It seems likely that the
Supreme Court, which last week agreed to hear a challenge to
Chicago's gun ban, will overturn the law. But Senior Editor Jacob
Sullum argues that the Court's reasoning in applying the Second
Amendment to the states could have implications far beyond the
right to arms. If it cites the 14th Amendment's Privileges
or Immunities Clause instead of the Due Process Clause, he
says, it can help revive constitutional protection for
economic liberty.
