The problem with Powell's legacy is not that he didn't do enough good, or that he didn't push far enough in the right direction. In some respects he may have been a positive force.
The problem is that he also took a lot of steps backward.
It's one thing for somebody to only do a little bit of good. It's another thing to do a little bit of good and a little bit of evil.

He didn't go back far enough. Matter of fact, I'm asking my friend Sam Brownback to change the FCC regulations again so that infidels like Howard Stern will be flogged instead of given a fine.

The low point of his tenure was the Saving Private Ryan fiasco. "If you air it, we might fine you, or we might not. If you don't air it, we definitely won't fine you. Why don't you just air it and SEE if we fine you?"

While I don't care for the direction that FCC fines have taken, the Saving Private Ryan "fiasco" was only cause by Powell following the BS rules that Congress has laid out for the FCC to follow. At least as far as I've been able to determine.

Spurs is right. Thierer's piece is a kiss-ass sop to the Bush admin. Note that he doesn't mention the censorship issue and Howard Stern, despite record fines and incredible FCC perfidy. It's amazing, if you just spout a few Hayek-quotes, you can increase the size of government AND get CATO-kudos...I honestly can't believe Reason printed such a kiss-ass piece.
It makes me wonder, frankly, if someone's on a government payroll, in light of certain recent events...
