Via Playboy's second favorite libertarian blog, a link to an interesting draft paper by Eugene Volokh on how child custody decisions may depend on parents' controversial cultural, political, or religious beliefs. On a semi-related note, I'm pleased to see that earlier this summer, Ulf Hedberg (whose story had to be trimmed from the draft version of my Aug/Sept gay adoption piece) has won reversal of a Virginia court order demanding that Hedberg's partner—a parent in the eyes of Hedberg's son—move out if he wanted to keep custody of his child.

I think of the children all the time. I'm thinking about them
now.
No wonder we have so many pedophiles in this country.
....what ? -- Playboy thinks Volokh is a 'libertarian' ?
Well, their guy Bill Maher also claims to be a libertarian
{?}
...libertarians must have a big-tent to accomodate both neocon's
& liberals ??

Hit &Run is indeed a good blog, but I find the comments
aren't nearly as high-minded or intellectual as the ones
here.
Flame war!
Flame war!
I read the whole comment. What an arrogant post, doubtless by an
elitist law school student stroking himself over his own
superiority to the unwashed masses.
A hearty "fuck off" to K1avg from this troglodytic H&R poster!
:)
Sorry OneState, That's about a flame war-like as I can get.
