12-Year-Old Girl Arrested for Pinching Boy's Butt, Sent to Juvenile Detention
"I regret it because I didn't know it would lead to this."


Police arrested a Longwood, Florida, 12-year-old girl for pinching a male classmate's butt during school hours. Breana Evans has been charged with misdemeanor battery and was temporarily placed in juvenile detention.
Everybody involved in this story—Breana, her father, the cops, her alleged victim—thinks the arrest is an overreaction. Everybody, except the boy's mom, who alerted police and demanded that they prosecute.
"I regret it because I didn't know it would lead to this," Breana told WPTV.com.
Breana claims she didn't know the boy. She pinched him because that's just something her friends do. Keep in mind that she is 12.
The school resource deputy—that's the police officer who patrols the school—didn't charge her with a crime because the boy didn't want to press charges. Instead, Breana was suspended.
But the boy's mother insisted to police that he was the victim of battery, and so they had no choice but to arrest Breana. She was Mirandized and put in a patrol car. They took her mugshot and booked her into juvenile detention.
The state attorney said that Breana will have to complete community service, submit to drug tests, and take classes. If she does all those things, the charges will eventually be dismissed.
Breana's actions were wrong. She should not have violated that boy's personal space. It was appropriate for the school to tell her to keep her hands to herself, and even to give her some light punishment. But a suspension seems a tad overboard, unless the boy was deeply humiliated or scarred. Nothing in the story suggests that this was the case.
Part of growing up is learning to respect other people's boundaries, and schools should play a role in instructing kids to behave like adults.
The police, on the other hand, have no role to play in the lives of non-violent, non-troubled kids who are making typical kid mistakes. It is ludicrous to charge Breana with a crime. She's not a criminal, she's a normal pre-teen. Kids push each other around. They mess with each other. Police should interfere only when such conduct is actually threatening. A kid who repeatedly punches another kid might deserve a visit to juvenile detention. A kid who pinches another kid deserves a time-out.
But given the new obsession with child safety, and paranoia about sex crimes, I'm actually a bit surprised Breana hasn't also been charged with sexual harassment. If Breanna were a boy and the victim a girl, perhaps the authorities would have imposed a harsher sentence. (A 13-year-old boy in Maryland who kissed a 14-year-old girl on a dare was charged with second-degree assault.)
"Lord, lord, lord, what's this world come to?" asked Breana's father. "Kid can't even be a kid."
And that's exactly the problem. When we expect perfect behavior from children, we set them up for failure. If they're not allowed to make mistakes, then they're not allowed to grow up. Putting a kid in jail for a one-off physical encounter is cruel, it's unnecessary, and it betrays a profound naivety about the social development of young people.

If the kids are 12 at this point in the school year, I'll assume the kids are in 6th grade, so it would've been 1988 or so for me. I went to a religious school in 6th grade, so punishments would've been more severe than most.

When my daughter was in jr high, some kid on the bus grabbed her breast. I guess he did it several times and so she finally told the bus driver, who informed school authorities. This was about 12-13 years ago, my daughter would have been 12 then. The fucking idiots called the law. I couldn't believe it. I had to go in and stress to them that I did not want the courts involved in it and that we were not under any circumstances pressing charges against this kid and for them to just handle it. It wasn't as easy as you would think to get them to back down, they wanted to prosecute this 12 year old kid. It finally got dropped.
This is why they invented corporal punishment. Strong deterrent. No wasted time or permanent record.

Back when I was in middle school (75-78), that happened all the time. Us kids dealt with it. There were no trauma specialists, lawyers or cops required.
When I was in 8th grade I was sitting in class next to a chick with huge tits (known her for a long time, weren't great friends but we had hung out outside of school once or twice). Anyway one time she stretches in her chair, arms over her head, chest pushed out, really loosening up from an exhausting day of hell (school). No conscious thinking happened on my part, but her breasts were jutting towards me and i was holding a pencil and I just sorta poked her in the boob with the eraser, I may have even said, "poke" in a snarky fashion.
Probably a jail time offence by today's standards. But jail wouldn't have been necessary, I learned my lesson; had an instant karma moment (you know those). She made an involuntary jerk when my eraser poked her boob and my pencil jammed back into the flesh of my hand; stung like a bitch and I instantly felt like a dumb idiot.
Possible other side to story: Boy is victim of constant harassment and bullying by classmates including the girl, perhaps she's even the ringleader. Mom is simply seizing on this particular incident to finally get some justice for all the abuse, via the hysterical harassment laws. 12 is after all, right in the age range where this kind of thing goes on, and at that age girls are often bigger than boys. Plus this particular girl looks especially big for her age.

The story says nothing about the relationship between the boy's mother and father. I presume it's not very close. Are they separated? If not, they might be after this. Should one parent be able to insist on pressing charges in a case like this, when the other parent, and the child victim, don't want to?
The girl says that pinching bottoms is "something her friends do", in other words "everybody does it". I wonder how true that is. They shouldn't, of course, but maybe they do. If students were explicitly taught the NAP, they probably wouldn't do stuff like this. But I guess that is too much to hope for.

She was unwise to do an interview on camera using her name, now there will be no privacy for her when she's older and employers google her name. Moreover, the charges will not just be "dismissed" if she agrees to the prosecutor's terms. It's called a diversion, and it's an admission of guilt that is later expunged, but many institutions treat it the same as a conviction, this includes the military, security clearance, professional licensee boards (nursing, law, banking, etc). Law forums are filled with people who didn't understand they'd lose their job when they agreed to a diversion, they just heard charges will be dismissed.
A similar dodge is to hold a case in abeyance and take it off the dockets. Immigration courts do this and can suddenly schedule a hearing that, if missed, means automatic deportation. It is a sort of Sword of Damocles hanging over people and neither admits them nor grants them a visa nor deports them. It merely takes the case off the docket until straws can be tossed into the political winds at some future date. But this trapping of teenagers is character assassination pure and simple.

Maybe, just maybe, the boy's mom has read about the many boys being humiliated and facing charges for similar pranks and is just angry about it. She may have read about the ongoing "war on boys" and decided that turnabout is fair play. As the father of a all-male rowdy boy, I can empathize with her if this were the case. We know you stink, but you must play. Get the fuck out of here! If I didn't make a team I would work hard, practice and try out again. Same if we lost a game. It's the pampering and coddling of these entitled kids that will doom us! I couldn't imagine the grief I'd have taken from classmates if my mom would have been foolish enough to do this. But then again, my mom knew how to raise a man.
