College Students Are Infants and Deserve Zero Free Speech or Sex Rights, Says Slate
Wow


Eric Posner—a University of Chicago Law School professor and son of famed federal judge Richard Posner—makes the case in Slate that college students don't really deserve free speech or due process rights. He also chides libertarians outraged by campus censorship for thinking that 18-year-olds—infants, in his view—are intellectually capable of thriving in a non-coercive environment.
Conservatives and libertarians are up in arms. They see these rules as an assault on free speech and individual liberty. They think universities are treating students like children. And they are right. But they have also not considered that the justification for these policies may lie hidden in plain sight: that students are children. Not in terms of age, but in terms of maturity. Even in college, they must be protected like children while being prepared to be adults.
There is a popular, romantic notion that students receive their university education through free and open debate about the issues of the day. Nothing could be farther from the truth. Students who enter college know hardly anything at all—that's why they need an education. Classroom teachers know students won't learn anything if they blab on about their opinions. Teachers are dictators who carefully control what students say to one another. It's not just that sincere expressions of opinion about same-sex marriage or campaign finance reform are out of place in chemistry and math class. They are out of place even in philosophy and politics classes, where the goal is to educate students (usually about academic texts and theories), not to listen to them spout off.
But it's not just inside the classroom where students should be prisoners of tutelage, argues Posner:
Most of the debate about speech codes, which frequently prohibit students from making offensive comments to one another, concerns speech outside of class. Two points should be made. First, students who are unhappy with the codes and values on campus can take their views to forums outside of campus—to the town square, for example. The campus is an extension of the classroom, and so while the restrictions in the classroom are enforced less vigorously, the underlying pedagogical objective of avoiding intimidation remains intact
Second, and more important—at least for libertarians partisans of the free market—the universities are simply catering to demand in the marketplace for education. While critics sometimes give the impression that lefty professors and clueless administrators originated the speech and sex codes, the truth is that universities adopted them because that's what most students want. If students want to learn biology and art history in an environment where they needn't worry about being offended or raped, why shouldn't they?
Wow.
First, let's zero in on students having to "worry about being offended or raped." Note that these two concerns, casually presented side-by-side in the article, are not remotely comparable. Rape is a violent crime that is rightly illegal under state and federal laws; offense is not. Students absolutely have the right not to be raped, and universities are legally obligated to provide reasonable protections for students. While it's impossible to guarantee anyone's safety all the time, and rape remains a reality for many women, students shouldn't really live in constant fear that they might be raped, since it happens rarely—all too frequently, sure, but rarely. And campuses are relatively safe places for women, despite headlines implying the contrary.
Offendedness is an entirely different matter, and there's every reason to think that artificially protecting students from it is not ultimately in anyone's best interests. If a student manages to graduate college without ever having been offended, would we say that the experience was worthwhile? Doesn't growing up, becoming educated, and entering civil society require that young people learn to confront uncomfortable ideas? Real-life does not come with trigger warnings, and a person who has spent four years in the good-feelings Matrix will not be prepared to interact with actual human beings.
Posner's claim that 18-year-olds are actually biologically incapable of handling free speech was expertly dismissed by Foundation for Individual Rights in Education President Greg Lukianoff when he encountered this argument while testifying before the U.S. Commission on Civil Rights last year, so I'll let him rebut it:
MR. LUKIANOFF: I've rarely heard that argument made so directly. Essentially, just to summarize it, the way I've heard it made in the past is essentially that what we're really saying is that 18- to 22-year-olds are children. And they must be therefore treated the same way as K through 12 are. They can't handle the real world. They can't handle the duties of citizenship. It's an argument that I've definitely heard.
And if you're saying that basically we should—that maybe below-graduate-level study should be ruled the same way high school students should be—I would disagree with you.
But that's definitely an argument that people should make that straight out, but you run into a couple moral and philosophical problems with that.
One of them is the moral and philosophical underpinnings of the 26th Amendment. Essentially, we have decided in this country that 18-year-olds… that is considered the age for majority.
We also send our 18-year-olds to war. Unless you're actually also willing to make the argument that nobody below the age of, I don't know, 22 should go to war, and we repealed the 26th Amendment, we've got a serious problem.

MR. LUKIANOFF: I just want to make one last point, and do not forget that some of the greatest contributions of colleges and universities come out of their graduate and Ph.D. programs. And so what I've watched is people try to argue that because of the presence of some 15- to 16-year-old super-geniuses at some of these campuses, that we should be therefore limiting speech on college campuses, forgetting that [that] would also limit the speech of 45-year-old Ph.D.'s.
Posner's notion that this is merely the education market giving customers exactly what they want is also ludicrous. Higher education is not a free market by any stretch of the imagination. The market is dominated by public universities and publicly-subsidized private universities. Many of these institutions are explicitly required by the U.S. Constitution to grant their students free speech rights, no matter how desperately some segment of the student population craves censorship.
To pretend that administrators have played a limited role in the growth of campus censorship in the last two decades is similarly nonsensical. Administrative bloat is an undeniable problem at many colleges; campuses are flooded with vice presidents for student life and assistant directors of residential activities. These administrators don't sit just sit around twiddling their thumbs (not all the time, at least)—they are actively policing speech on campus.
But he is right, perhaps, that all too many students actually want and expect to be treated like children. This is a real problem—worsened by years of letting the hecklers win—not the correct state of emotional development for college students.

There was a time when teenagers were expected to work manual jobs, contribute to the family income, and basically get on in the world without being held by the hand.
When technology and industry made that less of a necessity, ~17 became the age when people were expected to take an adult responsibilities.
Now this guy is saying it should actually be 22. And if he had his way, in 50 years it would be 26 year olds.
That wasn't technology and industry, that was politics and social engineering. Keep the 15 year olds out of the job market so that instead of junior making $12 an hour in barely-skilled labor and Dad making $16 an hour in barely-skilled labor, Dad can make $20 an hour in barely-skilled labor because the supply of barely-qualified workers is lower.
A net negative for the family, but Dad feels better about himself and gets to be in a higher tax bracket.

Perhaps the bigger issue is that children - real children - have for several decades been denied basic rights and the chance to learn responsibility. If we don't start recognizing the rights of children we will see this argument creeping forward with every generation until future generations will not have their rights recognized until the moment they die.
As for holding 14 year olds responsible for murder - I agree that it is hypocritical. Either recognize that 14 year olds have most if not all rights, or don't presume they have the capacity to be held responsible for their actions. I am reminded that the age of consent, back when it was 10, was to protect children under that age from the government. Ten years and older were held responsible for such "crimes" as fornication.

Could part of it be parenting as well? Parents not wanting to parent and instead be their children's "best friends?" I also wonder if it is partly because parents are afraid that if they discipline their children they will have the authorities called on them.
As a parent of teenagers the later is far more common than the former.
I have encountered very few parents who worried overly much over being their kids friends. Nearly every parent I have ever talked to has been terrified of CPS showing up on their doorstep.
Eh, a while back when my buddy's son was giving him a hard time about being disciplined for his antics and threatened to call DYFS, my buddy just picked up the phone and said, "good, here's the phone, you want me to dial it for you? Just understand that you will be removed from us and will never see me or your mom again". Bluff called, the kid STFU and behaved himself.
The fear is not that the kid will call and rat them out.
The fear is that the kid will say something that will be intrepreted in the wrong way by a teacher or that they will employ corporal punishment, leave a mark and someone will see it.
I've actually had it happen to me.
When he was 9 my now 15 year old did something stupid. I open hand smacked him on the ass and him being very fair skinned left a bruise.
A couple of days later we were in a restaurant and he went to the bathroom. Somehow someone in the bathroom saw the bruise and actually called the cops. As we left the restaurant the literally stopped us in the parking lot and conducted a criminal investigation to determine if I was guilty of child abuse.
Fortunately my entire extended family was present including my Inlaws who were both career army and pretty well known in the community, but imagine if it was just me and the kid.
In a world like that you don't dare do anything to really punish your kids.

When I got tired of waiting for my ex to file our uncontested divorce and did it on my own so I could move on with current wife who I already had kids with the ex conspired with a friend of hers to make some anonymous allegations of child neglect against us.
Their mistake was doing it over LiveJournal and forgetting that I still knew the ex's LJ password.
So when the caseworker showed up the day after the divorce was final we knew who was behind it and were even able to log in and show them the thread where the entire scheme was cooked up. Still it took 2 weeks to get CPS out of our hair and even though there was a specific crime in the books for knowingly filing a false report of child abuse/neglect in the state we lived at the time the police refused to pursue the case.
That's what I suspect. I see too many parents issue tepid "bad decision" responses to their kids' bad behavior. Something about being in tune with their emotional needs.
They have the franchise and are legally adults for everything but drinking, which, incidentally, is stupid. I say this as someone who thinks the last few generations have been stretching out immaturity more with each iteration. Even so, they're adults.

Why are today's 18 year olds so unprepared for living in the real world? Why? What did we do to them? I say we because I have a 26 year old who has no job, no ambitions and no future. I don't understand it. At 18 I was married by 26 I was preparing to buy my second house after selling our tiny "starter" house. My kids were 7 and 4. I don't know what I did wrong.
Whatever the cause the solution is certainly not to keep treating them as infants but to demand that they act as adults and face the consequences of not doing so. Using being offended and rape in the same context is offensively idiotic.
Every generation has critiqued following generations, that's a fact. In spite of the fact that I'm now the grumpy old man, something is seriously wrong with how these generations are turning out. The fault can only be laid at the feet of their parents and I accept that my kids are my problem and I'm 1 for 2. One is independent and productive and the other still acts like a child. Only 3 years separate them and I'm baffled by the results. A parent's primary job is to ensure that their kids can lead happy and productive lives. That they are ready for living in the real world once they pass into adulthood is the most important thing.
Cut your child (not that they're a child any more) off, and they will grow the fuck up fast. But you have to be willing to be that harsh. Some people, regardless of when they were born, will be lazy shits unless you do not allow them to be.

You have to appeal to the emotional side that your wife is using to "think." you have to make it out as if she is actively hurting the kid by coddling him. She has to feel her way to your position, and that involves much guilt and angst. It will not be a fun transition for her, but it is one that she has to do unless you plan of permanently housing your son.
How do I know? I'm 26,and surrounded by people with parents in the exact same position as you. One of the parents (generally the mother) has the other's balls in a vice because "It's my baby, and we can't let him fail!"
Here's the reality. Those kids are still making minimum wage, struggling to figure themselves out. Those who were kindly shown the door after turning 18 (i haven't lived at home since age 17, except for a couple months at a time between semesters during undergrad) are already well into adulthood. Many of my cohort are married, having kids, own a house, have advanced degrees, and make well over median salaries.
I personally live 800 miles away from one parent an 1000 miles away from another. It was scary at first to live so far away, but I wouldn't trade it for anything. It allowed me the space to figure out who I am apart from parental meddling. I certainly wouldn't be married, in law school, a homeowner, and supporting my own family if I didn't have that opportunity away from my parents to gain the skills and confidence needed to survive on my own.
Another thing to add. This is an issue of culture and of society, true. However, this is proximately an issue of parenting. Teachers are not to blame for entitlement, college professors are not to blame, government is not to blame. The one who is at blame is the parent that decided it was OK to let these people have the vast majority of influence over their child's life, leaving little room for parental influence.
I don't mean this to be offensive, but it is harsh. I have no pity for parents who look up after 20 years of letting the government raise their child and don't recognize the person who their child grew up to be. I don't quote scripture much around here for obvious reasons, but the Bible says "train up a child in the way he should go; even when he is old he will not depart from it." The correlary to that is that whomever truly trains up your child dictates the way he goes.

That's what my dad did to me in the late 70's. I did grow the fuck up fast. Mom wasn't pleased then but later she was.

As for the ambition/motivation thing, consider the marriage laws. The only reason for a guy to do the work to make lots of money is to support a family, but nowadays getting married just means you're going to get divorced and have half your money taken away. There's no incentive for any man to make more than enough for a moderately comfortable lifestyle and just enjoy his remaining free time. You could say they should make money to attract a wife, but even assuming you could find an actual GOOD woman, you'd be ignoring the fact that the regular stress relief from regular sex and cuddling, and the lack of a need to go out to socialize (and FIND a wife) that comes with having a wife are what HELP a man cope with working extra to make extra money.
Get me a good woman (again, probably doesn't exist) and I'll make all the extra money we could want over the next 40 years. Until then, I'll just use my real skills (as opposed to credentials) to make a comfortable life, and get sex as much as I can from dating, which is available.

Two problems:
1. Many of these codes are implemented when spineless administrators give in to demands from a vocal and irritating minority of students. Student activists have a disproportionate voice on college campuses, and their desires are often implemented to the detriment of their classmates.
2. The remaining codes are frequently enforced by the Department of Justice, particularly since Eric Holder started using the DOJ to strongarm colleges into implementing his preferred speech/sex codes. Colleges have been threatened with removal of funding if they didn't comply.
Eric Posner is stupid enough to think this is a free market.
Thirdly, if students are so insanely immature that they are unworthy of free speech or sex rights, why on earth would you then treat their opinions on the codes as valid? When did college kids become such huge pussies? I went to college in the 90s and I had one roommate who hung a confederate flag in the window and another who was an Indian (feathers, not dots... I wish something like this had been around when I was going to school. As someone who has to hire developers, I can tell you something like this school is perfect. When I review resumes now, I only look at the education section out of curiosity. I could care less if they graduated. All I care about is their recent experience.

I thought my parents' approach to the kids reaching adulthood was pretty clear and direct.
Once we graduated from high-school, we were welcome to live at home so long as we paid room and board. It wasn't a huge amount of money; the intent was not punishment, merely enough to make it clear the free ride was over.
