South Charleston, West Virginia, police arrested Jose Cruz for DUI and driving with no headlights. They also say that while an officer was getting a breathalyzer machine ready, Cruz passed gas and waved his hand towards the officer. So they added battery to the charges. After reviewing the case, prosecutors dropped that charge.
