Judge to IRS: WTF?
Wants an affidavit explaining what happened to IRS e-mails amid investigation of wrong-doing
A second federal judge is ordering IRS officials to explain, under oath, how they ended up losing emails and wrecking hard drives connected to allegations that the agency targeted Tea Party non-profit groups for tougher evaluations. Fox News took note of today's order:
U.S. District Court Judge Reggie Walton told Obama administration lawyers on Friday he wants to see an affidavit explaining what happened with Lerner's hard drive. The IRS claims her computer suffered a crash in 2011 that wiped her email records at the time clean.
But at a hearing examining a lawsuit against the IRS by conservative group True the Vote, Walton said he wants to know what happened to Lerner's hard drive, which allegedly was recycled. He asked for an affidavit from those involved in handling the crashed drive.
The order is another boost for those questioning the agency's claims that many Lerner emails from that time period are not recoverable.
A day earlier, in a separate case brought by conservative watchdog group Judicial Watch, U.S. District Judge Emmet G. Sullivan gave the tax agency 30 days to file a declaration by an "appropriate official" to address the computer issues involving Lerner.
Not all of Lerner's e-mails have been lost. Earlier in the week, several media outlets (including Reason) reported that an e-mail from Lerner in April 2013 warned other IRS employees to be careful about what information they were putting in their own e-mails because Congress was searching for information.

Regardless of Lerner's claims, that data is not gone. It is resident on probably several pieces of hardware and it can be retrieved.
And, yes, as the party who is claiming it's gone, SHE and her agency should be the ones to retrieve and deliver it. In pristine condition, thank you very much, assholes!

ABSOLUTELY. I've been busy correcting the internet today, charging into forums that say "When the emails were lost in the hard drive crash, bzz bzzz," and asserting that they are NOT lost. Not only are there digital and paper backups, but the g.d. White House has THEIR copies, duh.
Quite amusing how lefties have now decided that e-files just, well, float off in smoke if the hard drive of the initiator somehow fails.
Almost like that 18-1/2 minutes that disappeared from Nixon's tape, right? I'm sure the lefties would be claiming that his secretary just sorta 'ooopsed'!

Yup, data is never lost. Even if the data-bearing book or tape or CD-ROM or hard drive gets swallowed by a black hole. Stephen Hawking lost a bet on that one. It's just, either 'A) do you have God-like powers of actually restoring that data, as in the shredded-and-burned book or the black holes cases, or 'B) In real world, in the case of the erased tape, do you have the tools of the feds, and many-many people-hours, all paid for by our "limitless" taxes, to fund that big effort? I talked to some FBI agents at a computer training class many years ago, and yes, they can pull some near-magic, getting snippets of data, in those days, off of magnet tapes that had been erased many times? In our household, though, when our hard drive crashes, we just call the NSA to restore it off of their backups, since they know everything that anybody, or their PCs, know!
