In early September, Rep. James Clyburn
(D-S.C.), the third-ranking Democrat in the House of
Representatives, told Fox News host Andrew Napolitano that,
"There's nothing in the Constitution that says that the federal
government has anything to do with most of the stuff we do."
Unfortunately, writes Associate Editor Damon W. Root, Clyburn was
all too correct. Congress routinely oversteps its constitutional
bounds. But as Root notes, the Supreme Court will soon have a
perfect opportunity to rein Clyburn and his colleagues back in
with the case of U.S. v. Comstock.
