Half Not True
A headline in yesterday's New York Times summed up the results of a new gun study this way: "50% of Dealers Willing to Sell Handguns Illegally." But as the article explained, what actually happened was this:
Researchers at the University of California at Los Angeles, posing as potential buyers, called 120 dealers in 20 cities, giving different [reasons] for wanting to buy guns. The researchers found that when they said they wanted to buy guns for a boyfriend or girlfriend who "needs it," 52.5 percent of dealers were willing to make the sales.
As "industry officials" pointed out, there's nothing sinister about that, since "the questioning was so ambiguous that it could fall under an exemption that allows a buyer to buy a gun as a gift for someone who is not banned from owning one."
The question of an illegal straw purchase was broached with a different, much smaller sample:
The researchers also made 20 follow-up calls to randomly chosen dealers and said they needed to buy guns for girlfriends or boyfriends because they were not "allowed to."
In 16 of those cases, or 80 percent, the dealers responded with unequivocal "nos," indicating that the purchases would clearly be illegal. In the remaining four cases, the dealers agreed to sell the guns, even though they indicated that they knew that would be illegal, the researchers said.
In other words, the percentage in the headline for "Dealers Willing to Sell Handguns Illegally" was off by a factor of two and a half, and that's assuming the sample of 20 dealers adequately represented gun retailers nationwide.

Of course, widespread evasion of the law would only back the libertarian position on gun control anyway.
I think this demonstrates that a solid majority of dealers are willing to work within a reasonable regulatory system.
Ban it and they will come.....
joe,
I think you'd find in general that the more restrictive the rules, the more they get broken, and vice versa. And no rule gets followed 100% of the time, but enforced rules do affect people's behavior, to some degree (depending on a variety of variables). All common sense, that. With gun control laws, just as with drug control laws, the relevant issues are whether controls violate people's rights and whether they do more harm than good.
Nice to see the New York Times has learned from that little "inventing the news" scandal.
This was in the NYTimes. It may as well have been in the National Enquirer.
Joe,
The dealers who were willing to provide guns to those "not allowed" to buy them are the GOOD GUYS. The people who pass these "reasonable" restrictions are the BAD GUYS. Just wanted to clear that up.
Sorry, Kevin, I'm not dressed for church.
Actually, the quote says 120 dealers in 20 cities. Not 20 dealers as you state in your critique in the last paragraph.
Look lady, I'm not interested in hearing some sob story about your paranoid schiz boyfriend. Just give me the $400 and tell him to stay away from from my block.
Yeah, Kevin, people like that belong on stained glass windows.
Great. You're sovereign and I'm not.
Actually, none of the dealers sold guns illegally. They were asked if they would, over a phone. And in the only clear question of law, a total of four said yes. Note they did not sell the guns, but instead said yes. FFLs do work with the BATFE on stings. Each of the four could have then phoned the BATFE. This proves nothing other than they make the news to fit the print, or something like that.
"I think this demonstrates that a solid majority of dealers are willing to work within a reasonable regulatory system."
What this demonstrates is that if there are laws that gun dealers have to follow, or they will be fined, jailed, have thier businesses taken away, etc., they will follow them. What's your point? That's how laws work. It works that way for unreasonable regulatory schemes too.
How about a ban on polls, stories about polls, and headlines about stories about polls? That I would be in favor of.
Donovan, the question about buying a gun for a boyfriend or girlfriend who was not "allowed to" was addressed to a sample of 20 dealers, as indicated in the second excerpt from the Times article.
Curt Warner:
Sorry, but our polling shows there's no tread on that tire, so your proposal won't make it into committee.
Didn't mean to be so snippy, Kevin. Let me try again.
A willingness to put firearms in the hands of psychotics, parolees, and people with restraining orders out against them, for profit, does not qualify as prima facie evidence of being a "good guy." You wanna argue against any or all of these restrictions, have at it. But don't pretend that Al Capone was a good guy just because you like beer.
