North Dakota Highway Patrol Trooper Ryan Hoffner testified during a DUI case that he stopped Darren Lee Bachmeier's truck even though he'd observed no traffic violations. Why? Well, he saw the truck swerve within its own lane. Oh, and it was after midnight. "It is assumed that everyone on the road after midnight is a suspect for driving under the influence," Hoffner testified, according to the Associated Press, citing court documents. The judge in that case criticized that remark, but refused to throw out evidence against Bachmeier.
