Other then the fact that Ms. Hilton did not contest his claim to be the sole owner of the tape, this might have a case. Even if it were judged that he must give her co-ownership, it does not invalidate his rights to control distribution.

Good thing this guy is not yet barred, he would lose the case miserably for his client.

Except this wasn't his idea, it's what some lawyer is actually arguing. Is he right? I have no idea. I'm opposed to copyrights altogether.

The fact that hes buying it is why I made my comment. Anyone who has followed copyright law knows that this argument will never work. Copyright is extended at creation, regardless of 'filling' Trademarks on the other hand, require filling. Filling for copyright is just a formality, usually done to set ownership in stone, but is not a requirement under current US copyright.

If I jot down a 10 line poem on a napkin, its mine, if my wife happened to help me with a line or 2, she technicly could be a co-author. I could later submit that poem to be published, citing myself as the author, the fact that I did not disclose that my wife helped with line 2 and 8 does not invalidate my copyright, and Popular Mechanics could not publish my poem under the pretense of, his wife helped him he didnt disclose, its now public domain. I still retain my ownership rights. Now my wife could sue to be included as co-author, but that would be another issue all together.

Copyright law does not require that a registration be filed. But, in order to sue you do need to register. It affects the amount of damages you can claim. Also if the registration is invalid you case will be thrown out. I guess he could refile but that will take a while. And if they find fraud by not including here on the registration it could prove fatal for future registrations.

This has no effect on whether she can stop the distribution of the tape, but if she is required as registrant co-author, she may be able to mess up his attemtps to assert the registered copyright against others, defeating his ability to make money on it. Alternatively, he may actually have to share the profits on it.

This would be a wicked be wrench for his cases. You know judges think he is a sleeze ball, I could easily seeing one of them tossing his case and making him refile his registration with her name on it.

I think that Paris, didn`t realize what she was doing when she was filmin the sex tape. Everybody now is looking for this tape, and I think that on net is just 17 min tape. Just noticed I was linked-to here. A) I was just reporting, not supporting a position. B) All Salomon's attorney is trying to do is get the case dismissed (most likely w/o prejudice). For that limited purpose, arguing fraud is a good tactic. C) You don't have to register a copyright to have one, but if you do file, you have to play nice and disclose all co-authors. D) Yeah, I never really saw the Hilton's appeal either. Toodles, JB
