          Well it is interstate commerce. So I am sure MNG and Neu Mexican will find any objection to such a provision "silly".

            I know nuance is not your strong suit, but my arguments regarding the mandate can be summed up by this paraphrase of a Clarence Thomas opinion: this is an uncommonly silly law, were I a member of the legislature I would vote to repeal it, but I cannot find anything in the Constitution which prevents it.

              And if we can force people to buy insurance, we can force them to buy movie tickets, or music or anything else. It seems a bit odd that the framers spent all that time and effort creating a federal system and a limited federal government with enumerated powers only to insert a trap door in the commerce clause that allows the federal government to not just regulate virtually anything but mandate virtually any behavior.

              Sure. Under such a cockeyed scheme they couldn't tell you that you can't have a gun within 100 yards of a school. But they can mandate that every one buy one or face a penalty.

                What can I tell you, the power to regulate includes the power to direct, totally prohibit (Raich) and mandate (the history of the police power for states and localities (google Kennesaw, GA), the meaning of the word regulate in dictionairies of the time and today, and the use of the word in other provisions of the Constitution [the power to make regulations for the military in Art I. Sec. 8] all demonstrate that).

                  Prohibit in the context of commerce has never been the same as the police power. You are conflating one with the other. "regulate the commerce amongst the states.." has never been interpreted to mean "force people to engage in commerce".

                  You are just torturing the words and the history because you never met a government power you didn't love.

                    The police power has historically been referred to as the power of the state or locality to "regulate for the health, morals and safety" of citizens. It's embraced mandates like the one in Kennesaw no problem. it's bizarre to think the word "regulate" embraces mandates in state and local law, in other parts of the Constitution but not when it appears in the IC clause.

                      Yep, and the state police power is often spoke of in the law as the power of the state to "regulate the health, morals and safety of their citizens." So the word regulate obviously involves mandates there, but somehow it changes it's meaning when it appears in the IC Clause.

                  Keep in mind that Kennesaw is not Congress; and, in any event, Congress is empowered to require every member of the militia to buy a firearms (see Article One, Section 8), and has done so before (see the Militia Acts of 1792).

                  In fact, if PPACA is so dang important to you, you could just admit that we're all members of the militia, and that we're required to take care of ourselves as part of that service. But Congress didn't do that, because that admission would logically also allow (nay, require) us to purchase the tools of the infantry: automatic weapons, body armor, etc.
