Federal Agent Thinks Dad Taking Picture of Daughters Is Sex Trafficking


Every summer for the past 14 years, Jeff Gates has taken a picture of his two daughters hugging on a ferry boat as they travel to their summer home on the Jersey Shore. This year, as he was completing the annual ritual, a stranger came up to him and said, "I would be remiss if I didn't ask if you were okay."
He was talking to the daughters. It took a minute before Gates realized what the stranger meant by the comment. As he recounts in The Washington Post:
At first none of us understood what he was talking about. His polite tone and tourist attire of shorts, polo shirt and baseball cap threw us off. It took me a moment to figure out what he meant, but then it hit me: He thought I might be exploiting the girls, taking questionable photos for one of those "Exotic Beauties Want to Meet You!" Web sites or something just as unseemly. When I explained to my daughters what he was talking about, they were understandably confused. I told the man I was their father. He quickly apologized and turned away.
Gates and his wife had adopted the girls from China, making the Gates a mixed-race family. Should that automatically set off warning signals? Gates thought no. So, after a time, he tracked the man down and confronted him:
I walked outside to where he was standing and calmly said: "Excuse me, sir, but you just embarrassed me in front of my children and strangers. And what you said was racist."
The man didn't seem at all fazed. He replied: "I work for the Department of Homeland Security. And let me give you some advice: You were standing there taking photos of them hugging for 15 minutes."
And there we have it: He's from Homeland Security. He is paid by the government to suspect the very worst at all times and butt in.
When the government is telling Americans that we should be on guard against everyone, everywhere, at all times ("If you see something, say something"), it might start to seem plausible—likely, even—that a sex trafficker would take photos of his sex slaves, in public, for 15 minutes. In reality, of course, that's absurd.
A week later, on the ferry ride home, as my oldest and I were walking on deck, I suggested that we imagine the other passengers through this man's eyes. She grimaced but agreed. It was so easy to project suspicious stories onto the white woman trying to grab a black child — instead of seeing a mother running after her son. Or to suppose that an old man was taking inappropriate photos of a young girl — instead of seeing a grandfather capturing a special moment with his granddaughter. We talked about this as we walked around the deck.
The deliberate decision to engage in worst-first thinking—thinking of the very worst case scenario first and proceeding as if it's likely to happen—is not only what gets fathers treated like traffickers, it also gets moms arrested for letting their kids play in the park ("What if the child was kidnapped?") and other parents arrested for letting their kids wait in the car for ten minutes ("What if they left them there all day?").
Worst-first thinking, the authorities say, is the kind of thinking that makes us safe and secure. And I say it makes us paranoid and cruel.

When you can claim "because security" or "because drugs" or "because child abuse" or "because sex trafficking" any time you feel like exercising your nearly unlimited power, then of course that's what you'll say. Always remember, the government has it's own interests at heart, and this is true from the most singular member to the most bloated bureuacracy.

Seriously, if this guy was indeed a DHS employee, he probably had the least offensive interaction with a citizen in the history of the department. He asked a question, got his answer, apologized for the offense, and then left them alone. Then the writer went and called him a racist.
This supposed DHS guy didn't violate the writer's rights in any way, shape, or form. He walked up to him in a public place and asked a question. He did not detain, arrest or demand ID.
The best counter to the Orwellian nanny state is an active and engaged citizenry who looks out for their fellow human beings through a robust and polite civil society. If this curious man was indeed a federal agent, then I wish all federal agents were so polite, circumspect, and reasonable.

I don't think it's been established that the guy was a cop. Anyone can say, "oh, I'm a government sex crimes inspector, and that's why I was staring at your teenage daughters for 15 minutes."
All we know is that some middle aged guy took an inordinate interest in a couple teenage girls who were out with their father, and the middle aged guys thoughts immediately went to sex.
Problem is, this is a day and age where, yes, government employees will do anything to anybody anywhere for any reason.

You're right that the agent chose the least aggressive action he could have taken, other than inaction. However, that doesn't mean that what he did wasn't a problem. Imagine growing up as an Asian girl with white parents, and getting constant reminders from the people around you that people don't see you as a real family. Imagine how embarrassing it would be to have a stranger think that you were being sex trafficked by your father.
If the girls are at all worldly, they would also realize that if a polite and reasonable government agent thought it necessary to confront them with their father, they have reason to fear a less reasonable agent in the future.
Confront them? He asked a question. A simple question.

He asked a very polite question, got an answer, and then apologized for being rude. The other stuff only came up because the dad went and talked to supposed DHS guy. Which I note again, was just another conversation between adults. No one was arrested or threatened with arrest. No one was physically assaulted or threatened with same.
We're also only getting one side of the story, and probably will never get the other POV. But the guy telling it is not an unbiased observer, although I think he told it pretty straight, though with a tendency for claiming victim status.
Maybe you and I have a different idea of what politeness entails, but I don't view coming up from behind someone and addressing two girls with "I would be remiss if I didn't ask if you were okay" while not acknowledging the man who probably is their father to be polite at all. It is a statement that establishes one's authority over another. By saying he would "be remiss", he is saying that what he is observing requires him to be legally obligated to intervene.
Again, if you came up to me from behind and started to address my daughter without acknowledging me as well, my own protective instincts would kick in. Now I'll admit that I have some bias as a reserved New Englander who views any question past "how are you doing" to be an uncouth imposition; nevertheless, approaching someone on the lido deck with a glorified "Hey! I think you might be a pimp!" is not polite by any regional standards.
And not only from a politeness standpoint but a tactical one as well, wouldn't the best thing to do, if he really was that concerned, be to ask the crew of the ferry to check the ids of the 3 when they disembarked, and if they didn't have the same surnames, then intervene?
If you recall, in a similar case involving a White father who was stopped by Border Patrol when crossing into Canada with his Asian-looking daughters, I didn't criticize the agents' actions as a border crossing is a legitimate place to investigate human trafficking and that the man hadn't done enough research to know that it's customary to possess a letter from the other parent expressing consent for the children to cross international borders with only one parent.
But this isn't a border crossing, nor is it an international port-of-entry. It was a fucking ferry on the Jersey shore. If you want a world where DHS agents are paid to patrol ferries looking for violations of the Mann Act, then be my guest. Just don't call it liberty.

I don't blame the DHS guy for trying to pull rank in return. He's got a boring job, minding a ferry boat all day, and for institutional reasons, DHS is touchy about photography. Without being able to see the scene, my guess is that his inquiry had nothing to do with the teenagers at all, but only about why this guy is taking so long with pictures on a conveyance DHS is minding.

Exactly! When you are being asked by a coercive member of an often violently aggressive group it is not the same as that of a concerned neighbor. The ability of the police to lawfully attack and kidnap does not make the question a "only asking a polite question".

Yes, but to some extent profiling is bad because it tends to have so many false positives. Thinking someone is up to no good because they're black is one thing, but a middle aged white guy hanging out with teenaged Asian girls and taking their picture... well, most people would probably not intervene unless they seemed distressed, but maybe if your law enforcement, you see enough abuse that you have a different perspective?

Assuming the guy really was from the DHS, any interaction with an agent of the state entails the potential use of deadly force. What if the dad rightly said 'buzz off'? A muzzle would be pointed at his head as he would have been forced to lie the deck accompanied by screams of "obstruction of justice!" and "stop resisting, motherfucker!".

The interests of the state are best served when its citizens are united by common fear. The fear need not be rational, nor the threat even real.
The state expends enormous resources on indoctrination in its educational institutions and propaganda in its media outlets to instill fear into its citizens. That's the thing that's striking to me.

Sorry, but individuals are forced to pay for these services against their will. If, due to whatever reason one wished to no longer fund these organizations due to their poor performance, these same agencies will be sent by the state to confiscate one's things, and if there is resistance by the individual they might be killed.
My income is confiscated by force to reward inefficient agencies, no matter their performance. Where if there were competing businesses, it might take up less of my income to acquire private defense services as competition can help lower costs, and based upon how I individually value certain services, to include weighing my ability to defend myself, which would be taken into account with an individuals plan. The owner of a port and shipping company would expend more to protect their industry. Their rates could be lowered if they chose to arm their ships, etc. Such services would be tailored to the individual/s whether they have a shipping company, down to a home or apartment.

Now you made me go & read the actual story, which even has the album pix of the daughters, 16 & 17 YO at the time in question. And the more I read it, the more sorry I feel for the DHS guy (if he was from DHS) and the more upset at the photographer. The photographer tells his daughters his paranoid interpret'n of what the stranger thought, and that is what embarrassed them. Not only that, but the question he suggested in his article that the stranger ask had the potential to be more embarrassing than the neutral Q he did ask.

I have serious doubts the guy was really "from the Department of Homeland Security". Why would he identify himself as that rather than from ICE or DEA or one of the other agencies under it that actually have investigatory/arrest powers. Did the dad ask to see a badge?
Not saying that the dad is making the story up or anything, but it's also likely the dude was just a random busybody (or possibly a perv himself) who invented the DHS identity as a cover.
It took me a moment to figure out what he meant, but then it hit me: He thought I might be exploiting the girls, taking questionable photos for one of those "Exotic Beauties Want to Meet You!" Web sites or something just as unseemly. When I explained to my daughters what he was talking about, they were understandably confused. I told the man I was their father. He quickly apologized and turned away.

This guy was certainly a buttinsky but nothing like the terror of your story. At least not in the original story by the author.
