Point out there's no second hand smoke from vaping

A smokers' group sued Tuesday to snuff out the city's new ban on e-cigarettes in restaurants, bars, and everywhere else regular smokes are banned.

The group, Citizens Lobbying Against Smoker Harassment, charged in a lawsuit filed in Manhattan Supreme Court that the ban is illegal because it has nothing to do with protecting New Yorkers from second hand smoke—the purpose of the original smoking ban.

The bill, passed late last year and signed by former Mayor Bloomberg on his second to last day in office, bans using e-cigs, which emit a water-based vapor, in restaurants, bars, parks, beaches, and workplaces.
