None that resulted in a dead child. Part of being a hospital is doing treage and figuring out who needs care first. They clearly failed in that.,

Not being a GYN, I couldn't tell you. But I think GYNs do something during a delivery. And not every kid born that way dies I don't think.

Not an OB/GYN, but I have delivered a baby or two in my career. This could have been easily averted in two ways:
1) Ultrasound to determine a complicated birth.
2) A simple technique called Leopoldt's Maneuver to determine the position of the baby.
How this is rectified is, quite simply, shoving a hand in the uterus and physically removing the umbilical cord from the baby's neck, something a trained midwife can do with little problem, and would have been very easy to correct in Labor and Delivery.
However, what we don't know is the HS of the mother, and whether or not she had prenatal care, and more important to me, followed her doctor's orders.
If she did neither, then under the NHS system, she's got a problem. In the US, she would have been diverted from triage and went straight to Labour and Delivery, under EMTALA.

This is also correct. Under the NHS system, you just try and sue anyone for this. Forget it, the likelihood of getting a case to trial will be difficult. And this is a priori malpractice. Anyone can sue under their "Loser Pays" type system; however, their laws restrict what is considered malpractice to keep the rates of medical malpractice cases low. That case tarran cited would probably pass muster, but IANAL nor a UK solicitor. In the US, that would not have happened, certainly not in any hospital in which I have worked.
My point is, they wanted it, they got it and they won't let go of it. And America wants it too.

Speaking of smoking. There is a big push for the entire county to go smoke free and one of the commercials features this woman who pretty much blames everyone but her self for her illness. She says she tried to quit but tobacco companies (somehow) did everything they could to keep her smoking. She basically whines for about 5 minutes about how hard it is to quit smoking. Does anyone else get this one?

Now there's an asthma commercial that blames a kids asthma attacks on second-hand smoke so parents should be pushy about others smoking around their kids.

I am reminded of last year when we took the family to Great America. They have designated smoking areas but I swear you need GPS, a detailed map, and native guides with trained blood hounds to find them. We had finally located one, a tiny 10'X 10' square marked out by blue paint with an ashtray in the middle. There was no shade in the blazing hot sun, no benches to sit on, and it was located behind some buildings by a motor pool: it was obviously a place you had to WANT to find.
We light up. A few minutes later, a woman pushing a stroller wanders up and starts the passive-aggressive whiny cough of the ardent anti-smokers. I ask her, "Is the smoke bothering you?" She looks all sorts of injured and says, "Yes." with a meaningful glance towards her spawn. I then tell her, "You need to fucking leave then. God knows how many thousands of acres in this park are devoted to your preference, but this here is MY space, so fuck off". She was not very happy.
