their own, but I was hoping for better than that.
I haven't seen that Trump's on board with legalization either, and he'd have to tell Sessions no--if Sessions as Attorney General were in charge of the DEA. Even if Congress could pass a law protecting the states on the issue, I'm not sure Trump would sign it.

He's going to nominate Cruz, who will take a federalist approach. This also means that sanctuary cities can survive. But that's all part of the plan. Trump just needs someone he can blame for certain 'departures from campaign promises' and Cruz is the man who can play that role.
Cruz would be stupid to accept. He loses his seat, takes the heat for everything that Trump does domestically and ruins his career. Its a no win for him.

It's a matter of numbers and individual priorities. Opposing Sessions for his view on pot is, to many people, about as relevant as opposing him because of his view on street mimes.
I think you vastly underestimate the number of individuals for whom this is a priority.

I think ending the drug war is of vital importance on all sorts of issues--from crime to race and civil liberties.
It's important to me, anyway.
At some point, I'll get to stop thinking about how glad I am that Hillary didn't win and start judging the Trump Administration on its own merits. I guess I'm starting to warm up to that.
Ending the drug war would be a good thing. We also have wars on: fossil fuels, personal choice in everything from flush toilets to automobiles, use of land as its owners want to use it and freedom of association, to name a few.
Most people are more affected by these wars than the drug war because very many people choose not to mess with illegal drugs, but it is much harder for them to choose to avoid things like high energy prices.
The drug war has been the biggest threat to our constitutional rights in so many different ways, nothing else comes close.

Sessions wants it to end, too. With victory over all drugs and all who use them. War does not determine who is right or wrong, only who is left. If Sessions thinks the war on vice is something that can be won, he's sorely mistaken. He's fighting something older than Jesus, he's fighting human nature.
Trump has promised not to interfere in legal marijuana states. Also MJ won big at the ballot box. Trump is a populist but not an ideologue. Weed is safe for now.
Being against H1-Bs isn't necessarily the same as opposing all legal immigration. H1-B is a terrible compromise between free migration and corporate protectionism. On the one hand, H1-B holders have to have a sponsor to remain in the US, often allowing their sponsors to pay below market rate. Such that the second an H1-B holder wins a green card, they often move on to another position in the same field at a different company making the "native" wage. But hey, there I go hating the idea treating smart immigrants who haven't been here long enough to get a green card different from those who have. Shikha will probably explain my false conscience on that soon.

And if Sanjeev has the same skills to do the job, and at a lower wage, isn't the fact he is unable to do so without a certain class of visa proof that the "market" wage had been unnaturally inflated through labor protectionist immigration restrictions?
I think that Sanjeev should be able to immediately work in a wider pool. This would lower the prevailing wage across the whole pool, yes, but I've also seen several H1-B people get a pretty shitty deal just to be in the states. Their work was at least as value-productive as mine and they got paid way less, by an arbitrary and useless distinction.

And then you took your average, red-blooded Trump supporter, sat them down, and showed them clips, side-by-side, of Trump praising Cruz for the extraordinary job he'll do as AG and then denigrating him as a worthless liar who nobody likes. What's that hypothetical Trumper's reaction?

Almost anybody that Trump picks is going to be denounced by somebody as a racist, a word that is quickly losing its meaning due to overuse. However, Sessions prosecuted a leader of the KKK and fought against segregation. Is a single overhyped comment he made 30 years ago make him worse than the revered Robert Byrd, the Democratic senator who actually was a member of the KKK? His views on defense spending and legal immigration are really irrelevant: his work as attorney general does not involve making new immigration laws or crafting defense budgets. I believe that homosexuality is completely moral, yet find nothing wrong with Session views on homosexuality as a constitutional issue. Like abortion, homosexuality is not found in the constitution, and therefore homosexual marriage should be a state issue, and I see no reason why soldiers need to publicly proclaim the sexual preferences when more serious issues are at hand.

Reason would do itself justice if it would focus on stuff that Sessions actually had control over. Attorney General Sessions will likely shape the Trump Administration's policy toward state wide drug reform and criminal justice reform. Screeching about racism does nothing but make you guys look like Slate Magazine. And I say this as someone who is genuinely concerned about the direction a Trump Administration will take on issues such as Criminal Justice.

1. How as a U.S. Attorney he filed several cases to desegregate schools in Alabama.
2. How he prosecuted Klansman Henry Francis Hays, son of Alabama Klan leader Bennie Hays, for abducting and killing Michael Donald, a black teenager selected at random.
3. How he insisted on the death penalty for Hays. When he was later elected the state Attorney General, Sessions followed through and made sure Hays was executed.
4. How the successful prosecution of Hays also led to a $7 million civil judgment against the Klan, effectively breaking the back of the KKK in Alabama, which has never regained a foothold in Alabama.
