Justice Delayed Beats Justice Denied
A dozen people wrongly convicted on charges stemming from a phony 1999 drug sweep in Tulia, Texas have been released on bond. This case showcases many of the worst elements of the drug war, including out-of-control cops, compliant courts, and racism.
From an account that ran in the San Francisco Chronicle:
They were among 12 inmates released on bond on Monday afternoon, most of the remaining people behind bars in a controversial 1999 drug sweep that led to convictions of 38 people, most of them black. Attorneys and activists have pointed to the case as an example of racism in law enforcement, and the narcotics agent who organized and carried out the sweep has since been criticized for his tactics, his racial comments and his past.
This case is still far from over but at least some sort of rectification process is underway.

When will the media, who have for years indoctrinated the public in favor of victims and against the accused, finally realize that a justice system that routinely convicts the innocent is not serving justice but another step toward a society of the opressed. They have been complicit in the systematical erosion of due process, even the awareness of what due process is. I guess calling defendants scumbags and low-lifes is easier.
It is about time we started reforming the much beloved adversarial justice and jury system, because it is fatally flawed. Too many people are too dumb to be jurors, prosecutors strive for conviction over truth and too many judges are either incompetent or only interested that their rulings are legally defensible rather than leading to the truth.
The juror convicts the defendant because he is not able to prove his alibi - a reversal of the burden of proof that seemed not to bother that juror. And the foreman of the jury that sentenced a man to 45!! years, a minister, says: "It depends what your definition of justice is. I think he is being released according to the law.I think he was sentenced according to the law. I look at it like the system worked."
A common sentiment: Convict an innocent and set him free after 5, 10 or even 20 years, the system worked. Put the blame on the crooked cop and continue business as usual. Never look at the rest of the system. The system worked. Frightening, truly frightening. Get caught up in that mill and you're ruined, no matter what the outcome. But, of course, we, the upstanding citizens have nothing to fear. We obey the law. Dream on America!

As I recall, the first couple of defendants who went to trial got 90 years. Shaken, everybody else lined up and plead guilty to get lesser time.
The lessons are plenty.
The law is so whacked out now a non-violent offender - even a guilty one - can get 90 years!
Jury trials are such a gamble and, especially if you have a PD, so unwinnable by a defendant, Prosecutors have an easy time getting their way.
The appeals process in Texas is a joke. The only way these folks got out (they're still under supervision) is when an outside judge discovered the lying undercover scum.
Prohibitive bond procedures now are unconstitutional on their face. Show up in court in cuffs and you're goose is cooked but that's precisely how most poor defendants show up. Local jails are now 95% occupied by pretrial defendants.
They finally showed a picture of the crooked cop on the news last night. He looks like a ZZ-Top wanna be. F-ing hillarious. I hope that they can deign to charge this jackass with more than mere purgury. How about obstruction of justice and possession of mullet?
The Sheriff, Prosecutor and the Judges are just as culpable. They should locked up with no bond and get some of their own judicial medicine.
